Please be advised that the Board of Directors of the vail village plaza condominium
Association has approved the following improvemenrs proposed by the Masters Gallery:
r Installation of awnings in five locations. They will be the same color as the existing
awnings.
r Replacement of their main entry door with a new door of the sane dimensions. They are
replacing the door with a newer version because of safety and security reasons. The new
door metal will be a brown color that will better match the new railings that have been
installed near the gallery.
o The Board of Dire ctors understands that minor modification of amending the monogram
on the awnings may be made to the plans over the course of the review process to ensure
compliance with the Town's applicable codes and regulations.
The Board of Directors believes that these proposed changes are improvements to the property
therefore we hopc that the Town of Vail will approve them.

Tim€ Rduircments
The Design Radew Board meets on tie 1st and 3rd Wednesdays of eadr month. A complete application form
and all acompanyrrE material must be acepted by the Community Development Depaftment prior to
appllcaUon deadllnes. A schedule of DRB meefngs and associated appllcaton deadllnes may be found on the
Wot1d Wlde Web at www.valloov.com For a ne$/ resldentlal development, the application deadline is typically
3.5 weeks prior to a Design Rer/iew Board hearing.
Rwiew Criteria
The proposal wlll be reuaryed for ompliane with the Design Guidellnes as set forth in Title 12, (Zoning
Regulations) and TiUe 14 (Development Standards) of the Town of Vail Municipal Code.
Reouircments for orooeftiee located in hazard arcas
If a property ls located in or adjacent to a mapped hazard area (i.e. snow avalanche, rock fall, debrls flow,
floodplain, wetland, poor soils, etc.), $e Community Development Depafinent may require a site-specific
gedogical inrrestigafion. If a site-specific geologlcal Invesfrgatlon determines that the subject propetty is located
in a geologically sensltive area, the property owne(s) must sign an affidavlt re@gnizing the hazard repolt prior
to the issuane of a building pennlt. Applicants are strongly encouraged to consult with Community
Development staff prior to submitting a DRB appllcaton to determine the relationship of the propefty to all
mapped hazards.
Reouired Plan Shed Format
For all surveys, site plans, landscape plans aM other slte lmprovement plans, all of the follorring must be
sho^rn.
Plan sheet size must be 24nx 36". For large prcJecE, larger plan size may be allowed.
Scale. The minimum scale is 1"=20'. All plans must be at the same scale.

Desion Reviw Board Meetino Reouirements
For new constr.r<tion and additions, the applicant must stake and tape the project site to indicate property lines,
propo6ed buildings and building corne|s. All trees to be removed must be taped. The applicant must ensure
that sbking done during the winter is not buried by srnw. All site tapings and staking must be completed prlor
to the day of the DRB meeting.
The applicant, or their representative shall be present at the Design Review Board Hearing. Applicants who fall
to aqPqqr before the Design Rwiew Board on their scheduled meeting date and wlro have mt asked in advarlc
that dlscussion on their item be postponed, will have thelr ltems removed from the DRB agenda untll such tlme
as the item has been rcpublished.
If the tlRB approves the application with conditions or modifications, all conditions of apprwal must be resollfed
prior to the issuance of a building pernitr'.. '. r
Staff Aooroval
The Administrator (a member of the plannlnS stafD may revlew and approve Design Review applications,
appKtve with ertain modifications, deny the application, or refer the application to the Design Review Board for
a decision. All statr approvals are rerdewed by the Design Review Board and any staff decisidn is subject to
final approval by the DRB.
Additional Review and Fees
If this application requires a separate review by any local, state or Federal agency other than tfre Town of Vail,
the application fee shall be inffeased by $200,00. Examples of such review, may include, but are not llmlted to:
Colorado Department of Hlghway Acess Permits, Army Corps of Engineers 404, eb.
The applicant shall be responsible for paying any publlshing fees in exess of 50% of the application fee. If, at
the applicanfs request, any matGr is postponed for hearing, causing the matter to be re-published, then the
entire fee for such re-publication shall be paid by the applicant
Applications deemed by the Community Development Deparlment to have design, land use or other issues,
which may have a significant impact on tte ommunity, may require review by external consultants in addition
to Town staff. Should a determination be made by Town staff that an e)fternal consultant is needed, the
Community Development DeparBnent may hire the consultant. The Department shall estimate the amount of
money necessary to pay the consultant and this amount shall be foruvarded to the Town by the applicant at the
time of flllng an application. The applicant shall pay expenses incurred by the Town in excess of the amount
fonararded by the application to the Town within 30 diys of notification by the Town. Any excess funds will be
retumed to the applicant upon review completlon.

