Dear Shaw Construction:
I have read the FAA requirements. Shaw is required to obtain a pre-determination from the FAA. We have not received a copy of the letter of
determination.
Vail Fire&Emergency Services asked Shaw to light the tower crane per the FAA regulations. We provided advanced warning and a copy of the lighting
regulations to you. Regardless of the determination by the FAA,we are requiring lighting on the tower crane due to the medivac helicopters we have
flying in here on a regular basis.
I had two complaints yesterday because there is only a single light and it is not visible from 360 degrees.
Under the International Fire Code,2003 edition,as adopted under the Town of Vail Municipal Code,Section 10,including but not limited to
IFC 102.1, 102.7, 102.8,:
Shaw is hereby ordered to have appropriate lighting installed on the boom, including the top most portion,and the front and rear ends of the
boom. Lighting shall be visible 24/7. Compliance shall be met by 17:00 hours,October 6,2005.
Failure to comply will result in a"red tag"for the crane and possible additional enforcement actions as prescribed by law.
The helicopter pilots need to be able to see these tower cranes day and night under various weather conditions. It is a matter of public safety.
