Town of Vail Fireolace Ordinance
In seprember of 1991, the vail Torn council adopfted an ordinance which restricts te construction and
use ot open heafltr rtreplaces within municipal boundaries. Since that time the ordinance has
undergone numerous changes ard revisions, striving br compromise, yet efiectiveness in addressing
the aii quality issue. Therefore the fiolloring criteria has ben adopted:
I Construction of open heafth urood burning fireplace is no longer permitted within Town of Vail
municipal boundaries.
o lrrirellino Units - Each new dwelling unit may contain:
One (1) EPA phase II certified sotia ruel burning derdce and no nrore than two (2) gas appliances
(B vent)
OR
niro (2) gas log fireplaces and no more than two (2) gas appliance fireplaces (B bent).
o Restricted Dwellino Units - Each new restricted dwelling unit may contain:
-Ona
(1) gas log fireptace and not mor€ than on€ (1) gas appliance fireplace.
r Accommodation Units -Iach new accommodation unit may contain:
One (1) gas log fireplace or one (1) gas appliance llreplace.
o If two or more separate dwelting units or accommodation units are combined to form one larger
unit, the combined unit may retain one woodburning ftreplace (if one already exists) and no more
than 2 gas appliance fireplaces, or may convert up to two existing fireplaces to gas.
0 If during the course of a remodel an existing woodburning fireplace is altered or moYed, the unit
must then comply with all provisions of the ordinance. That is, the ftreplace must be converted b
natural gas or replaed by an EPA Phase II certilied unit.

A. Unlawfirl deposits: Subject to subsection C thereof, it is unlawtrl for any person to litter,
track or deposi! or causl to be littered tracked or deposited, sand, gravel, rocks, rnud, dirL'
snow, ice, or any other debris or material upon any street, sidewalk, alley or public place, or
any portion thereof.
B. Notice; Abatement: The Director of Public Works may notifu and require any person who
violates or causes another to violate the provision of subsection A hereoi or who has in the
Director's employment a person who violates or causes another to violate the same, top
remove s,rch iani, gravel, rocks, mu{ dirt, snow, ice or any other debris or material wrthin
twenty four (24) hours after receipt of said notice by the Director of Public Works. In the
event the person so notified does not cornply with the notice within the period of tirne herein
specified, the Director of Public Works, or other autborized agent, may cause any such sand
gravel, rocks, mud, dirt, snow, ice, debris or any other material to be removed from any sheet
or alley at the expense ofthe notified.
C. Exceptions: The provisions of subsection A hereof shall not be applicable:
t . Within the immediate area of any construction, maintenance or repair project of any
street or alley or of any water main, sewer mairq electricity ling gas line, telephone line
or any appurtenance thereto;
2. Todepoiitsofsan4dirtormaterialsnecessaryfortheprotectionofthepublicsafety;and
3. to pu-blic areas designated for the dumping or depositing of said materials.
D. Summons; Penaltv: As an alternative to the notice for removal provided in subsection B
above, any
person who violates or causes another to violate the same, may be issued a summons to
appear before the Municipal Court of the Top'n for said violations, and upon being found
guilty ofa violation hereunder be punished as provided in Section l4-l of this code.
g. ftotiie; Penalty: It is unlawful foi any person to fail or refuse to comply with the notice of
the
Director of Public Works as provided in subsection B hereo{ and any zuch person shall, in
addition to payment of the expense of removal incurred by the Director of Public Works, as
provided insubsection B hereof, upon being found guilty ofa violationhereunder, be
punishable as provided in Section l-4-l ofthis code. (1997 Code: ordinance 6 (1979)

BUILDING PER]VIIT ISSUANCE TIME FRAME
If this permit requires a Town of Vail Fire Deparhnent Approval, Engineer's (Public Works)
review and approval, a Planning Departnent review of Health Deparhnent review, and a review
by the Building Deparunent, the estimated time for a total rwiew may take as long as three (3)
weeks.
All commercial (large or small) and all multi-family permits will have to follow the above
mentioned maximum requirements. Residential and small projects should take a lesser amount of
time. However, if residential or smaller projects impact the various above mentioned
departments with regard to necessary review, these prqjects may also take the three (3) week
period.
Every attempt will be made by this deparfnent to expedite this permit .rs soon as possible.
I, the undersigned, undcrstand the Plan Check procedure and time frame. I also understand that if
the permit is not picked up by the expiration date, that I must still pay the Plan Check Fee and
that if I fail to do so it may affect future permits that I apply for.

PUBLIC WORKS PERMIT PROCESS
How it relates to Buildins Permits
Fill out our check list provided with a Building Permit Application.
If yes was answered to any of the questions then a "Public Way'' is required. You
can pick up an application at either Community Development, located at 75 South
Frontage Road or Public Works, located at 1309 Vail Valley Drive.
Notice sign offs for utility companies. All utilities must field verifu (locate)
respective utilities prior to signing application. Some utility companies require up
to 48 hours notice to schedule a locate.
A construction traffrc control/staging plan must be prepared on a s€parate sheet of
paper. An approved site plan may also be used. This plan will show locations of
all traffic control devices (signs, cones, etc.) and the work zone, (area of
Construction, Staging, etc.). This plan will expire on November lst and will need
to be resubmitted for approval through the winter.
Sketch of work being performed must be submitted indicating dimensions (ength"
width and depth of work). This may be drawn on the traffic control plan or a site
plan for the job.
Submit completed application to the Public Work's office for review. If required,
locates will be scheduled for the Town of Vail Electricians and Irrigation crew.
The locates take place in the morning, but may require up to 48 hours to perform.
The Public Work's Construction Inspector will review the application and
approve or disapprove the permit. You will be contacted as to the status and any
requirements that may be needed. Most permits are released within 48 hours of
being received, but please allow up to one (l) weekto process.
As soon as the permit is processed, a copy will be faxed to Community
Development allowing the "Building Permit" to be released. Please do not
confuse the "Public Way Permit" with a "Building Permit" which is to do work
on a project itself.
NOTE:
The above process is for work in a public way ONLY.
Public Way Permits are valid only until November 15fr.
A new Public Way Permit is required each year if work is not complete.