Time Requirements
The Design Review Board meeB on the lst and 3rd Wednesdays of each month. A complete application
form and all accompanying material must be accepted by the Community Development Department prior
to application Oeadiines. A schedule of DRB meetings and associated application deadlines may be found
on the World Wide Web at www.vailgov.com.
Review Criteria
The proposal will be reviewed for compliance with the Design Guidelines as set forth in -Iitle 12 (Zoning
Regulations) and Title 14 (Development Standads) of the Town of Vail Municipal Code'
Desicn Review Boatd Meetino Reouirements
For new constnrcUon and additions, the applicant must stake and tape the project site to indicate
property lines, proposed buildings and building cornem. All trees to be removed must be taped. The
ippticant must ensure that staking done during the winter is not buried by snow. All site tapings and
staking must be completed prior to the day of the DRB meeting.
The applicant, or their representative, shall be present at the Design Review Board Hearing. Applicants
who fail to appear before the Design Review Board on their scheduled meeting date and who have not
asked in advance that discussion on their item be postponed, will have their items removed from the DRB
agenda unUl such time as the item has been republished.
If the DRB apploves the application with conditions or modifications, all conditions of apprcval must be
resolved prior to the issuance of a building permit.
Staff Approval
fne nOministrator (a member of the planning staff) may review and approve Design Rwiew applications,
approve with ceftain modifications, deny the application, or refer the application to the Design Review
Board for a decision. All staff approvals are reviewed by the Design Review Board.and any staff decision
is subject to final approval by the DRB.

B. Store materials in a dry, protected, well-vented area. Report damaged material immediately to
the delivering carrier and note such damage on the canier's freight bill of lading.
C. Remove all protective materials after installation.
1.06 SUBSTITUTIONS:
A. Proposals for substitution products will be accepted only from bidding contractors a minimum
of l0 working days before the bid due date. The proposed substitution shall meet the performance
and quality standards of this specification.
I.O7 JOB CONDITIONS:

