RE: Gore Creek Residences Fireplace Gas Valves
Mr. Johnson,
This correspondence is to provide insight and closure to the gas shut-offvalves for
certain freplaces being installed at the Gore Creek Residences project. There are two
types of fueplace models being installed in the project. This correspondence is in regard
to the "Golden Blount Super-Fire Model SF 4224-TV" units only.
Inspections for gas-line and frreplace rough installations frst began on l/16/06, The first
set of inspections was performed for units l5 and 16. At that time our inspector Greg
Denckl4 approved the gas-piping for the unit as a whole, including the fireplaces. He did
note corrections that are required to be addressed for the fireplace installation on
mechanical permit # M05-0265 but thought the fireplace gas-line and shut-off valves
were compliant to the 2003 IFGC.
Future inspections were requested for units 13 and 14 on 3/10/06. At that time, I
performed the gas-piping inspection and noted that a correction was required because of
the location of the shut-offvalves for these certain fireplaces. This inspection was
performed and noted on mechanical permit # M05-0213. Again this correction was noted
on 3/15/06 on mechanical permit # M05-0265. It appears that there have been three
additional inspections performed on gas-lines and fireplaces for other units in the Gore
Creek Residences project. Some were approved and others were not approved showing
inconsistency on our part.
The Town of Vail Building Safety and Inspections Services team holds a weekly staff
meeting to discuss code related items. The gas-valve- shut-offissue is clearly an example
of an item we need to discuss and obtain a consistent interpretation. We first discussed
this issue on3/23/06. At that time, a vigorous discussion occurred regarding the Fuel Gas

code requirements and the subsequent interpretation. At that time I had asked for a copy
of the manufacturer's installation requirements to determine if any additional guidance
would be provided. We did not meet again as a team until 4/13/06. As predicted, another
discussion occurred without complete resolution
On or about 4/20/06,I received a copy of the manufacturer's installation requirements.
Upon further review of the manufacturer's installation requirements and research of the
code requirements, a formal interpretation was rendered. Listed below is a copy of the
email generated that is now being used as a formal interpretation:
Some history:
Prior to adopuon of the 2003 IFGC, we had the 1998 IMC or as an altemative the 1997 UMC.
The 1998 IMC stated:
"section 907, Shutoff Valves. Shutoff valves required by section 1305.1 and serving decorative gas-fircd
appliances shall be located oubide of the fireplace firebox, adjacent to and in the same room as the fireplace."
"Section 1305.1 Appliance Conrcction, Every gas outlet stlall have an individual shutoff valve. The shutoff valve
shall be in the same room and within 6 feet of the appliance served. Access shall be provided to the shutoff vafue"
Very Clear Language.
The 1997 UMC stated:
"section 1312.14 Barbecue or Fireplace ouueb, Gas oudets in a barbeque shall be controlled by an approved
operating valve located within the sarne room and ouBide the fireplace but not more than 4 feet from the oudets.
Prior codes that urere used were the UMC'S 1991 & 1988 versions that said basically the same thing.
Again Very Clear language but a conflict in regard to location and disbnce. We had to provide a judgment of the 2
codes regarding the location of the shutoff valve. It was decided then that the more restrictive of the two
requirements applied.
We now have adopted the 2003 IFGC. We also tried to review the newer code to determine if there were any
major changes that may affect our adminisfation of the new code. We also bied to review this new code to
determine if any changes were made that would affect the oukomes of future interpretations & installauons. This
may be one of those cases that we missed the shift in code language.
Here is the 2003 IFGC:
"section 409.5, Equipment Shutoff Valve, Each appliance shall be provided with a shutoff valve separate from the
appliance. The shutoff valve shall be located in the same room as the appliance, not further than 6 feet from the
appliance, and shall be installed upstream from the union, @nnector or quick disconnect device it serves. Such
shutoff valves shall be provided with access.
Exception, Shutoff valves for venbd decorauve appliances and decorative applianaes for instalhtion in venEd
fireplaes shall not be prohibited from being installed in an area rernote from the appliance where sjch valves are
provided with ready access. Such valves shall be permanently identified and shall s€rye no other equipment.
Piping from the shutoff valve to within 3 feet of the appliance connection shall be sized in accordance with section
402."
Not As Clear Language. Regarding the Gore Creek Residences, the shutoff valve is located within the fire box
WrI}IOUT ready access. More rcsearch in the code is required, So, I looked at section 409.5.1 for addiuonal
guidance:
Section 409.5.1, Shutoff Valve In Fireplace, Equipment shutoff valves located in the firebox of a fireplace shall be
installed in accordance with manufacfure/s instructions.'
After review of the installation manual for this appliance (Gore Creek Residences), I could not find any information
on the shutoff valve, its location, access points or piping schematics. So we must return back to the other code

