Application for Design Review
Changes to Approved Plans
General Information: This application is for all changes to approved plans prior to Certificate of Occupancy. An applica-
tion for Design Review cannot be accepted until all required information is received by the Community development De-
partment. Design Review approval expires one year from the date of approval, unless a building permit is issued and
construction commences.
Submittal Requirements:
The Town of Vail offers two (2) methods for submittal of materials for review of applications. Materials can be submitted
either digitally or on paper. Whichever method you select all materials shall be submitted in that format throughout the
Design Review process. The Town encourages you to consider using the submittal of digital documents and plans.
If submitting digitally all elements of the application shall be uploaded to the Town's share file site as a complete set of
materials. If submitting paper three (3) copies of the materials noted with an asterisk (*) and one (1) copy of all others
are required. The materials necessary to have a complete application are as follows:
1. Copies of all pertinent approved plans with illustrated, labeled changes.
2. Joint Property Owner Written Approval Letter, if applicable ..

As you know, three members of the Board of Directors of 9 Vail Road, Alfredo Catan, Debbie
Ford and I, met July 31 to review the final proposal for renovation of Unit 41 at 9 Vail Road.
Rhoda Kaplan was unable to attend. Also present at the teleconference were Tom Saalfeld, your
contractor Mark Hallenbeck and you.
The proposal was reviewed based on the following documents:

This review included two items which remained open from the final proposal review June 12 and
two new items. Open items included a request for a larger sliding door in the living room and a
price per square foot to expand the condominium boundaries into the Limited Common Elements
in an under-eave attic on the 5th floor. Additional items requested since the final review of June
12 included addition of two horizontal 2' x 4' operational skylights in the new bathroom on the 5th
floor and an increase in the height of the dropped ceiling in the loft area.
All approvals are subject to the Construction Guidelines, which you and your contractor have
signed; Rules and Regulations; Common Element Modification Policy and Universal Policy on
Unit Renovations, all of which can be found on the 9 Vail Road website.
This letter also serves as documentation of the Association's approvals for Town of Vail building
permits and Minor Exterior Alteration reviews.
Board review of revised proposed changes to Unit 41:
1. Enlarge sliding door in living room:
a. Not approved. The door must remain its current size to retain compatibility
with the sliding doors on the south side of the building.

2. Install two 2' x 4' operable skylights in the new 5th floor master bath. These skylights will run
perpendicular to all other skylights on the building due to a change in direction of the twin Tee's
a. The Board approved the installation of 2 operable 2' x 4' skylights.
Conditions of approval:
-Skylights must be equipped with screens, with water sensors that will
immediately close the skylights and with battery backup to ensure the windows
can be closed in the event of power failures.
-The structural integrity of the roof must be maintained; windows must be
positioned such that they do not affect any part of the twin Tee structure.
-The owner of Unit 41 and his heirs and assigns assumes all responsibility for the
maintenance of these skylights and for any damage caused to common
elements or other units due to incorrect installation or unit malfunction.
-This approval is limited to this application only. Any additional requests for
horizontally positioned or operable skylights will be individually considered and
rely extensively on the Association's experience with these skylights.
3. Raise the dropped ceiling in the loft area. In your e-mail of July 18, you had requested that the
upper boundary of the 5th floor within your condominium unit, currently defined as a dropped
ceiling at a height of 7' 11" be redefined to include all general common elements up to and
including the underside of the roof of the building. This request had been verbally reduced to
"raise the dropped ceiling in the loft area as much as possible." Your e-mail of July 24 specified
"raise ceiling height on upper floor above landing and positioning sprinklers based on
recommendation from the sprinkler contractor."
a. The Board denied the June 18 request to redefine the upper boundary of the 5th floor
loft and hallway as originally requested.
b. The Board did agree to allow a limited increase in ceiling height in the loft area above
the landing in your unit as requested in the July 24 e-mail.
Conditions of approval:
-The current flat ceiling in the unit 5th floor loft may be raised as a flat ceiling to but
not above any common elements that currently run above the defined ceiling height
of 7' 11". This includes sprinkler system pipes as they currently exist, water pipes or
any other common elements that occupy this space whether deemed abandoned or
not. As we discussed earlier, you may remove the small section of ductwork lying
diagonally on the dropped ceiling outside the entrance to the den area. This
approval does not extend to the area above the hallway and 5th floor west
bathroom as requested but not approved June 12.
Sprinkler relocation required by the extension of the loft floor and modification of
the southwest 5th floor bedroom must be approved by Town of Vail Fire Marshall.
You may not relocate the sprinkler pipes to a higher level than they exist now in
order to further raise the ceiling height.
You will not own this space but have an easement to use this space. The unit
boundary remains as defined on the current condominium map: 7' 11". This
easement may be revoked by the Association.
4. Establish a price to redefine the condominium boundary in the 5th floor den to include 3 feet of
Limited Common Element attic space as part ofthe condominium unit.
a. The Board established a price per square foot of 50% of the price per square foot paid to
acquire the unit in December, 2013 (50% of $1271.86).
b. The owner intends to expand by 1 foot a similar space at the new 5th floor master bath.
The owner will pay the 50% of $1271.86 per square foot on the net Limited Common
Element attic space added to his unit.
This is the final project review for your unit renovation. Copies of the current building permit, DRB
approval for the minor exterior alterations reviewed and approved by the Board June 12, the revised
building permit based on this review and approval by the Board and DRB approval for the bathroom
skylights must be delivered to the Association prior to commencement of any further construction on
the unit. Town of Vail Fire Marshall approval of any sprinkler system revisions and associated drawings
must be delivered to the Association prior to any modification of the sprinkler system. All change orders
must be reported in writing to the Association prior to implementation.