2.02 AUTOMATIC SLIDING DOOR SYSTEMS:
A. Automatic Sliding Door System: Shall be Stanley DURA-GLIDE Series 2000. The system
shall consist of sliding aluminum doo(s), sidelight(s) (unglazed), header, operator, and actuating
controls. The system shall be completely engineered, manufactured and assembled by Stanley
Access Technologies. All components shall be factory assembled in the header, adjusted and
tested. No field wiring or operator adjustment shall be required other than the connection to job-
site power and fine-tuning ofdoor speeds to compensate for various door sizes and weights.
B. Sliding Aluminum Doors: Provide door units to dimension heights and widths with
corresponding glazingas shown on construction documents [select one: standard narrow stile or
medium stilel. Door holders shall be provided for all panels to control the doo(s) as they swing
in the direction of egress. All door panels shall have security glass stops. [Please speci! as
applies: Glass stops 114", 518" and t" shall be available for all door panels and transom.l All doors
shall have intermediate rails. The bi-part sliding door system shall include a two-point lock
securing the lead edges of the door stiles together and to the hanger assembly. The active sliding
door shall be provided with a key cylinder on the exterior and a thumb turn on the interior in
accordance with NFPA l0l.
C. Door Operation: Shall be [select one or more: single slide or bi-part] directional operation. In
compliance with NFPA l0l , the sliding door panel(s) shall allow "breakout" to the full open
position to provide instant egress at any point in the door's movement. To allow safe egress,
automatic operation shall be discontinued when the SX panel is in the "breakout" mode. Door(s)
and sidelight(s) shall be sized to prevent pinch points at meeting stiles.
D. Aluminum Frame and Extrusions: Shall be a minimum .125" wall thickness in integral
structural sections. The frame shall be [select one: standard 4-112" deep section or 6" deep
section]. The bi-part transom packages shall contain one vertical transom tube. [Specifr, if
applicable: Provide additional vertical tubesl.
E. Aluminum Extrusion Finish: Standard anodized finish shall be [select one: AA-MI2-C22-431
Cfear, AAMI2-C22-A44 Dark Bronze or Blackl. [Special and painted finishes are available upon
request. Speciff color finishl.
F. Sidelights: [select one: fixed 'O' panel or 'P' panel] Provide sidelights to dimension heights
and widths as shown on construction documents with conesponding glazing. All 'O' panels shall
have intermediate rails.
G. Header Case: Shall be 6" wide by 8" high (l52 mm wide by 203 mm high) extruded aluminum
and capable of supporting bi-parting doors of220 pounds per leafover a span of l4'-0" with
minimal deflection. lt shall contain door operator and door mounting components. The header
cover shall have a continuous selflocking hinge to open flush with the top ofthe header.
H. Door Hanger Wleels: Shall be 2-112" (64 mm) diameter urethane wheels with precision steel
lifetime lubricated ball bearing centers. The sliding door(s) shall be held on the track by 2" (51
mm) diameter anti-riser wheels and supported by a factory adjusted cantilever support and pivot
assembly. This assembly shall allow the sliding doors to swing outward for emergency egress
without the need for a lower door pivot support. The door height shall have an adjustment of 1/8"
+/- as required by field conditions.
I. Door Operator and Controller: Shall be the Stanley Dura-Glide System driven by an electro-
mechanical operator and a regulated electronic conholler. The operator components shall consist
of a DC permanent magnet 1/8 horsepower motor, gear reduction drive, Stanley Pozi-Trac
position encoder, and a microprocessor control box. Provide 120 VAC, 5 arnps minimum to
electrical door operator.
J. Microprocessor Control Box: Torque shall be factory set as prescribed by ANSI A156.10. The
control box and Stanley Pozi-Trac position encoder shall automatically set the opening and
closing check positions, and the full open and full closed position of the door system.
K. Threshold Sensor: Shall be the factory installed Stanley Stanguardil Threshold Sensor. It shall
be a selfcontained fully adjustable sensor system that works in conjunction with Stanley SU-050
