BUILDING PERMIT ISSUANCE TIME FRAME
If this permit requires a Town of Vail Fire Department Approval, Engineer's (Public Works)
review and approval, a Planning Department review or Health Department review, and a review
by the Building Department, the estimated time for a total review will take as long as three (3)
weeks.
All commercial (large or small) and all multi-fumily permits will have to follow the above
mentioned maximum requirements. Residential and small projects should take a lesser amount
of time. However, if residential or smaller projects impact the various above mentioned
departments with regard to necessary review, these projects may also take three (3) weeks to
review and approve.
Every attempt will be made by this department to expedite this permit as soon as possible.
I, the undersigned, understand the plan check procedure and time frame. I also understand
that if the permit is not picked up by the expiration date, that I must still pay the plan check fee
and that if I fail to do so it may affect future permits that I apply for.

PUBLIC WORKS AND THE PUBLIC WAY PERMIT PROCESS
How it relates to Building Permits:
Fill out the attached check list with the Building Permit Apolication.
If yes was answered to any of the questions then a "Public Way" permit is required. You
can pick up an application at either Community Development, located at 75 South Frontage
Road or Public Works, located at 1309 Elkhorn Drive.
Notice sign-offs for utility companies. ALL utilities must field verifl7 (locate) respective
utilities prior to signing application. Some utility companies require up to 48 hours notice to
schedule a locate.
A construction traffic control/staging plan must be prepared on a separate sheet of paper,
An approved site plan may also be used. This plan will show locations of all traffic control
devices (signs, cones, etc.) and the work zone, (area of construction, staging, etc.). This
plan will expire on November 1st and will need to be resubmitted for consideration for
approval through the winter. Be aware that your resubmission for winter may be denied
depending on the location of construction.
Sketch of work being performed must be submitted indicating dimensions (length, width
and depth of work). This may be drawn on the traffic control plan or a site plan for the job.
Submit completed application to the Public Work's office for review. If required, locates will
be scheduled for the Town of Vail electricians and irrigation crew. The locates take place in
the morning, but may require up to 48 hours to perform.
> The Public Work's Construction Inspector will review the application and approve or deny
the permit. You will be contacted as to the status and any requirements that may be
needed. Most permits are released within 48 hours of being received, but please allow up
to one (1) week to process.
As soon as the permit is approved, the Building Department will be notified, allowing the
"Building Permit" to be released. Please do not confuse the "Public Way Permit" with a
"Building Permif'.
NOTE: The above process is for work in a public way ONLY. Public Way
Permits are valid only until November 15th. A new Public Way Permit is required
each year if work is not complete. Re-application each November 15th does not
mean an automatic renewal.

o The Town of Vail Building Department has developed the following procedures to
ensure that new construction sites have adequately established proper drainage
from building sites along and adjacent to Town of Vail roads or streets.
o The Town of Vail Public Works Department will be required to inspect and approve
drainage adjacent to Town of Vail roads or streets and the installation of temporary
or permanent culverts at access points from the road or street onto the construction
site. Such approval must be obtained prior to any requests for inspection by the
Town of Vail Building Department for footings, temporary electrical or any other
inspection. Please call Leonard Sandoval at479-2798 to request an inspection from
the Public Works DeDartment. Allow a minimum of 24 hour notice.
o Also, the Town of Vail Public Works Department will be approving all final drainage
and culveft installation with resulting road patching as necessary. Such approval
must be obtained prior to any Final Certificate of Occupancy issuance.

CODE 5.2.10: DEPOSITS ON PUBIIC WAYS PROI{IBITED
n Unlawful deposits: Subject to subsection C thereof, it is unlawful for any person to litter, track or
deposit, or cause to be littered, tracked or deposited, sand, gravel, rocks, mud, dirt, snow, ice, or any
other debris or material upon any streef sidewalk, alley or public place, or any portion thereof.
u Notice; Abatement: The Director of Public WorK may notifo and require any person who violates or
causes another to violate the provision of subsection A hereof, or who has in the Director's employment
a person who violates or c.tuses another to violate the same, top remove such sand, gravel, rocks, mud,
dirt, snow, ice or any other debris or material within twenty four (24) hours after receipt of said notice
by the Director of Public Works. In the event the person so notified does not comply with the notice
within the period of time herein specified, the Director of Public Works, or other authorized agent, may
cause any such sand, gravel, rock, mud, dirt, snow, ice, debris or any other material to be removed
from any street or alley at the expense of the notified.
u Summons and Penalty: As an alternative to the notice for removal provided in subsection B above,
any person who violates or caus$ another to violate the same, may be issued a summons to appear
before the Municipal Court of the Town for said violations, and upon being found guilty of a violation
hereunder be punished as provided in Section 1-4-1 of this code.
tr Notice and Penalty: It is unlawful for any person to fail or refuse to comply with the notice of the
Director of Public Work as provided in subsection B hereof, and any such person shall, in addition to
payment of the expense of removal incurred by the Director of Public Works, as provided in subsection B
hereof, upon being found guilty of a violation hereunder, be punishable as provided in Section 1-4-1 of
this Code. (1997 Code: Ordinance 6 (1979).

