No work was performed under this permit number. At this time we are requesting 100% refund of the use tax ($9,600) and 80% refund of the other permit cost ($5,431 .94 ). Work is not scheduled to be performed in the future. INSTRUCTIONS 1.) Attach a copy of the building permit or permit receipt showing the original amount of use tax paid. 2.) If you are claiming a refund because: a. actual cost of materials used for a project is less than 50% of the valuation shown on your building permit -submit this form for review along with the appropriate documentation. b. you are exempt from the use tax -Identify which of the exemptions cited in section 2-8-5 of the Vail Town Code (available at www.vailgov.com) applies to you and attach documentation to support your claim. Submit this form within 60 days after issuance of the building permit. c. you paid tax on materials used to construct deed restricted employee housing units which have a price appreciation cap - submit a certified copy of the recorded deed restriction conforming to Title 12 of the Vail Town Code within 60 days of issuance of the last certificate of occupancy. d. you paid the construction use tax in error or by mistake -provide an explanation as to why the tax paid is erroneous and any calculations used to determine the amount of the error. The policy for allowing refunds is listed below. Responsible: Community Development Building Department Departments Effected: Community Development Administration (Admin) Finance Building Date: September 3, 2013 Policy: The building official shall establish a refund policy for building permits. References section 109.6 International Building Code (IBC) 2012 edition. Request for reduced valuation: o Refunds may be requested for a reduction in valuation by submitting a written request to the Building Official. This request must contain supporting documentation detailing the reduction in value. o Refund request must be made prior to issuance of the building permit. Construction Use Tax: o Refunds may be requested for a refund of the Construction Use Tax by submitting the Use Tax Paid Application form to the Community Development Department as well as all supporting documentation. This form is available in the Community Development Department as well as on line at www.vailgov.com. o Determination of refund will be made by the Finance Director. There is no interface between the two programs. Any funds receipted for the permit process will be required to be initially processed in the permit tracking software as this is the tracking location for all fees collected. Finance will receive a daily report of fees collected and refunded from Community Development. All research regarding customer payments will be through Magnet. Issued Permits • If the plan review has been approved, permit issued and no inspections performed 80°{o of the permit fee may be refunded. All plan check fees are retained by the Town. Construction Use Tax and Housing Fee in Lieu are processed separately. See those SOPs for process. • If inspections have been performed no fees are refunded. 4. Overpayments -Overpayments can occur if a customer was incorrectly charged or customer reduces permit valuation . Either of these scenarios are processed the same. • Permits Plus Steps: o Add comment in LHN explaining the reason for the overpayment. o Adjust the valuation using the Revision Screen if value was amended. o The change will affect the construction use tax. The applicant needs to fill out the Construction Use Tax Refund form (see attached). Construction Use Tax is processed as a separate transaction as the Finance Director must approve the transaction.