motion sensors. Simultaneously with the door opening signal, the sensor shall be energized. It
shall emit a 30" deep by 72" rnaximum wide elliptical shaped infrared presence zone centered on
the doorway threshold line. The door shall close after the SU-050 sensor and
Stanguardru threshold sensor detect a clear surveillance field.
L. Motion Sensor: Shall be the Stanley SU-050 Motion Sensor. The unit shall be switchable
between bidirectional and uni-directional k-band frequency to detect all motion, fast or slow, in
both directions with a relay hold time of 2-30 seconds. The Stanley SU-050 shall be mounted to
the header 10'-0" maximum above the finish floor. Using the adjustable antenna tlre detection
pattern shall be semi-circular, approximately 7'-0" wide by 5'-0" deep for a wide zone and
approximately 6'-0" wide by 8'-0' deep for a narrow zone. The location of the detection zone
shalt be adjustable from the face ofthe door (20 degrees to 35 degrees in increments of3
degrees). The unit shall operate between 30 degrees through 122 degrees F in all environmental
conditions. The supply voltage shall be 12-24 V AC/DC +/- l0% and the power consumption
shallbe6Wmaximum.
M. Safety Search Circuitry: Shall be provided which will recycle the doors when an object is
encountered during the closing cycle. The circuitry shall search for that object on the next closing
cycle by reducing the door speed at the position the object was previously encountered, and will
continue to close in check speed until the doors are fully closed, at which time the doors will reset
to normal speed. If the obstruction is encountered again, the doors shall come to a full stop. The
door shall remain stopped until the obstruction is removed and an operate signal is given,
resetting the door to its normal speed.
N. Accessories: The Dura-Glide 2000 automatic sliding door system shall have the following
accessories to reduce enerry loss: Adjustable nylon sweep(s) on the bottom of the sliding door(s),
double pile weatherstripping for the sliding door lead edges, single pile weatherstripping between
the carrier and the header on the lead stite(s) ofthe sidelight(s) and the pivot stile(s) ofthe sliding
door(s), and a selector switch located on the interior side ofthe unit to allow doo(s) to open at
full or reduced width according to weather and traffic conditions. [For clean rooms, delete
standard pile weatherstripping and insert: For clean room applications, weatherstripping shall be
rubber vinyll. [Insert, if applicable: Provide automatic locking system, hydraulic closers, battery
packs, alarm contact monitoring thresholds].
2.03 OPERATING CONDITIONS:
A. Climatic Conditions: All automatic sliding door system components shall operate between -30
degrees F and +130 degrees F in all climatic conditions.
III. PART THREE EXECUTION
3.Ol INSPECTION:
A. Veriff that the automatic sliding door system installation wilt not disrupt other trades. The
door installer shall verify that the installation area is dry, clean and free of foreign matter. Check
as-built conditions and verifu the manufacturer's automatic sliding entrance system details for
accuracy to fit the wall assembly prior to fabrication, Report in *riting to the Contractor any
detrimental conditions to the proper functioning of the automatic sliding entrance system.
Installation shall proceed once the unsatisfactory conditions have been corrected in accordance to
the manufacturer's recommendations.
3.02 INSTALLATION OF AUTOMATIC SLIDINC DOOR SYSTEMS:
A. Installation shall be by an installer approved and trained by the manufacturer in strict
accordance with the manufacturer's instructions and fire marshall's listing requirements.
B. Comply with the automatic sliding door system manufacturer's recommendations and/or
installation guide when installing the automatic sliding entrance system. Set all units plumb, level
and true.
C. Provide all fasteners required for installation of the automatic sliding door system.
D. Adjustment and Cleaning: After repeated operation of the completed installation, re-adjust
door operators and controls for optimum operating condition and safety. Clean all metal surfaces
promptly after installation.
E. Explain and review the Daily Safety Check Procedure.