o No person shall park any vehicle upon a street or at any other place within this Municipality in such a
manner or under such conditions as to interfere with the free movement of vehicular traffic or proper

D Whenever any police officer finds a vehicle attended or unattended, standing upon any portion of a
street or upon any place within this Municipality in such a manner as to constitute a violation of any
section of this Article, or left unattended for a period of twenty four (24) hours or more and presumed to
be abandoned under the conditions prescribed by Colorado Revised Statutes section 42-4-1102, as
amended, the officer shall require the vehicle to be removed or cause it to be removed and placed in
storage in the nearest garage or other place of safety designated or maintained by this Municipality, and
the charges for towing and storage of such vehicle shall be charged to the owner of the vehicle in

development of the finest line of Sauna Heaters,

THE HIGHEST QUALITY, BAR NONE.
All saunas come complete with heater, rocks,
controls, thermometer and recessed light fixture
for the ceiling. Interiors of the saunas are finished
with /n" tongue and groove redwood for the
walls and ceiling. Benches and duckboard are
constucted with %" x 4" redwood that has
been sanded smooth on all exposed surfaces.
The heater is enclosed by a guardrail conskucted
of 3/0" redwood. The prehung self-closing door
requires no houblesome catches and the hinges
are adjustable for closing tension. A double-

The existing nonconforming buitding encroaches into the 20foot setback reguirement along the entire south elevation of
the existing building with the greatest encroachment
occurring at the west corner of the building. At this
corner, the buil-ding encroaches 5.3 feet into the reguired
20 foot setback. In the area of the proposed bay window,
the building currently encroaches 4 feet. With the
expansion, the encroachment wilt be increased to 5 feet.
The proposed bay would be approximately 25.5 feet fron the
edge of pavement. The owner is reguired to obtain a
variance because the window will increase the nonconfornityof the building. The proposal does not add any GRFA. Thesite coverage also remains unchanged because the structureof the bay window addition iE 8rr above grade.
II. CRTTERIA AND FINDINGS
Upon review of Criteria and Findings, section 18.52.060 of
the Vail Municipal Code, the Departuent of Coronunity
Devel.opment recommends approval of the reguested variance
based upon the following factors;

Harry and Margareta Davison, the owners of Villa Va1ha1l,a Unit 3, are requesting

from their living room to the ski area has been obstructed. By adding the
proposed windows, they will again be able to enjoy this view.
Due to the strong horizontal architectural elements of Villa Va1ha1la' the
bay window exterior will be a continuation of the wall plane between the
existing accent bands at the first and second fLoors. However, the bay window
is designed as a window seat and will not increase the floor area of the unit.
18.58.040 of the Town of Vail Zoning Ordinace allovs for architectural features
to project not more than four feet into a required setback area. The bay
winiow-wilI project two feet from the face of the existing wa1l. Villa Valhalla
is zoned Public Accornodation with ninimun front, side and rear setbacks of
twenty feex (L8.22.060). The existing building is located approxiroately
sixteln feet fron the south property 1ine. Ttrerefore, the bay window will
project approxinately six feet into the setback area requiring the requested
setback variance.
The setback variance will have no impact on other existing or potential uses
and structures in the neighborhood.
A physical hardship exists because Vi11a Valha1la was constructed wit.hin the
twenty foot setback area. The proposed two foot deep bay window wil-l project
fron the existing wall only one haLf of the four foot distance allowed by
code. The strict or literal interpretation and enforecement of the setback
regulation would deprive the Davisons of privileges enjoyed by the owners
of other properties in the same zone district.

