Box 2067 Vail, CO 81658 RE: 2763 Kinnikinnick Road, Vail Intermountain Development Subdivision - Block 4, Lot 1B Dear Mr. Willis, My name is Joe Batcheller. I am a Planner for the Town of Vail. I am writing to inquire about a possible zoning violation at your property located at the above address. It appears as though the decks at your house were refurbished. It would be violation to do such work without design review approval. We have no record of a Design Review Board application having been submitted to allow for this work. Pursuant to Section 12-11-3, Design Approval, Vail Town Code, a design review application shall be submitted and approved prior the exterior of a structure. A. Scope: No person shall commence removal of vegetation, site preparation, building construction or demolition, dumping of material upon a site, sign erection, exterior alteration or enlargement of an existing structure, paving, fencing or other improvements of open space within the corporate limits of the town unless design approval has been granted as prescribed in this chapter. The addition of plant materials to existing landscaping, gardening and landscape maintenance shall be exempt from this provision. B. Violation: It shall be a violation of this chapter and the building permit for any person to commence, continue or complete work that has not received design approval as prescribed in this chapter and/or is not in conformity with the plans approved and authorized by the administrator and/or the design review board and the building official. Please provide information regarding the refurbishment of the decks at 2763 Kinnikinnick Road. A Design Review Board approval form or building permit would suffice. If this work was done without authorization, the Town requests that you submit a completed Design Review Board application no later than February 20, 2015.
