All installations of exterior hot tubs or spa's require a DRB approval from planning. This application will
not be accepted without a copy of the DRB approval form attached (if applicable).
If this permit is for installation of an exterior hot tub or spa on a new elevated platform or deck over
30" above grade, you must also obtain a building permit.
If this permit is for installation of an exterior hot hrb or spa on any existing deck or elevated platform,
a structural engineer must review the existing condition and veriff that it will support the added
concentrated load. Please provide a copy of the structural engineers wet stamped letter or drawing
with this application.
If this is a remodel in a multi-famif building with a homeowners association, a letter of permission
from the association is required.
If this permit is for a commercial space, two (2) sets of stamped drawings are requircd. Elatial

Fuel Gas Code.
o All new oonstruction within tlre Town of Vail is onsidercd to be of unusually tight construction,
thus all combustion air is rcquired b be drawn from outside the stnrcturc fior mechanical
eguipment.
Town of Vail Fireolace Ordinance
In September of 1991, the Vail Town Council adopted an oldinance which rcsilxicts b construction and
use of open hearth ftrcplaoes within municipal boundaries. Since that Ume the oldinance has
undergone numerous changes and rwisions, striving for omplomise, yet effectiveness in addressing
the air quality issue. Therefiore the following criteria has been adopted:
. Construction of open hearth wood burning fireplaces is no longer permitted within Town of Vail
municipal boundaries.
Dwellino Units - Each new dwelling unit may contain:
One (1) EPA Phase II certified solid fuel buming device and no more than tro (2) gas appliances
(B vent)
OR
Two (2) gas tog ftreptaces and no more than trryo (2) gas appliance fireplaces (B bent).
Restricted Dwellino Units - Each neur restrictcd dwelling unit may contain:
One (1) gas log ftreplace and not morc than ohe (1) gas appliance fireplace.
Accommodatiod Units - Each new aeoommodation unit may contain:
One (1) gas log fireplace or one (1) gas appliance fireplace.

unit, the combined unit may rctain one woodburning fireplace (if one already exists) and no morc
than 2 gas apptiance fircplaces, or may convett up to two existing fireplaes to gas.
If during tfie oourse of a rcmodel an existing woodburning fircplace is altered or moved, the unit
must then compty with all provisions of the ordinance. That is, the fireplace must be @nvelftd to
natural gas or rFPlaed by an EPA Phase II ceftified unit.