GENERAL INFORMATION
Sign variances may be granted in order to prevent or to lessen such practical difficulties and unnecessary
physical hardships inconsistent with the development objectives of the Town of Vail. A practical difficulty
or unnecessary physical hardship may result from the size, shape, or dimensions of a structure, or the
location of the structure, from topographic or physical conditions on the site or in the immediate vicinity,
or from other physical limitations, street locations, or traffic conditions in the immediate vicinity. Cost or
inconvenience to the applicant of strict compliance with the sign regulations shall not be a reason for
granting a variance.
I. SUBMITTAL REOUIREMENTS
o Fee: $200.00
n Stamped, addressed envelopes and a list of the property ownens adjacent to the subject
property, including properties behind and across streets. The list of property owners shall include
the owners' name(s), corresponding mailing address, and the physical address and legal description

PRE.APPLICATION CONFERENCE
A pre-application conference with a planning shaff member is strongly encouraged. No application will be

TIME REOUIREMENTS
The Planning and Environmental Commission meets on the 2nd and 4th Mondays of each month. A
complete application form and all accompanying material (as described above) must be accepted by the

DESCRIPTION OF THE REQUEST
The Masters Gallery is requesting a variance to allow for a second business projecting
sign (i.e. awning) at 100 East Meadow Drive (VailVillage lnn site). Section 11-48.-128 (4)
of the Town of Vail Sign Regulations states the following:
Number: One sign per vehicular street of major pedestianway which the
busrness abufs, as determined by the Administrator with a maximum of two (2)
signs, subjecf to design review.
This application involves the placementol a 12.2 square foot awning sign above the
southwest side door entry. This sign would supplement the illegally existing 18.5 square
foot projecting sign above the south front doors along East Meadow Drive. Both signs
are pending review by the Design Review Board and must comply with all applicable
provisions of the Town's Sign Regulations.
The applicant's statement of the nature of the variance request is attached for reference.
REVIEWING BOARD ROLES
The PEC is responsible for evaluatinq a proposal for:
1. The relationship of the requested variance to other existing or potential uses and
structures in the vicinity.
2. The degree to which relief from the strict or literal interpretation and enforcement of a
specified regulation is necessary to achieve compatibility and uniformity of treatment
among sites in the vicinity, or to attain the objectives of this Title without grant of special
privilege.
3. The effect of the requested variance on light and air, distribution of population,
transportation and traffic facilities, public facilities and utilities, and public safety.
4. Such other factors and criteria as the Commission deems applicable to the proposed
variance.
Desiqn Review Board:
Action: The DRB has NO review authority on a variance, but must review any
accompanying DRB application.
The DRB is responsible for evaluating the DRB proposal for:
- Architectural compatibility with other structures, the land and surroundings
- Fitting buildings into landscape
- Configuration of building and grading of a site which respects the topography
- RemovaUPreservation of trees and native vegetation
- Adequate provision for snow storage on-site
- Acceptability of building materials and colors
- Acceptability of roof elements, eaves, overhangs, and other building forms
- Provision of landscape and drainage
- Provision of fencing, walls, and accessory structures
- Circulation and access to a site including parking, and site distances
- Location and design of satellite dishes
- Provision of outdoor lighting
III. STAFF RECOMMENDATION
Upon review of the criteria outlined in Section lV of this memorandum, the Community
Development Department staff recommends denial of the variance request to allow for a
second projecting sign, 100 East Meadow Drive/Lot O, Block 5D, Vail Village 1"'Filing,
based upon the following finding(s):
1. That special circumstances or conditions do not apply to the land,
building, topography, vegetation, sign structures or other matters on
adjacent lots orwithin the right-of-way, which would substantially restrict
the effectiveness of the sign.
2. The variance applied for departs from the provisions of the Vail Town
Code more than is required to identify the applicant's business use.

CRITERIA FOR EVALUATION - SIGN VARIANCE
Consideration of factors:
1. Special Circumstances Exist There are special circumstances or
conditions applying to the land, buildings, topography, vegetation, sign
structures or other matters on adjacent lots or within the adjacent right-of-
way, which would substantially restrict the effectiveness of the sign in
question, provided, however, that such special circumstances or conditions
are unique to the particular business or enterprise to which the applicant
desires to draw attention, and do not apply generally to all businesses or
enterprises.
The applicant states this variance is necessary to facilitate business identification
to pedestrians along East Meadow Drive for three reasons:
1. Large groupings of trees block the middle front of the location.
2. The major entrance is over 25 feet from the street.
3. They are a total of three retail spaces (#10, 15, and27).
This situation is similar to other properties along East Meadow Drive. Additionally,
there are alternatives under the provisions of the Town's Sign Regulations that
could meet the applicant's objectives without the need for a variance.
Staff does not believe there are special, unique circumstances on this site that
warrant a deviation in the application of the Town's Sign Regulations.
2. Applicant Not Responsible: That such special circumstances were not
created by the applicant or anyone in privy to the applicant

3. Harmonv Maintained: That granting of the variance will be in general
harmony with the purpose of the sign code, and will not be materially
detrimental to the persons residing or working in the vicinity, to adjacent
property, to the neighborhood, or to the public welfare in general.
Staff does not believe an approval of this variance request would be materially
detrimental to the persons residing orworking in the vicinig, to adjacent property,
to the neighborhood, or to the public welfare in general.
4. In Line With Provisions: The variance applied for does not depart from the
provisions of this Title any more than is required to identify the applicant's
business or use.
The Town of Vail Sign Regulations allow for use of window signage that could
address many, if not all, of the applicant's concerns. Therefore, staff believes
there are alternatives under the provisions of the Town's Sign Regulations that
could meet the applicant's objectives without the need for a variance.
5. Other Factors: Such other factors and criteria as the Planning and
Environmental Gommission deems applicable to the proposed variance.
B. The Planninq and Environmental Gommission shall make the followinq
findings before granting a variance:
1. That special circumstances or conditions apply to the land, building,
topography, vegetation, sign structures or other mafters on adjacent lots
or within the right-of-way, which would substantially restrict the
effectiveness of the sign.
2. That such special circumstances were not created by the applicant.
3. That granting the variance will be in general harmony with the purpose of
this title and will not be detrimental to the public health, safety or welfare,
or materially injurious to properties or improvements in the vicinity.
4. The variance applied for does not depart from the provisions of the Vail
Town Code more than is required to identiff the applicant's business use.

