Dear Mr. & Mrs. Watts,
My name is Joe Batcheller. I am a Planner with the Town of Vail. I am writing to inform you of a
potential zoning violation at your property located at the above address. It appears as though
your driveway was repaved without receiving design review approval. The Town has no record
of a Design Review Board application having been submitted to allow for this work. Pursuant to
Section 12-11-3, Design Approval, Vail Town Code, a design review application shall be
submitted and approved prior the exterior alteration of a property.
A. Scope: No person shall commence removal of vegetation, site preparation, building
construction or demolition, dumping of material upon a site, sign erection, exterior
alteration or enlargement of an existing structure, pavin , fencing or other improvements
of open space within the corporate limits of the town unless design approval has been
granted as prescribed in this chapter. The addition of plant materials to existing
landscaping, gardening and landscape maintenance shall be exempt from this provision.
B. Violation: It shall be a violation of this chapter and the building permit for any person to
commence, continue or complete work that has not received design approval as
prescribed in this chapter and/or is not in conformity with the plans approved and
authorized by the administrator and/or the design review board and the building official.
The Town requests that you submit an application for design review of the new driveway no
later than November 30, 2014. Applications can be found online at www.vailgov.com. Please
contact me by email at jbatchellerCa)-vailgov.com or by phone at 970-479-2440 should you have
any questions. The Town can work with you if additional time is necessary. Should an
application not be submitted by the date above, or an alternatively agreed upon date, the Town
may pursue the issuance of a citation for the violation.
