Cond: 201 (PLAN): DRB approval shall not become valid for 20 days following the date of approval, pursuant to the Vail Town Code, Chapter 12-3-3: APPEALS. Cond: 202 (PLAN): Approval of this project shall lapse and become void one (1) year following the date of final approval, unless a building permit is issued and construction is commenced and is diligently pursued toward completion. Cond: CON0014384 Vail Spa Condominium Association shall agree to enter into a Bonded Developer Improvement Agreement with the Town of Vail, in an amount to be mutually agreeable by the Town of Vail and the Vail Spa Condominiums Association, prior to the issuance of the building permit for this project, for the purposes of Vail Spa agreeing to design and construct a 6' wide separated pedestrian paver walk along the north side of the West Lionshead Circle Frontage in a similar location as shown in the Public Works comments in Project Dox. Vail Spa shall also agree to provide the Town of Vail with the necessary pedestrian easements for the portions of the pedestrian walkway that are on Vail Spa property. It is recognized that the design and construction of this path is anticipated in 2018 and the Developer Improvement Agreement shall reflect this timeframe. The pedestrian walk shall be subject to the Town of Vail approval process. In addition, Vail Spa shall agree that the proposed crosswalk implementation will be delayed until such time that a safe solution is agreed upon in conjunction with the design and construction of the pedestrian walk. The Developer Improvement Agreement shall expire December 31, 2018. Cond: CON0014385 All windows on the building that were installed prior to the year 2000 shall be upgraded to new aluminum clad windows in bronze colors to match the new window style and color. Cond: CON0014386 The eight (8) foot tall concrete wall shown on the plan in the northeast corner of the property shall be removed form the plan and is not approved.
