In consideration of the issuance of a revocable permit fo'r the stiucture above indidated,applicant
agrees as follows:
1.That the structure herein authorized on a revocable permit basis is restricted exclusively to the land above
described.
That the permit is limited specifically to the type of structure described in this application.
That the applicant shall notify the Project Planner and Public Works Department, or their duly authorized
agent, twenty-four hours in advance of the time for commencement of construction, in order that proper
inspection may be made by the Town.
The applicant agrees to indemnify and hold harmless the Town of Vail, its officers, employees and agents
against all liability, claims and demands on account of injury, loss or damage, including without limitation
claims arising from bodily injury, personal injury, sickness, disease, death, propefty loss or damage, or any
other loss of any kind whatsoever, which arise out of or are in any manner connected with applicant's
activities pursuant to this permit, if such injury, loss, or damage is caused in whole or in part by, or is claimed
to be caused in whole or in part by, the act, omission, error, professional error, mistake, negligence or other
fault of the applicant, his contractor or subcontractor or any officer, employee or representative of the
applicant, his contractor or his subcontractor. The applicant agrees to investigate, handle respond to, and to
provide defense for and defend against, any such liability, claims, or demands at the sole expense of the
applicant. The applicant also agrees to bear all expenses relating thereto, including court costs and

I aftorney's fees, whether or not any such liability, claims, or demands alleged are groundless, false, or
fraudulent.
Applicant agrees to procure and maintain, at its own cost, a policy or policies of insurance sufficient to ensureagainst all liability claims, demands and other obligations assumed by the applicant pursuant to this
Paragraph 4.
Applicants further agree to release the Town of Vail, its officers, agents and employees from any and all
liability, claims, demands, or actions or causes of actions whatsoever arising out of any damage, loss or injury
to the applicant or to the applicant's property caused by the Town of Vail, its officers, agents and employees
while engaged in maintenance or snow removal activities or any other activities whatso-ever on Town oivait
property, streets, sidewalks, or rights-of-way.
That the permit may be revoked whenever it is determined that the encroachment, obstruction, or other
structure constitutes a nuisance, destroys or impairs the use of the right-of-way by the public, constitutes a
traffic hazard, or the property upon which the encroachment, obstruction, or structure exists is required for
use by the public; or it may be revoked at any time for any reason deemed sufficient by the Town of Vail.
That the applicant will remove, at his expense, the encroachment, obstruction, or structure within ten davs
after receiving notice of any revocation of said permit.
That the applicant agrees to maintain anv landscaping associated with the encroachment on the right-of-way.
That in the event said removal of the encroachment, obskuction, or strucfure is not accomplished within ten
days, the Town is hereby authorized to remove same and have the right to make an assessment against the
property and collect the costs or removal in the same manner as general taxes are collected.
That the dpplicant has read and understands all of the terms and conditions set forth in this application.
The Revocable Right-of-way Permit fee is $35.00; $11.00 of the fee pays for Eagte County Clerk and
Recorder recording. Make checks payable to Town of Vail.

General Information:
This applicaUon is required for proposals involving minor exterior alterations and/or site improvements.
Proposals to add landscaping do not require DRB approval unless they involve the addition of patios,
water features, grading, or the addiUon of retaining walls.

**For interior conversions with no exterior changes, the submittal requirements include a complete set of
existing and proposed floor plans, a title report, and written approval from a condominium association,

409o, and floodplain)r Ties to existing benchmark, either USGS landmark or sewer invert. This information must be
clearly stated on the survey. Property boundaries to the nearest hundredth (.01) of a foot accuracy. Distances and bearings
and a basis of bearing must be shown. Show o<isting pins or monuments found and their
relationship to the established comer.. Show right of way and property lines; including bearings, distances and curve information.r Indicate all easements identified on the subdivision plat and recorded against the property as
indicated in the title report. List any easement restrictions,. Spot Elevations at the edge of asphalt, along the street frontage of the property at twenty-five
foot intervals (25'), and a minimum of one spot elevations on either side of the lot.. Topographic conditions at two foot contour intervals. Existing trees or groups of trees having trunks with diameters of 4" or more, as measured from a
point one foot above grade.. Rock outcroppings and other significant natural features (large boulders, intermittent streams,
etc.).. All existing improvements (including foundation walls, roof overhangs, building overhangs, etc.).. Environmental Hazards (ie. rocKall, debris flow, avalanche. wedands, floodplain, soils). Watercourse setbacks, if applicable (show centerline and edge of stream or creek in addition to
the required stream or creak setback). Show all utility meter locations, including any pedestals on site or in the right-of-way adjacent to
the site. Exact location of existing utility sources and proposed service lines from their source to
the structure. Utilities to include:. Cable W Sewer Gasr Telephone Water Eledric. Size and type of dminage culverts, swales, etc.. Adjacent roadways labeled and edge of asphalt for both sides of the roadway shown for a
minimum of 250'in either direction from property.
. Site and Grading Plan:. Scale of !"=20'or larger. Property and setback lines. Existing and proposed easements. Eiisting and proposed gradeso Existing and proposed layout of buildings and other structures including decks, patios, fences and
walls, Indicate the foundation with a dashed line and the roof edge with a solid line.. All proposed roof ridge lines with proposed ridge elevations. Indicate existing and proposed

elevation drawings shall be provided on the plan or separate sheet. Stamped engineering
drawings are required for walls between 4' and 6'feet in height.
' Delineate areas to be phased and appropriate timing, if applicable
. Landscape Ptan:r Scale of 1" = 20'or larger. Landscape plan must be drawn at the same scale as the site plan.. Location of existing trees, 4' diameter or larger. Indicate trees to remain, to be relocated
(including new location), and bo be removed. Large stands of bees may be shown (as bubble) if
the strand is not being affected by the proposed improvemenb and grading.r Indicate all existing ground cover and shrubs.r Detailed legend, lisUng the type and size (caliper for deciduous trees, height for conifers, gallon
size for shrubs and height for foundation shrubs) of all the existing and proposed plant material
including ground cover.. Delineate critical root zones for existing trees in close proximity to site grading and construction.. Indicate the location of all proposed plantings,. The location and type of existing and proposed watering systems to be employed in caring for
plant material following its installation.r Existing and proposed contour lines. Retaining walls shall be included with the top of wall and
the bottom of wall elevations noted.
. Lighting Plan:r Indicate type, location and number of fixtures.. Include height above grade, lumens output, luminous area. Attach a cut sheet for each proposed fixture.

Dear Mr. Langley,
On March 8,2007 , we met with your architect, Michael Hazard, to discuss a potential solution for
certain building and fire code issues that exist at Villa Valhalla. While there are many code
issues that may not be resolved due to the age and nature of the building, it seems that the
solution that was presented could be a reasonable option to resolve the exiting issues. The
elevator will help provide ADA access to the building and will also facilitate multiple means of
egress. The additional entry will also facilitate additional means of egress. The potential solution
would benefit the building as a whole and would meet the intent of the Vail Town Code.
However, the additional gross residential floor area would not be related to solving code issues.
We look forwmd to working with Villa Valhalla in the future to solve some of your pressing code
