RE: Lot 12,Vail Townhouses/Renovations/Party Wall Agreement Consent
Dear ion:
We hope this correspondence finds you well as we reach out first and foremost to thank you for your
understanding and patience throughout our Vail Townhouse Unit 12 renovations. We also realize that while
our architect and builder have discussed the extent and staging of the renovations with Mr. Polizzotto for his
comments and approval, we are required under our mutual Party Wall Agreement to obtain your written
acknowledgment and consent to certain of our renovations. We are now in a position to best explain and
obtain your approval as to our Party Wall renovations. Rest assured that we do not intend to weaken or
increase the load on our shared Party Wall with your Unit 13 and of course indemnify you against Ioss or
damage to your Unit 13 from our renovations, including Party Wall renovations, as provided in our Party
Wall Agreement and by law.
In summary, you may recall that all interior walls are being removed from Unit 12 and reconfigured. The
roof will be removed and reframed in the last phase of renovations slated for late summer. The elevation of
the Creek-level bedrooms will be lowered which requires us to add new footers that will support the existing
ones and underpinning of the entire length of the Party Wall. There will be a small addition on the back of
the Unit that will tie into and extend the existing Party Wall, which will require stucco repair and repainting.
The rear exterior patio will be lowered to match the new elevation of the bedrooms which requires a
retaining wall and work related thereto as previously discussed with you. The front living room wall on the
street-level will be moved forward and will tie into and extend the Party Wall at the front of the residences.
We will re-clad the privacy wall on Unit 12's side and tie in several new exterior privacy walls in an effort to
assure ongoing and mutual privacy between Units 12 and 13.
While most of our renovations are interior and do not touch or concern the Party Wall or mutually shared
areas,to the extent you want to be kept apprised of our construction-related activities we have requested our
professionals provide you with such information. We understand that our renovation team continues to
strive to make every reasonable attempt to be courteous to you and your guests in terms of noise, dust and
staging. We are advised that you have concerns about the proposed July time-frame renovations. Please
know that we will make every effort to assure that those concerns do not come to fruition.