a bay wlndo'n to thel-r unlt. llarry Davlson lntroduced Kathy Warren the archltect
for the proJect. I(athy handed out a couple of drawl-ngs showlng the proposed
wlndow and the nay lt would change the exterlor of the bulldlng. She explained
that Ln order to proceed with the plan the Davlsonrs would need to get a varlance
from the Town of Val1 for the front setback of the butldlng. Before they can
apply for che variance chey also musE have Ehe approval of the condo agsociatlon.
Greg Johnson asked Karhy Warren lf the proposed plan wouLd add any floor space
to the unit. The answer was no. Greg also sEated that he thought the new window
would look better lf V111-a 7, the Tut,t rs unlt above Ehe Davlsonts dld the saue
thlng. Frsnkle Tutt stated Lhat chey did not nant to go to the expense of addlng
the window withouE galning any floor space, so they dld not nant to do the same
thing as the Davlsonrs. Harry Davison then explained why he wanted to add the
wLndow. Harry stated thac when the Tivloll Lodge expanded last year hl-s view was
completely taken away by the addltlon on thelr butldlng. He feels hls unlt was
affected by the TLvlolits additlon more than any of Ehe ocher unl-ts ln the V111a.
The other olrners at the meetlng all agreed wich llarry on that polnt. Harry stated
that by addlng the bay wlndow he could at. leasc resEore some of the vlerr from hls
dlnlng room. There uas a discussion on how nany o! lers would have to vote yes ln
order to approve the proJect. After taklng a couple of rninuEes to go through the
By-l-aws and the Condo decs, l-t, was noted that neither docunent stated what klnd
of approval nas necessary to approve a change Lo the exterlor of the bulldlng.
It nas the consensus of the oarners present that a siurpl-e nsjorlty of seven yes
votes by ounera would be enough for approval- on thls request.It was also declded
to have the by-laws amended at a later date to lncl-ude the process for approval,
of any oe,ners request to change the exterlor of the bulldlng.

the plan because he felt lt would set a precedenE for any ouner wlshlng to alter
the exterlor of the bu{l-ding. It was the consensus of the olrners that the by-laws
would be changed after the vote on Davlsonrs requesE ln order to be falr Co Ehem'
Beacuse the drawlngs presented at the meeting were not expliclt enough, Greg Johnson
suggested that the t.q.r."t be tabled and that Kathy warren come up wlth more speclfic
drawl-ngs to be mal,led out to the entlre assoclatlon so that eAch owner could see the
changes the wlndow would make ln the bulldlng before votlng on the request' IE ltas
decided Ehat after Kachy was flnlshed wlth rhe new drawlngs she wouLd brlng them to
John Everly who would then rnall them out, to the entlre associaElon along wlth a ballot
so that each owner could vote yes or no on the requesE. IE was also declded that any
ballot not returned within two weeks of the date lt was nailed ouE $tould be counted
as a yes vote.

famlly who are Ehe current olfners of the Garden of the Gods bullding' Don was lnvlted
Eo Eh; meet.lng so he could brlng the Vl1la Assoclatlon up to date on the remodel
plans for the Garden of the Gods. Don sfated Ehat the bulldlng naa to be cornpletel-y
torn dolrTr and a new bulldlng put up in lEs place. There has been one vote on the
the H111 ts request by the Town councll for a Speclal Development Dl-strlct and lt
passed the council by a -3 margln for approval . Don explained that most of the

expanslon on the east side of the bulldlng of about 4-5 feet. The expansion would
adi that rnuch helght to the buildlng. On ihe west slde of rhe bulldtng whlch ls the
Vllla slde everythlng would remaln the same slze. There woul-d be 15 parklng sPaces
underground also added for the bulldlng. Inslde of the bulldlng there vould now
be 2 condo unlts on Ehe second and fhird floors of the bulldlng lnstead of the 8
hotel llke sultes that currently exlst. The condos could either be 5 bedroom units
or I bedroom unlts because of the ablllty to lockoff the bedroorns. There would be
ll hotel rooms avallable for renE, There will also be two employee unlts of about
1000 square feet each. The unl-ts sll- would be owned wlthin Che ltt11 faml1y and not
sold. The bus stop that ls currently ln front of the bullding would move from the
north end of the bulldlng to the south end of the bulldlng. Don wanted Co know what
the VlL1a o\rners thought of the pool and lf they had any thoughts about elther raklng
iE out or creaElng a new pooJ- arla wlth sma11 decks and a large Jacuzz! wtth a-snall-
cooll-ng pool . He stated tirat the H111 fanlly looked at the pool as a negatlve feature
because of the llabillty and Che upkeep. I{e stated that the llabll1ty was thelr maln
concern and that they would llke to create an area wlth a more passive atmosphere'
After a small discu""l-on oo the pool it was apparenE that the naJority of Ehe V1118

