PRICING GUARANTEED FOR(30)DAYS FROM DATE OF THIS AGREEMENT.AT THIS TIME WE ARE UNABLE TO GUARANTEE MATERIAL PRICING GENERATED BY THE MANUFACTURERS. MATERIAL PRICING WILL BE BASED ON PRICES AT TIME OF SHIPMENT, AND PASSED ALONG TO THE CONTRACTOR OR THEIR REPRESENTATIVE AFTER THIS 30 DAY PERIOD. Any alteration or deviation from above specifications involving extra cost will be executed only upon written orders,and will become an extra charge over and above the agreement.50°/a (PERCENT)PAYMENT WILL BE MADE UPON CONTRACT APPROVAL and the balance is due within(30)thirty days of completion.Unpaid balances after thirty(30)days of completion will be charged an additional fee of(2%)two percent per month. If payment is not made as agreed herein Climate Control may immediately suspend work until payment is made,or we may terminate work under this Agreement without being held in breach of this Agreement. In the event of any breach by the undersigned Customer of the terms herein, we may immediately terminate prior to the completion elate of the work described herein. In the event of termination, we will be entitled to payment for all work and materials provided prior to the date of termination.If this account is placed with an attorney of collections Customer will be responsible for attorney fees and costs of collection. Project design documents and or specifications("design build documents")shall remain the sole and absolute property of Climate Control until it receives full payment for design build documents or upon project completion and full payment as agreed herein is made. Upon payment being received the design build documents will be provided to the owner or their representative.If the project is canceled,terminated or suspended,or Climate Control's work hereunder is terminated or suspended for any reason prior to completion as set forth herein,any design build documents or copies thereof provided to the owner or owner's representative shall be returned to Climate Control and are not to be used under any circumstance for project completion for the purpose of enhancements or improvements to said project.Climate Control will be entitled to collect attorney fees and costs for any enforcement relating to recovery of the design build documents. UNFORESEEN CONDITIONS/CHANGES:Due to the nature of retro-fit work,it is not always possible to estimate all costs involved to complete a project and actual costs may vary clue to such unforeseen factors. If unforeseen conditions are encountered at the construction sites which are subsurface or otherwise concealed physical conditions or unknown physical conditions of an unusual nature which differ naturally from those ordinarily found to exist in such a structure,Climate Control will promptly notify and investigate such conditions.Climate Control will determine the discovery of such conditions and will increase the contract pric e for the work and,if so,by approximately how much.Climate Control will provide a written work authorization or change order to be signed by the Owner or their representative prior to performing such additional work. Prior notice to Owner is not required for life/safety or potential property damage. Once signed,this agreement shall constitute a binding contract,and any terms of this agreement shall be incorporated into any base contract. If there is a conflict between the terms of this agreement and any base contract,signed change order or additional work authorization between the parties,the terms will be agreed upon in writing.