section 409.5. There is no ready access to the valve, no permanently affixed label to identiry the valve, no
guidance from the manufacturer or located separate from the appliance, the interpretation stands as before. The
shutoff valve shall be located outside the firebox. If VWe n|ake an interpretauon and not clear of the
consequences, I will be conservauve and stay with a more resbictive interprebtion. That would be the one that
world keep us out of bouble in the future.
In closing, all gas-shut-off valves for the Golden Blount Super-Fire Model SF 4224-TV
fireplaces shall be located outside the firebox. This includes fireplaces that have
completed their stone surround and veneer that have not made changes to the gas-shut-
off-valve location.

Town of Vail Mechanical Codes and Desion Criteria
r You must obtain Design Review Board (DRB) approval if any of the mechanical work will involve
ANY exterior work. This includes and is not limited to rcmoval and replacement of driveway snow
meft systems. Please contact a Planner at479-2128 for additional information.
r The Town of Vail has adopted the 2OO3 International Mechanical Code and the 2O03International
Fuel Gas Code.
r All new construction within the Town of Vail is considered to be of unusually tight construction,
thus all combustion air is required to be drawn from outslde the structure for mechanical
equipment.
Town of Vail Fireolace Ordinance
In September of 1991, the Vail Town Councll adopted an ordinance which resEictste construction and
use of open heardr fireplaces within municipal boundaries. Sine that time the ordinane has
undergone numerlous changes and revisions, striving for compromise, yet effectiveness in addrcssing
the air quality issue. Therefore the following criteria has been adopted:
o Construction of open hearth wood burning fireplaces is no longer permitted within Town of Vail
municipal boundaries.
r l),wellino Units - Each new dwelling unit may oontain:
One (1) EPA Phase II certified solid fud burning dwice and no morc l*ran two (2) gas appliances
(B vent)
OR
Two (2) gas log fireplaces and no morc than hro (2) gas appliance fireplaces (B bent).
o Restricted Dwellino Units - Each new restricted dwelling unit may contain:
One (1) gas log fireplace and not morc than one (1) gas appliance ftreplace.
o Accommodation Unlts - Each new aooommoda6on unit may contain:
One (l) gas log fireplace or one (1) gas appliance fireplace.
o If two or more separate dwelling units or accommodation units are combined to form one larger
unit, the combined unit may r€tain one woodburning ftreplace (if one already exists) and no more
than 2 gas appliance fireplaces, or may convert up to two existing fireplaces to gas.
r If during the coume of a remodel an exisffng woodburning fireplace is altered or moyed, the unit
must then comply with all provisions of the ordinance. That is, the fireplace must be convefted to
natural gas or replaced by an EPA Phase II ceftified unit.

ToWn of Vail Fireplace Ordinance
In September of 1991, the VailTown Council adopted an ordinance which r€stricts te @nstruction and
use of open hearth fireplaces within municipal boundaries. Since that time the ordinance has
undergone numerous changes and revisions, striving for complomise, yet effectiveness in addressing
the air quality issue. Therefore the following criteria has been adopted:
o Construction of open headft wood burning fireplaces is no longer permitted within Town of Vail
municipal boundaries.

o Dwellino Units -Each new dwelling unit may contain:
One (1) EPA Phase II certified solid fuel burning dwice and no morc t{ran two (2) gas appliances

OR
Two (2) gas log fireplaces and
Restricted Dwellino Units - Each new restricted dwelling unit may contain:
One (1) gas log fireplace and not more than one (1) gas appliance fireplace,
Accommodation Units - Each new aooommodation unit may contain:
One (1) gas log fireplace or one (1) gas appliance fireplace.
If two or more s€parate dwelling units or accommodation units are combined to form one larger
unit, the combined unit may retain one woodburning fireplace (if one already exists) and no more
than 2 gas appliance fireplaces, or may convert up to tuto existing fireplaces to gas.
If during the cource of a remodel an existing woodburning fireplace is altered or moved, the unit
must then comply with all prcvisions of the ordinance. That is, the fireplace must be convefted to
natural gas or replaced by an EPA Phase II certified uniL