Gods slde will be taken out durlng the remodel. There was also a discusslon on trylng

to knlw who would pay for the- changes lf Eh; area rras changed. At thls time Don could
not answer that questlon. It was declded thaE Ehe VIl1a assoclstlon would have a pool
commlEtee to look at any proposal ChaE ls presented before maklng any plans to change
the current pool. The members of the commit.tee are Frankl-e TuEt, Greg Johnson and Patty
parker. The other questlon thst was ralsed by Kathy Madden was on Che Elme frame for
constructl-on. Don Ilare stated Ehat the current plan is Eo start on Ehe lnslde of the
buildtng on March 1, 1991 and flnlsh by December 15, 1991. There were no more questions
for Don so he lefE the meetlng. After he ta" gone there lrtas a small dLscusslon on how
the consEructlon of Ehe Garden of the Gods bulldlng would affect the buslness of the
V1lla condos and lt nas agreed thaE Ehe President of the Assoclation Richard Sucher
woul-d wrlte a letter to Don Hare l-n order to lnsure thaE the V1lla owners would not
suffer any hardships because of the constructlon.
The nexg iten of business nas a request by the Parkers frour Vil1a 9 to add
two skyllghts to thelr unlt. There was a drawlng and a letter fron Mark Mueller
explalnlng thelr request. They also wanted to lnstall a washer dryer ln Ehelr unlt

After a shorE dlscusslon, Greg Johnson made a motlon to approve the requesEs ltlEh
a second from RoberE slegrlsE and the motlon was voted on and approved.
The next item on the agenda was a request by the Tuttts and the DavLson's for
the Assoclatlon to look into gas flreplaces. Frankle TuEt sEaEed that the prlmary
reasons were the damage from wood burning to the carpet ln the units' the down drafts
ln the bulldlng and the pollutlon from wood burnlng. The other o$tners at che meeting
al-1 l1ked the ldea of gettlng blds for the proJect. Bob Siegrist of unlt 10 dld
not lrant a bld for hls unlt because he did not thlnk he needed to swlt,ch to 8as
because he did not have any problems with his ftreplace because he does not renE his
unit and he ls on the top floor whlch ellmlnates the down draft. John Everl-y staEed
he would get blds for the rest of the unlts as soon as possible.
The next lEem on che agenda was the readlng and the approval of last years mlnutes.
Frankie Tutt nade a motion to approve the ninuces r.rlEh a second from Harry Davison and
the motion was voted on and approved.
The next ltem on the agenda r4ras the offlcers report.s' Frankie Tutt wanEed to pol-nt
out that the llanagement Conpany had done a good Job of Eaking care of Ehe orrnels
requests from last year. Frankle then went on to some current. problems. Frankle stated
that she felt the current rental rates for the Villa unlts were too 1ow based on
oEher comparable unlts ln the village. John Everly wlth the Management conpany agreed
thaE Ehe rates were 1ow and stated chat the llanagement company was going to raise Chem
for the next skl season. He stated that the ChrlsElanLa was going to be aggressive
ln lts prlcing for the 90-91 skl season. Sa11y Johnston then stated that ln order to
be aggresslve and charge Eop do11ar for un1Es, they needed to be ln flrst class conditir

trying Eo JusE couch them up ln the places they show the most rrear. She stated that
when you are charging htgher rates people expect more for thelr money and l-t 1s a
problem 1f they feel they are not getting t.he product. chey pald for. Sally proposed
that the owners let the Management company hlre an out,slde firm to evaluaEe the.unlts
and glve them suggestlons on what they rnight need. The owners were shown a letter and
the trlce L1st for lnspectlng the unlts. After a short dlscusslon Greg Johnson made

and approved.
The next ltem on che agenda r,ra s approvlng the budget for 1991 and revlewing che
1989 flnancial sEaEements. John Everly went over the statements. For 1989 the expenses
were about $3,000.00 over the proposed budget. The two areas that were the cause of the
hlgher expenses were malntenance and pool amounEs. The maintenance budget fel1 short
because oi plumblng work l-n the boller room Eo correct sone prevlous problems. The pool
heater and flltering system boch needed Eo be replaced chis year whlch caused that
area ro be over budget. John Everly stat.ed that he felr the 1990 budget needed to be
increased ty $1,500.00 ln the maintenance area because of some plunblng work that was
done 1n Janlary and had not been antlclpated when the 1990 budget was aproved ln Aprl1
of 1989. At the same tlme John proposed a budget for 1991. After a short dlscusslon
Frankle Tutt made a maotlon to raise the 1990 budget by $1'500.00 and to approve Ehe
1991 budget \,rlth a second frorn Harry Davlson and the motion was voted on and approved.
The l-ast item was Eo select new offlcers. Greg Johnson made a motlon to retaln the
same officers as last year wlEh a second from Bob Siegrist and the moElon was voted on
and approved. The officers are Richard Sucher as Presidenc Debble Thurlnger as Vlce-
Presldent and Harry Davlson as SecreEary- Treasurer.
