The VLHA (Board) reviewed and approved February 28, 2017 meeting results. Motion to Approve: Steve Lindstrom Second: Molly Murphy Vote: 4-0-1 (Wilkins abstained) The Board, Kathleen Halloran, Finance Director and Carlie Smith, Budget Analyst reviewed the 2017 Budget Resolution 1, Series 2017 and Exemption from Audit Resolution 2 Series of 2017. Motion to Approve: James Wilkins Second: Molly Murphy Vote: 5-0 George Ruther introduced Kelli McDonald, Economic Development Director and Susan Mitchell who offered to help with marketing the Deed Restricted Purchase Program. The Board, McDonald and Mitchell discussed the program goals and promotional naming options. Mitchell will present concepts at March 28, 2017 meeting. Discussion regarding the purchasing program FAQ’s ensued. What are the goals and program intent, what questions would help interested parties identify if this program is right for them and gain understanding who, what, when, why and how. Further discussion and resolution will follow at the March 28, 2017 meeting. Lynne Campbell, Housing Coordinator went over the list of six individuals seeking understanding of the deed restriction purchasing program. Further review of the properties is needed. Deed Restriction: The purchaser must execute, in a form satisfactory to the Town aod for recording with the Eagle County Clerk concurreot with the closing of the sale, a document acknowledging the purchaser's agreement to be bound by(!) the recorded Master Deed Restriction covering the sale unit aod (2) the theo-curreot Guidelines. IV. RESALE LOTTERY CRITERIA A There are six basic eligibility requirements which must be met prior to ao individual submitting a bid to purchase ao employee-housing unit. I. The applicaot must intend to use the unit as his/her primary residence aod maintain it as his/her primary residence in the future. 2. The applicaot must be curreotly employed at a business located within Eagle County which holds a business license with the appropriate jurisdiction (Town of Vail, Town of Avon, etc.), must be employed ao average of30 hours each week on ao annual basis, aod must maintain this level of employment for as loog as he or she owns the unit. 3. The applicaot must demonstrate that at least 75% of his/her income aod earnings are earned by working at a licensed Eagle County business. 4. Neither the applicaot nor aoy member of the applicaot's immediate family (including, but not limited to, spouse aod children under 18 years of age) may own residential real estate in Eagle County at the time of application, except where that real estate is deed restricted as a Town of Vail employee housing unit with a resale appreciation cap. A curreot residence may not be deeded to a corporation or other entity in order to qualify the applicaot for a Town of Vail deed restricted unit. 5. The applicaot must be prequalified with a mortgage lender. 6. For all Town of Vail deed restricted three bedroom units, the applicaot must have a household size of 3 or more persons. For the purposes of determining household size, applicaots may include all persons related to the applicaot by blood, marriage, or adoption. If the applicaot plaos to include dependents, they must be continuously listed on federal income tax forms aod reside in the household at least six months aod one day out of every 12 month period of time. A pregoaocy may be counted towards the TownofVail Employee Housing Guidelines 10/19/99 Paae 5 ofll family size requirement as long as a note from an Eagle County doctor is provided. B. Once basic eligibility bas been met, the qualified person(s) submitting the highest bid price (not to exceed the maximum bid price) during a bidding period shall have the first right to negotiate purchase of the unit. If two or more qualified bids are submitted at the highest bid price, they shall receive preference and be prioritized for selection as the top bidder based on the highest score using the criteria listed below. Each year of residency and employment in Eagle County will count as one point in determining the total score. Additional points will be determined as follows: C. Notes: I. All current years of employment in Vail shall be weighted at 3:1 over years of employment in Eagle County. 2. All current years of residency in Vail shall be weighted at 3: I over years ofresidence in Eagle County. 3. All years of residency and/or employment prior to a leave from Eagle County shall be given points at a I: 1 ratio regardless of location ofresidency or employment within Eagle County. I. The physical place of residence and employment is what counts, not the mailing address. 2. Employment physically located on Vail Mountain shall be considered inside the Town of Vail. 3. Employment requiring work to be completed at locations "on-site" throughout Eagle County (e.g., construction sites) shall be considered outside the Town of Vail. 4. Seasonal work and part time work shall be counted on a pro-rata basis. Seasonal work and part time work alone may not be adequate to meet the 30 hours/week average annual requirement. This type of work may need to augment other employment to meet the minimum eligibility. 5. For the purposes of determining the standing of each applicant, each year of residency (or employment) reflects one point. For the portion of time in excess of a complete year, the Town will round to the next highest number ifthe time exceeds six months and one day. If the time is less than six months, the Town will round down. TownofVail Employee Housing Guidelines 10/19/99 Paae 6 ofll 6. If two individuals are applying jointly, the years of employment and/or residency shall not be combined. The single individual with the longest record of employment and/or residency shall use his or her record for the purposes of determining longevity. 7. Persons who own residences located in Vail or Eagle County at the time of the application deadline are not eligible. 8. All claims will be verified by Town of Vail staff. Claims ofresidence or employment that do not check out or are on-verifiable will not be counted in determining your longevity. 