Per discussions the property owner(s) and George Ruther, Director, Community Development Department, on September X, 2015 and a subsequent meeting/discussion on X. 2015, the following terms and conditions were agreed upon as conditions of compliance and remediation. Property owners (Reusswig) will: 1. Remove existing rock wall encroachment by removing the top three to four rows of stacked stone wall, and import topsoil to cover remaining encroachment, followed by revegetation. (Town of Vail will cost share for this portion of work). 2. Contract with a Landscape Architect to submit a landscape plan to the Community Development Department for review and approval prior to initiating any work within the stream tract. 3. Contract with, and procure the services of Landscape Architect and Landscape Contractor to plant a mix of native plants, including a grass seed mix, shrubs, willows, and other riparian species. 4. Discontinue any unauthorized activities in the town-owned stream tract. 5. Acknowledge that all work installed by the property owners will be owned by the Town from installation thereafter. The Town of Vail will: 1 . Review and approve the submitted landscape plan. If the plan can not be approved at that time, the Town will provide a written list of issues which must be addressed to make the plan approvable. 2. Purchase and supply the native grass seed mix. 3. Inspect the work for acceptance upon completion. 4. Maintain the stream tract, including weed control, as deemed appropriate by the Town. 5. Remove the existing holiday lights on the spruce trees on the Town of Vail stream tract. 6. Treat diseased trees on the Town of Vail stream tract. I'd like to thank you in advance for your cooperation and assistance in helping restore the stream tract along Gore Creek. Your involvement and participation is an example I hope others will follow.
