DISCLOSURE STATEMENTS
Note: Pursuant to CRS 10-11-122, notice is hereby given that:
A) The subject real property may be located in a special taxing district.
B) A Certificate of Taxes Due listing each taxing jurisdiction may be obtained from the County
Treasurer's authorized agent.
C) The information regarding special districts and the boundaries of such districts may be obtained from
the Board of County Commissioners, the County Clerk and Recorder, or the County Assessor.
Note: Effective September 1, 1997, CRS 30-10-406 requires that all documents received for recording or filing
in the clerk and recorder's office shall contain a top margin of at least one inch and a left, right and bottom
margin of at least one half of an inch. The clerk and recorder may refuse to record or file any document that
does not conform, except that, the requirement for the top margin shall not apply to documents using forms
on which space is provided for recording or filing information at the top margin of the document.
Note: Colorado Division of Insurance Regulations 3-5-1, Paragraph C of Article VII requires that "Every
title entity shall be responsible for all matters which appear of record prior to the time of recording
whenever the title entity conducts the closing and is responsible for recording or filing of legal
documents resulting from the transaction which was closed". Provided that Land Title Guarantee
Company conducts the closing of the insured transaction and is responsible for recording the
legal documents from the transaction, exception number 5 will not appear on the Owner's Title
Policy and the Lenders Policy when issued.
Note: Affirmative mechanic's lien protection for the Owner may be available (typically by deletion
of Exception no. 4 of Schedule B, Section 2 of the Commitment from the Owner's Policy to be

A) The land described in Schedule A of this commitment must be a single family residence which
includes a condominium or townhouse unit.
B) No labor or materials have been furnished by mechanics or material-men for purposes of
construction on the land described in Schedule A of this Commitment within the past 6 months.
C) The Company must receive an appropriate affidavit indemnifying the Company against un-filed
mechanic's and ma(erial-men's liens.
D) The Company must receive payment of the appropriate premium.
E) If there has been construction, improvements or major repairs undertaken on the property to be purchased
within six months prior to the Date of the Commitment, the requirements to obtain coverage
for unrecorded liens will include: disclosure of certain construction information; financial information
as to the seller, the builder and or the contractor; payment of the appropriate premium fully
executed Indemnity Agreements satisfactory to the company, and, any additional requirements
as may be necessary after an examination of the aforesaid information by the Company.
No coverage will be given under any circumstances for labor or material for which the insured
has contracted for or agreed to pay.
Note: Pursuant to CRS 10-11-123, notice is hereby given:
This notice applies to owner's policy commitments containing a mineral severance instrument
exception, or exceptions, in Schedule B, Section 2.
A) That there is recorded evidence that a mineral estate has been severed, leased, or otherwise
conveyed from the surface estate and that there is a substantial likelihood that a third party
holds some or all interest in oil, gas, other minerals, or geothermal energy in the property; and
B) That such mineral estate may include the right to enter and use the property without the
surface owner's permission.
Nothing herein contained will be deemed to obligate the company to provide any of the coverages
referred to herein unless the above conditions are fully satisfied.

We have reviewed the preliminary plat that you have prepared and have prepared
the comments listed below, organized by sheet number.
1. GENERAL COMMENTS
1. Please confirm that the draft map includes all certifications/signature blocks per
the Town of Vail Plat Approval Procedure Ordinance for any necessary governmental approvals.
2. All references to "General Common Element" should be revised to "Common
Element," and all references to "G.C.E." should be revised to "C.E." to conform to the
definitions in the Declaration and the Colorado Common Interest Ownership Act.
3. The title of the project should be revised to "Willows Condominiums at Vail"
This revision should be made in Notes, Certifications and any other references on the Map.
4. In the Notes / Legend on each Map (particularly, pages 3-5), please include a note
that references "L.C.E. - QS" as a limited common element to Quarter Share Units; and a note
that references "L.C.E. - WH" as a limited common element to Whole Ownership Units.
5. Please see the Map attached as Exhibit A for revisions to designations of Limited
Common Elements.

have by these presents laid out, platted and subdivided the same into parcels as
shown on this final plat under the name and style of Willows Condominiums at Vail, a

C. The Notary Block needs to include the phrase: "limited liability
limited partnership" (currently, it only says "limited liability partnership")
4. In accordance with 38-33.3-201(2), please add to the Surveyor's Certificate, the
following statement: "All structural components of all buildings containing or comprising any
units thereby created are substantially completed."
The name in Note #3 should be revised to "Willows Condominiums at Vail"
6. Note # 6 should be revised to include the date of recordation, as follows: "An
easement recorded September 13, 1994 at Book 649, Page 837..."
7. Note # 8 should be revised to include the date of recordation, as follows: "An
easement recorded April 14, 2006 at Reception No. 200609611..."
8. In accordance with CRS 38-51-106(1)(b), whereby all easements and rights of
way are required to be shown, a new Note should be added to Page 1 that states: "A right of way
for ditches or canals constructed by the authority of the United States as reserved in United
States patent recorded July 12, 1899 at Book 48, Page 475. Specific location not defined. No
visible ditches or canals."
9. In response to CRS 38-33.3-209(e), we propose the following language to be
included as a new Note on Page 1: "It is not feasible to provide a legally sufficient description of
all easements serving or burdening the Property."
10. In accordance with CRS 38-33.3-209(b) and (c), we propose the following
language to be included as a new Note on Page 1: "No real estate within the common interest
community is subject to development rights."

1. Garage Level
a. Hatch marks for the parking spaces should be shown, and the
parking spaces should be numbered in accordance with the attached Exhibit B. A reference
should be made that the hatch marks are not part of the plat. Parking Spaces 1-9 need to be
identified as L.C.E. - WH, and Parking Spaces 10-15, and 17-19, need to be identified as L.C.E. -
QS. This can be done either (A) individually, for each parking space, or (B) by including a
Legend. Parking Space 16 will be owned by the Association, and therefore should not be labeled
as an LCE or CE.
(1) NOTE TO THE SURVEYOR: As requested by the
Developer, Parking Units 1-6, and 9, each contain 2 parking spots. Parking Unit 8 contains 4
parking spots.
b. The LCE storage spaces on the garage level should be numbered
(or lettered) in accordance with Exhibit B. The Storage Spaces that are Lettered, should be
identified as L.C.E. - WH; and the Storage Spaces that are numbered should be identified as
L.C.E. - QS. This can be done either (A) individually, for each storage space, or (B) by
including a Legend.