9. If there is a sole applicant in the top tier of the lottery, the scheduled lottery will not be conducted and the unit will be awarded to the top tier applicant. A drawing to establish the reserve list will be held in the Community Development office during regular business hours and shall be witnessed by the Town Clerk. 10. The application and any accompanying documentation shall become the property of the Town of Vail and will not be returned to the applicant. D. For all resales of existing Town of Vail deed restricted units, a permanent reserve lottery list will be used. The reserve list will be created using the exact same criteria outlined above. 1. The first person on the list will be offered the unit available for resale. If that person chooses not to take the unit, they will be dropped to the end of the list and the next person will have the option to purchase the available unit and so on, until a buyer is found. 2. The list will be updated by an annual lottery. 3. Separate reserve lists will be created for two bedroom and three bedroom units. V. OCCUPANCY REQUIREMENTS Once an Employee Housing Unit has been purchased, it must continue to be occupied in a manner that is consistent with the goals and policies of the Town of Vail Housing Program. The purchased Employee Housing Unit must be owner occupied by: An employee, working in Eagle County who works an average of thitty hours per week on an annual basis. A retired individual, sixty years or older, who has worked a minimum of five years in TownofVail Employee Housing Guidelines 10/19/99 Paae 7 ofll material shall disqualify the applicant from purchasing an Employee Housing Unit VIL SUBMITTAL REQUIREMENTS In conjunction with completing an application to purchase an Employee Housing Unit, the applicant shall provide, upon request by the Town, the following documentation as proof of residency and employment: A. Federal Income Tax return forms. Applicant must provide the last four (4) years of Federal Income Tax Returns, an audited financial statement, or acceptable documentation to the Town. B. Verification of current employment in Vail or Eagle County (i.e., wage stubs, employer name, address and phone number or other appropriate documentation as requested by the Town). C. Landlord verification (proof of residency, physical address). D. Valid Colorado Driver's License (address, issue date). E. Prequalification for a loan from a bank or mortgage company. F. Deposits for down payment shall be verified by the holder of such funds. G. Any co-ownership interests other than joint tenancy or tenancy-in-common must be approved by the Town. H. Signed authorization from the applicant allowing the Town of Vail to discuss details with applicant's employer. I. Any documentation which the Town deems necessary to make a determination. VIII. FORECLOSURE In the event of a foreclosure or of acceptance of a deed in lieu of foreclosure by the holder (including here and hereinafter assigns of the holder) of the promissory note secored by a first deed of trust on a deed restricted dwelling unit (hereinafter ''the Property"), and subject to the issuance of a public trustee's deed to the holder following the expiration of all statutory redemption rights, the Town of Vail (the ''Town'') shall have the option to purchase the Property which shall be exercised in the following manner: TownofVail Employee Housing Guidelines 10/19/99 Paae 9 ofll To Whom It May Concern, We are writing to ask you to reconsider the way the “lottery” portion of the Town of Vail Annual Master Resale Lottery is conducted. Last year at the lottery for the existing deed-restricted units for the Town of Vail, we were promised that the lottery would be changed for this year to address those applicants who had already been in the lottery for at least a year, as well as make the point system and tier placement a little more equitable and take luck out of the equation. The first year it seemed strange that there was a lottery portion at all, but after being in the lottery several years, the most frustrating part for us that there is no weight given to the fact that you have already been in the lottery previously and that you lose your position every year, after being on the master re-sale list for a full year already. This will be the forth year my husband, Ryan Walsh, and myself, have entered the lottery. The first two years, we were chosen 4th or 5th in our tier and then have spent the entire year working our way up to the 1st or next position, only to be forced to “re-lottery” in July. It was extremely frustrating and heart-breaking to us that for 2 years in a row a person who entered the lottery for the first time was offered a unit after only waiting a month after we had waited an entire year already. Luck plays too large a role in the process. There is no consideration given to applicants who have already waited a year or years. As an applicant, there is a possibility even though you have lived in Vail for a significant amount of time and are always in the upper tiers, simply because of bad luck you may never be offered a unit. This past year, the tier we were put in had a 50-point spread, and we were drawn so far down the list to have no hope of being offered a place. No one could explain to us why they allowed such a big tier this past year. An applicant with half the points as us, could have been chosen first in our tier and been offered a place before us. We feel that it would be more fair to have the new applicants lottery for positions in the tier behind the applicants already listed in the tier, allowing those applicants who have already been in the lottery in the previous years hold their current position. Another solution may be to be given points for already have been in the lottery for a year, i.e. an applicant would get 6 additional points for every year that they have been in the lottery. We would be happy to meet with any of the local housing authority or town representatives to explain our experiences further. We hope some changes this year will give us a little more hope in future lotteries. I’ve been a full-time tax paying resident of Eagle County since 1994. My first job was Vail Resorts teaching skiing, which I still work there after all these years.
