TOV Response to Comments dated 9/14/15 Response to comments: According to the ICC website on accessibility, (http://vvww.iccsafe.or�/about-icc/safetv/accessibilitv- info )the ICC recognizes the following code and regulations set forth by the Attorney General by revising the DOJ ADA regulations and including the ADA Standards of Accessible design. I have included the codes as well as the Department of Justice Commentary below. We believe we are in compliance with the intent of the code for the foilowing reason: 1. The 2010 ADA Standards as recognized to be the most current ADA standards (recognized by ICC)state the 5%of the dining surfaces are provided for the consumption of food or drink, at least 5 percent of the seating spaces and standing spaces at the dining surfaces shall comply with 902. (i.e.AN51117.1-2009J. This is the same as what is included in the IBC 2012 section 1108.2.9.1. The difference is in the commentary as interpreted by the Department of Justice after discussion, review and analysis of this section of code. I have included the full commentary at the bottom of this letter but in summary it concluded that an undue burden would be put on space if the each type/variety of dining surfaces was to meet the 5% rather the aggregate of seating in the entire dining facility.They encourage governments to see the standard of requiring accessible seating based on fixed dining tables. We believe we are providing a variety of accessible seating in the small lounge space above and beyond the code required 5%. Out of 24 total B occupants only 1.2 spaces are required. We have indicated on our plan 2 spaces,we could potentially have accessible seating on each end of all tables for a total of 4 spaces. We also have unique working conditions behind the bar due to the physical constraints of the space, amount of required equipment per health department and safety standards as well as limited employee work surface. We have made accommodations to all appropriate clearances and requirements and believes this satisfies the code as per the DOJ interpretation. The following information is take from the regulatory agencies: DOJ Review and Commentarv The Department of Justice published its revised regulations for Titles II and III of the Americans with Disabilities Act of 1990"ADA" in the Federal Register on September 15, 2010,which include the 2010 Standards for Accessible Design "2010 Standards" or"Standards". In the revised regulations,the Department included detailed guidance with a section-by-section analysis of the revisions: ARCHITECTURE• PLANNING • INTERIORS • LANDSCAPE P.O.BOX 1976,Avon,CO 81620 • 970.949.0257 •www.zehren.com . � � L Z E H R E N AND ASSOCIATES The following includes guidance from the revised regulations from the Department of Justice 226 and 902 Dining Surfaces and Work Surfaces Section 226.1 of the 2010 Standards require that where dining surfaces are provided for the consumption of food or drink, at least five percent(5%)of the seating spaces and standing spaces at the dining surfaces comply with section 902. Section 902.2 requires the provision of accessible knee and toe clearance. Commenters stated that basing accessible seating on seating spaces and standing spaces potentially represents a significant increase in scoping, particularly given the ambiguity in what represents a "standing space" and urged a return to the 1991 Standard of requiring accessible seating based on fixed dining tables.The scoping change merely takes into account that tables may vary in size so that basing the calculation on the number of tables rather than on the number of individuals that may be accommodated by the tables could unnecessarily restrict opportunities for persons with disabilities.The revised scoping permits greater flexibility by allowing designers to disperse accessible seating and standing spaces throughout the dining area. Human factors data, which is readily available to designers, provides information about the amount of space required for both eating and drinking while seated or standing. IBC 2012: 1108.2.9.1 Dining Surfaces:that where dining surfaces are provided for the consumption of food or drink, at least five percent(5%) of the seating spaces and standing spaces at the dining surfaces shall be accessible and be distributed throughout the facility and located on a level accessed by an accessible route. AN51 117.1-2009 902 Dining Surfaces and Work Surfaces 902.1 General. Dining surfaces and work surfaces shall comply with 902.2 and 902.3. EXCEPTION: Dining surfaces and work surfaces for children's use shall be permitted to comply with 902.4. Advisory 902.1 General. Dining surfaces include, but are not limited to, bars,tables, lunch counters, and booths. Examples of work surfaces include writing surfaces, study carrels, student laboratory stations, baby changing and other tables or fixtures for personal grooming, coupon counters, and where covered by the ABA scoping provisions, employee work stations. 902.2 Clear Floor or Ground Space. A clear floor space complying with 305 positioned for a forward approach shall be provided. Knee and toe clearance complying with 306 shall be provided. 902.3 Height.The tops of dining surfaces and work surfaces shall be 28 inches (710 mm) minimum and 34 inches (865 mm) maximum above the finish floor or ground. 902.4 Dining Surfaces and Work Surfaces for Children's Use.Accessible dining surfaces and work surfaces for children's use shall comply with 902.4. EXCEPTION: Dining surfaces and work surfaces that are used primarily by children 5 years and younger shalt not be required to comply with 902.4 where a clear floor or ground space complying with 305 positioned for a parallel approach is provided. 902.4.1 Clear Floor or Ground Space.A clear floor space complying with 305 positioned for forward approach shall be provided. Knee and toe clearance complying with 306 shall be provided, except that knee clearance 24 inches (610 mm) minimum above the finish floor or ground shall be permitted. Where dining surfaces are provided for the consumption of food or drink, at least 5 percent of the seating spaces and standing spaces at the dining surfaces shall comply with 902. In addition, where work surfaces are provided for use by other than employees, at least 5 percent shall comply with 902. EXCEPTIONS: 1. Sales counters and service counters shall not be required to comply with 902. 2. Check writing surfaces provided at check-out aisles not required to comply with 904.3 shall not be required to comply with 902. Advisory 226.1 General. In facilities covered by the ADA,this requirement does not apply to work surfaces used only by employees. However,the ADA and,where applicable,Section 504 of the Rehabilitation Act of 1973,as amended, provide that employees are entitled to "reasonable accommodations."With respect to work surfaces,this means that employers may need to procure or adjust work stations such as desks, laboratory and work benches,fume hoods, reception counters,teller windows, study carrels, commercial kitchen counters,and conference tables to accommodate the individual needs of employees with disabilities on an "as needed" basis. Consider work surfaces that are flexible and permit installation at variable heights and clearances. 226.2 Dispersion. Dining surfaces and work surfaces required to comply with 902 shall be dispersed throughout the space or facility containing dining surfaces and work surfaces.
