Thank you for your inquiry into the zoning and re -subdivision of your property located at
4859 Meadow Drive in Vail. As I understand from your correspondence, the property
was originally constructed as a two-family dwelling. In approximately 2002 - 2003 the
property was remodeled, at that time the property line between the two dwelling units
was vacated, creating one property. You have asked if the property can be re -
subdivided, so that the two dwelling units on the property may be separately owned.
The property is zoned Two -Family Primary/Secondary. The minimum lot size to allow
two (2) dwelling units in this zone district is 14,000 square feet. The lot is approximately
21,780 square feet, and is permitted to have two (2) dwelling units. In the Two -Family
Primary/Secondary district, the secondary side is permitted a maximum of no greater
than 40% of the allowed Gross Residential Floor Area (GRFA) permitted on the lot. The
permitted GRFA on a lot of 21,780 in the Two -Family Primary/Secondary district is
7,381 square feet. The secondary unit may not exceed 2,952.4 square feet. As long as
the property, when subdivided, continues to meet this requirement, and other code
requirements for a two-family dwelling, then the property may be subdivided. (Other
zoning code requirements include such requirements as on-site parking, setbacks,
height, minimum landscaping, maximum site coverage, etc.)
In order to subdivide the property, you will need to apply for Duplex Subdivision, which
may be submitted through the Town of Vail website: http://www.vailgov.com/online-
services .
