Asbestos Testing &Abatement Requirements
Asbestos testing and abatement protects workers, homeowners, neighbors and emergency services responders from ex-
posure to harmful asbestos. It is your responsibility to be in compliance with the State. Please contact the State directly
for their requirements at the contact info listed below.
When is asbestos testinq required?
ANY building projects disturbing more than these threshold levels of building materials require asbestos testing:
One- and Two-Family Dwellings: 32 square feet
All Others (commercial spaces, hotel rooms, etc): 160 square feet
Definition of a single-family dwelling: any dwelling unit that is used primarily for a single family, including
multi-family/condominium units, and fractional fee units.
Asbestos testing results must be provided with your application for a building permit.
Tests which identify POSITIVE results at more than 1% require abatement by a State-certified abatement contractor. The
air clearance letter or form must be submitted to the Town of Vail before the building permit will be issued.

Tips&Facts:
• Even recent construction projects may include asbestos-containing materials, so buildings of�age require testing.
• The "1989 Ban" on asbestos-containing materials is commonly misunderstood. "In fact, in 1991 the U.S. Fifth Circuit
Court of Appeals vacated much of the so-called "Asbestos Ban and Phaseout" rule and remanded it to the EPA. Thus,
much of the original 1989 EPA ban on the U.S. manufacturing, importation, processing, or distribution in commerce
of many asbestos-containing product categories was set aside and did not take effect." - CDPHE

COLORADO ASBESTOS REGULATIONS SUMMARY:
Colorado State Regulation 8 requires a State certified Asbestos Building Inspector to
inspect and sample for suspect asbestos containing materials(ACM) or suspect asbestos
containing building materials(ACBM)prior to the disturbance, removal or demolition.
In residential buildings of four or fewer units if more than 32 square feet of any surface
coverage (e.g., gypsum wallboard or drywall and associated applied surfacing
materials/textures, acoustic sprays,joint compounds,plaster, etc.), 50 feet of asbestos
covered or asbestos insulated pipe or any material which would fill a 55 gallon drum—if
these materials are going to be disturbed or removed—an asbestos inspection is required
by a state certified asbestos building inspector. For buildings with more than four
residential units(considered public), including commercial,public (including public
access areas to a residential building),civic or industrial buildings, if more than 160
square feet of surfacing materials, 260 linear feet or more than 35 cubic feet of suspect
ACM/ACBM is going to be disturbed, an asbestos inspection is required under NESHAP.
County or City regulations may be more stringent. The regulations require an absolute

minimum of 3 samples (EPA suggests 9)per homogenous suspect surfacing and TSI
materials and an absolute minimum of 1 sample of homogenous miscellaneous materials
or any number of "samples sufficient to determine whether a material is ACM"
(Reg8.IV.D.3). More samples are reyuired based on surface area or volume. In order for
the contractor to proceed with restoration,renovation or demolition the suspect materials
have to be sampled and analyzed by a NVLAP accredited laboratory by polarized light
microscopy (PLM)methods. OSHA compliance is required for all employers/employees
no matter the quantity of asbestos present.
CLIENT BACKGROUND:
The owner of the property is planning to remodel some of the interior of the single family
house with attached garage. HealthSafe Inspections, Inc.was hired to perform the
required asbestos building inspection for the slated remodel. The only suspect building
materials identified for the impact on existing building materials was the drywall system.
Bathrooms, kitchen,the stairwell and a basement closet were some of those rooms which
will be impacted. This is not a total interior gut remodel.
VISUAL INSPECTION& LABORATORY FINDINGS:
An inspection was conducted by Jim Baker of HealthSafe Inspections, lnc. on
Wednesday, February 1 l, 2015 with Chas Bernhardt of MBA Group, Inc. present during
the inspection. Suspect ACM/ACBM (drywall materials only)were identified and

C/W-T 1,2,3). This surfacing material/texture was on ceilings and walls of the
house interior. The estimated impact area was more than 32 sf,but less than
1,000 sf, requiring a minimum of at least three surfacing/texture material samples.
The PLM analytical estimated results:NONE DETECTED.
A total of 4 suspect homogenous ACM/ACBM bulk samples were collected and 4
samples were analyzed. There was NO asbestos in any of the 4 samples analyzed. The
bulk samples were analyzed by PLM by a NVLAP accredited laboratory in accordance
with Colorado State Regulation 8 for the presence of asbestos mineral fibers.

HEALTHSAFE CONCLUSIONS:
There was NO asbestos in the suspect buiiding materials of the house directly related to
the slated interior remodel plan. All drywall materials can be disturbed and removed
without concern for asbestos fibers. All the building debris can be disposed of in any
landfill which accepts normal construction waste.
