It is your responsibility to be in compliance with the State. Please contact the State directly for their requirements at the contact info listed below. When is asbestos testing required? ANY building projects disturbing more than these threshold levels of building materials require asbestos testing: One- and Two-Family Dwellings: 32 square feet All Others (commercial spaces, hotel rooms, etc): 160 square feet Definition of a single-family dwelling: any dwelling unit that is used primarily for a single family, including multi-family/condominium units, and fractional fee units. Asbestos testing results must be provided with your application for a building permit. Tests which identify POSITIVE results at more than 1% require abatement by a State-certified abatement contractor. The air clearance letter or form must be submitted to the Town of Vail before the building permit will be issued. Project Checklist Will not disturb more than the threshold limits identified above. In residential buildings of four or fewer units if more than 32 square feet of any surface coverage (e.g., gypsum wallboard or drywall and associated applied surfacing materials/textures, acoustic sprays, joint compounds, plaster, etc.), 50 feet of asbestos covered or asbestos insulated pipe or any material which would fill a 55 gallon drum—if these materials are going to be disturbed or removed—an asbestos inspection is required by a state certified asbestos building inspector. For buildings with more than four residential units (considered public), including commercial, public (including public access areas to a residential building), civic or industrial buildings, if more than 160 square feet of surfacing materials, 260 linear feet or more than 35 cubic feet of suspect ACM/ACBM is going to be disturbed, an asbestos inspection is required under NESHAP. County or City regulations may be more stringent. The regulations require an absolute minimum of 3 samples (EPA suggests 9) per homogenous suspect surfacing and TSI 1 materials and an absolute minimum of 1 sample of homogenous miscellaneous materials or any number of “samples sufficient to determine whether a material is ACM” (Reg8.IV.D.3). More samples are required based on surface area or volume. In order for the contractor to proceed with restoration, renovation or demolition the suspect materials have to be sampled and analyzed by a NVLAP accredited laboratory by polarized light microscopy (PLM) methods. OSHA compliance is required for all employers/employees no matter the quantity of asbestos present. CLIENT BACKGROUND: The property addressed above is slated for remodel work in the ground floor area in the mud room, mechanical, laundry and southwest room (to be converted into a master guest bedroom and master guest bathroom). Prior to submittal for the building permit for this remodel work, an asbestos inspection was required. HealthSafe Inspections, Inc. was hired to perform the asbestos inspection, sampling and reporting for this specific remodel plan. VISUAL INSPECTION & LABORATORY FINDINGS: An inspection was conducted by Jim Baker of HealthSafe Inspections, Inc. on Thursday, March 26, 2015 with Heather Duncan and others from Shaeffer Hyde Construction present during the inspection. Suspect ACM/ACBM (drywall materials were the only suspect materials) were identified and sampled; those materials were the following: 1. A homogenous taped and joint compounded drywall system (classified as a miscellaneous material as a complete integral system) [MUD-PLSTR-J]; these composite layered taped and joint compounded drywall materials were on ceilings and walls of the mud room off the garage and west ground floor entrance with a “plaster” applied surfacing material/texture. The estimated impact area was more than 32 sf, but less than 1,000 sf, requiring a minimum of at least one composite core sample of all drywall layers. The PLM analytical estimated results: NONE DETECTED. 2. A homogenous trowel-applied surfacing material/texture (“plaster”) [MUD- PLSTR-T-1,2,3]. This surfacing material/texture was on ceilings and walls of the mud room. The estimated impact area was more than 32 sf, but less than 1,000 sf, requiring a minimum of at least three surfacing/texture material samples. The PLM analytical estimated results: NONE DETECTED. 3. A homogenous taped and joint compounded drywall system (classified as a miscellaneous material as a complete integral system) [ST-C/W-J]; these composite layered taped and joint compounded drywall materials were on ceilings and walls of the ground floor laundry room, mechanical room, a closet and a southwest room (to be converted into a guest master bedroom) with a “skip- trowel” applied surfacing material/texture. The estimated impact area was more than 32 sf, but less than 1,000 sf, requiring a minimum of at least one composite 2 core sample of all drywall layers. The PLM analytical estimated results: NONE DETECTED. 4. A homogenous trowel-applied surfacing material/texture (“skip-trowel”) [LNDR- ST-C/W-T-A; MEC-ST-C/W-T-1; MSTR-S-ST-C/W-T-2; MSTR-ST-C/W-T-3]. This surfacing material/texture was on ceilings and walls of the ground floor laundry room, mechanical room, a closet and a southwest room (to be converted into a guest master bedroom). The estimated impact area was more than 32 sf, but less than 1,000 sf, requiring a minimum of at least three surfacing/texture material samples. The PLM analytical estimated results: NONE DETECTED. A total of 9 suspect homogenous ACM/ACBM bulk samples were collected and 9 samples were analyzed. The bulk samples were analyzed by PLM by a NVLAP accredited laboratory in accordance with Colorado State Regulation 8 for the presence of asbestos mineral fibers. There was NO asbestos in all of the collected bulk samples. See supporting Reservoirs Environmental, Inc. data: report # 315898-1. HEALTHSAFE CONCLUSIONS: All drywall materials in the ground floor laundry room, mechanical room, closet, mud room and southwest room ceilings and walls can be disturbed, removed and/or disposed of in any landfill which accepts normal, non-hazardous construction waste and debris. No asbestos abatement will be required in this specific remodel plan converting the rooms into a master guest bathroom and master guest bedroom.
