to construct a small addition toward my east property line. As shownon the attached original Site Plan,
when my house was built in 1977 the side setback was 10 feet and my house was 3 feet inside of this
setback. My proposed addition will be well within the original 10 ft. setback. However, it will
encroach into the new 15 ft. setback requirement.
• Compatibility of the Use—The use will remain residential which is compatible with the
surrounding properties.
• Impact of the Use—This small addition will have no negative impact on the health, safety,
welfare or development objectives of the Town.
• Effect of the Use—My change from a wood burning fireplace to gas will improve air quality.
There will be no negative effects on light,population,transportation or utilities. The additional
landscaping shown will help screen the east wall from the neighbor.
• Effect on Traffic—The addition is to my living room and kitchen area with no bedrooms. It
will not increase the population or impact transportation,traffic or snow removal.

• Effect on Character of the Area—The height of my house will not be changed. The addition
will be 54 ft. from the nearest neighbor. The encroachment will be only 34 sq.ft. of floor area
by 10 ft. high. Only 28 sq.ft. of added deck area will encroach into the 15 ft. setback.
• Reason for the Variance—I hope you will agree that this variance is warranted because the
original Owner and Architect located the home 3 ft. from the 10 ft. setback line to allow for
future changes and additions. This was a reasonable expectation which was unfairly eliminated
by the Town when the setback was changed to 15 ft. in the mid 1980s.
I feel that the Town's change from a 10 ft. to a 15 ft. setback on my lot is an exceptional and
extraordinary condition which was imposed many years after my home was constructed.
Therefore, it creates an unnecessary and unfair hardship because it would prevent me from
utilizing my property in the manner that was originally intended by the Town in making the
original side setback 10 ft.
