Frontage Road Vail,Co.81657 Dear Sirs, I am writing to you as the President of the Casolar Del Norte Homeowners Association as well as the President of the Board of Directors of the association. This letter is in regards to Paul and Nancy Rigsby and their changing of windows and proposed change of roofline to accommodate the windows that they would like to install at their home located at 1180E Casolar Del Norte Drive in Sandstone.I, representing the entire BOD,give our full support to the Bigsby's and have returned a 100%board approval vote that was taken at our last Board of Directors meeting that occurred on Monday,6/22/15. I also understand that the other party who owns the adjoining half of the duplex, Mr.John Uhley,is opposed to any change in the duplex overall and will not sign the Joint Property Owner Written Approval Letter that is part of the application process with the TOV and Community Development Department for any external changes. I have spoken with Mr.John Uhley and told him that he could simply put a notation on the form that states that the Town will not impose the expense nor the encumbrance to his property so that the Rigsby's can submit their application to the TOV and let Community Development handle all the requirements that are needed,whether they be in favor or not. I understand the steps that need to be followed but I also understand when someone is purposely obstructing the path and not allowing the Community Development Dept.to make the decisions,either on a staff level, or in front of the full DRB. In summation we,the Board of Directors of Casolar Del Norte,are stating to the Community Development Department what we believe to be true: The Bigsby's have been working in good faith with the TOV through the Community Development Department. Their architect,Marc Camens, has been into the Community Development offices and has met with two planners and Warren Campbell twice as welt as had two site visits to review the scope of work as well as the architectural drawings. Most recently,Jonathan Spence was on site to review and help finalize the plans for formal submission and review the drawings and gave a positive verbal opinion awaiting formal submission and final staff approval of the Design Review Board for the entire scope of the renovation. The Bigsby's have the full support of the Board of Directors of the Casolar Del Norte Homeowners Association and this letter is proof of our support of this project. I sincerely hope that you take into consideration all of our support and allow the Bigsby's to apply with the Community Development Department for their replacement windows project and can take into account that one property owner,albeit a contiguous duplex owner,does not have the right to 05/13/2015 14:05 9704760373 THE UPS STORE 0534 PAGE 06/07 stop the approval process as long as they are not bound to the exact same completion of changes that the other half is requesting.
