Dear Dr. Engle and Ms. Olson: Enclosed is a copy ol the minutes of the February 8, 1993 Planning and Environmental (PEC) meeting at which your conditional use permit request was approved. The attached copy of the meeting minutes will serve as your record of this approval. Please note that the approval of this conditional use permit shall lapse and become void if a building permit is not obtained and construction is not commenced and diligently pursued toward completion, or if the use for which the permit is granted has not commenced within two years from approval (February 8, 1993). lf approval of this variance lapses, an application must be resubmitted for reconsideration by the Community Development Department staff and the PEC. lf you have any questions or comments regarding this information, please do not hesitate to contact me at 303/479-2138. Enclosure Mike Arnett, a DFIB representative, stated that the design of the building needs lo 'stand for itself without landscaping", Jeff Sheppard, the project archilect, slated that the cosmetics of the building can cerlainly be changed and further inquired whether the overall scale was in the right direction. The PEC agreed that the overall building's scale was now acceptable. Kathy Langenwalter stated that the eastern-most roof should be gabled in order to shed snow in the opposite direction and not shed snow on the garage entrance. 2. A request for a Bed and Breakfast to be located at 1850 South Frontage Road WesVLot 3, Alpine Creek Townhouse Subdivision. Applicant: Dr. Richard Engle and Gertrude OlsonPlanner: Shelly Mello Shelly Mello stated lhat staff supports this request. Greg Amsden inquired whether there were 6 parking spaces offered by the Homeowner's Association and noted that the bed and breakfast was a considerable distance from the Town of Vall bus stop. Shelly Mello responded that the applicant would use the 2 garage space and one on- site parking space to meet the parking requirements. Chuck Crist motioned to approve this request per statf memo with Gena Whitten seconding the motion, with a unanimous vote 6-0 to approve this item. 3. A request for a conditional use to allow for an outdoor dining deck for the Uptown Grill Restiaurant, located at 521 East Lionshead Circle/Lot 3, Block 1, Vail/Lionshead First Filing. Applicant: Joel Fritz and Richard N. BrownPlanner: Tim Devlin Tim Devlin made a presentation per the stalf memo. He stated that this request is consistent with Vail Lionshead Urban Design Guidelines and Guide Plan but that the staff felt that the public should have complete access to the Bird of Paradise sculpture. He stated that at the present time staff was recommending denial of the applicant's request for a conditional use permit, but that the staff could support a modified version of the deck as described in the memo. Joel Fritz (the applicant) stated that he does not like the Bird of Paradise sculpture's current location. He believes that a dining deck would make the area more active and lhat he does not want to modify his plans. DESCRIPTION OF THE PROPOSED USE In December of 1989, the vailrown councilpassed ordinance No.31, series of 1g89 to allow Bed and Breakfasts in the Town of Vail. The detinition in that ordinance states: 'A Bed and Breakfast means a business which accommodates guests in a dwelling unit in which the Bed and Breaklast proprietor lives on the premises and is in residence during lhe Bed and Break{ast use." The applicants have applied for a conditional use permit to allow them to use two bedrooms in their home, which is located in the Residential Cluster zone district, for a Bed and Breakfast rental. The area to be used for bed and breakfast contains a total of 500 square feet. Two guests could stay in each bedroom for a total of 4 guests. CRITERIA AND FINDINGS Upon review of Section 18.60, the Community Development Department recommends approval ot the conditional use permit based upon the following factors: A. Consideration of Factors: 1. Relationshio and impact ol the use on the develooment obiectives of the Town. The Town Council encourages Bed and Breakfasts in the Town of Vail as a favorable type of lodging for tourists. otr i 2.The effect of the use on lioht and air. distribution of oooulation. transoortation facilities. utililies, schools. oarks and recreation facilities, and other oublic facilities needs. Four guests can be accommodated at one time, and it is unlikely that there would be more than two guest vehicles. There is a Town of Vail bus stop in the vicinity. lt is felt that the impact on the use of parks and recreation facilities and on transportation facilities would be minimal. Effect uoon traffic with particular reference to conoestion. automotive and oedestrian safetv and convenience. traffic flow and control. access, maneuverabilitv. and removal of snow from the street and Darkino areas. It is likely that there would be two additional vehicles driving to the residence. Staff feels that this would be an insignificant impact upon traffic. Effect uoon the character of the area in which the orooosed use is to be located. includino the scale and bulk ot the prooosed use in relation lo surroundino uses. The staff feels that the character of the area will not be negatively impacted by the addition of a Bed and Breakfast in this area. No exterior changes to the residence are proposed to accommodate the Bed and Breakfast. Bed and Breakfast Operations mav be allowed as a conditional use in those zone districts as specified in Title 18 of the Vail Municioal Gode for Ordinance No. 31, Series of 1989. Bed and Breakfast Ooerations shall be subiect to the followino requirements: a. The property contains two enclosed and one exlerior parking spaces. This is a single family residence so there is no additional parking demand on the site. b. FINDINGS The Planninq and Environmental Commission shall make the followinq findinos before orantino a conditional use oermit for a Bed and Breakfast operation: A. That the proposed location of the use is in accord with the purposes of lhis Ordinance and the purposes of the district in which the site is located. B. Thal the proposed location of the use and the conditions under which it would be operated or maintained would not be detrimental to the public health, salety, or welfare or materially injurious to properties or improvements in the vicinity. c. That the proposed use would comply with each of the applicable provisions of this Ordinance. STAFF RECOMMENDATION The Community Development Department staff recommends approval of this application for a Bed and Breakfast operation. Statf finds that all applicable review criteria and findings have been satisfactorily met.
