Dear Mr. and Mrs. Wagner,
Last year at about this time, Joe Batcheller, a Planner for the Town of Vail, met with you while
conducting a planning inspection. He conveyed to me that the three of you discussed what
landscaping improvements could and could not occur without a Design Review Board
application. As he recalled, the direction provided was that trees and bushes could be pruned,
but the removal of vegetation would require a Design Review Board application. He said he
recommended a survey be conducted in order to determine the exact location of the property
lines. For your reference, I have attached what limited written correspondence there is on this
topic.
Since then, it has come to the attention of the Community Development Department that the
extensive removal of vegetation has occurred on your property, as well as on adjacent
properties. This is a violation of the Vail Town Code. All work on your property must cease until
evidence is provided to the Community Development Department as to location of the 100-year
floodplain and whether or not there are wetlands on-site. This will be necessary to determine
what improvements can and cannot occur.
For the landscape work yet to be done, you will need to submit the following:
• A completed Design Review Board application
• A wetlands delineation report, and
• A landscape plan showing the proposed changes.
The landscape plan will need to show the following:
• 100-year floodplain,
• Property lines,
• The stream centerline,
• The stream setback, and

• Any wetlands on-site.
Please contact the Community Development Department no later than Friday, July 3, 2015,
letting us know you have received this letter. Thank you.