BUILDING PERMIT ISSUANCE TIME FRAME
If this permit requires a Town of Vail Fire Department Approval, Engineer's (Public Works)
review and approval, a Planning Depaftment review or Health Department review, and a review
by the Building Department, the estimated time for a total review will take as long as three (3)
weeks.
All commercial (large or small) and all multi-family permits will have to follow the above
mentioned maximum requirements. Residential and small projects should take a lesser amount
of time. However, if residential or smaller projects impact the various above mentioned
depaftments with regard to necessary review, these projects may also take three (3) weeks to
review and approve.
Every attempt will be made by this department to expedite this permit as soon as possible.

o The Town of Vail Building Depaftment has developed the following procedures to
ensure that new construction sites have adequately established proper drainage
from building sites along and adjacent to Town of Vail roads or streets.
o The Town of Vail Public Works Depaftment will be required to inspect and approve
drainage adjacent to Town of Vail roads or streets and the installation of temporary
or permanent culvefts at access points from the road or street onto the construction
site. Such approval must be obtained prior to any requests for inspection by the
Town of Vail Building Department for footings, temporary electrical or any other
inspection. Please call Leonard Sandoval at 479-2198 to request an inspection from
the Public Works Depaftment. Ailow a minimum of 24 hour notice.
o Also, the Town of Vail Public Works Department will be approving all final drainage
and culvert installation with resulting road patching as necessary. Such approval
must be obtained prior to any Final Ceftificate of Occuoancv issuance.

CODE 5-2.10: DEPOSITS ON PUBLIC WAYS PROHIBITED
q Unlawful deposits: Subject to subsection C thereof, it is unlawful for any person to litter, track or
deposit, or cause to be littered, tracked or deposited, sand, gravel, rocks, mud, dirt, snow, ice, or any
other debris or material upon any street, sidewalk, alley or public place, or any portion thereof.
o Notice; Abatement: The Director of Public Works may notiff and require any person who violates or
causes another to violate the provision of subsection A hereof, or who has in the Director's employment
a person who violates or caus$ another to violate the same, top remove such sand, gravel, rocks, mud,
dift, snow, ice or any other debris or material within twenty four (24) hours after receipt of said notice
by the Director of Public Works. In the event the person so notified does not comply with the notice
within the period of time herein specified, the Director of Public Works, or other authorized agent, may
cause any such sand, gravel, rocks, mud, dirt, snow, ice, debris or any other material to be removed
from any street or alley at the expense of the notified.
o Summons and Penalty: As an alternative to the notice for removal provided in subsection B above,
any person who violates or causes another to violate the same, may be issued a summons to appear
before the Municipal Court of the Town for said violations, and upon being found guilty of a violation
hereunder be punished as provided in Section 14-1 of this code.
o Notice and Penalty: It is unlawful for any person to fail or refuse to comply with the notice of the
Director of Public Works as provided in subsection B hereof, and any such person shall, in addition to
payment of the expense of removal incurred by the Director of Public Works, as provided in subsection B
hereof, upon being found guilty of a violation hereunder, be punishable as provided in Section 1-4-1 of
this Code. (1997 Code: Ordinance 6 (1979).

o No person shall park any vehicle upon a street or at any other place within this Municipality in such a

street or upon any place within this Municipality in such a manner as to constitute a violation of any
section of this Article, or left unattended for a period of twenty four (24) hours or more and presumed to
be abandoned under the conditions prescribed by Colorado Revised Statutes section 42-4-1102, as
amended, the officer shall require the vehicle to be removed or cause it to be removed and placed in
storage in the nearest garage or other place of safety designated or maintained by this Municipality, and
the charges for towing and storage of such vehicle shall be charged to the owner of the vehicle in
addition to a ten dollar ($10) impoundment charge, (Ord. 2(i968) 5 3: Ord. 28(1981) 5 1)

As per our conversalion concerning the handicap ramp it was shted thd if the total
cost of installing a handicap ramp exceeds Zff/o of the permitted cost of construction tlnt
a ramp would not need to be installed. The valuation of the building permit is
$11,500.00. The plumbing was delegated lowering the cost by another $4,500.00. The
cost for a new ramp is $7,019.00 and another $600.00 fior railing for a total of $7,619.00.
This far exceeds the2tr/o.I have included a copy ofthe proposal from The Gallegos
Corpordion that details the cost for the ramp. Please contact me if you need anymore
