Dear Chris: On November 23, 2009, the Town of Vail Planning and ?‘ - Environmental Commission _• 1-11144, approved a Conditional Use �� Permit for a private parking lot located on the former BP/Amoco LL �' gas station site, with an expiration date of November 23, 2012 (PEC09-0032). On =_ October 4, 2012, the Town of �I Vail Community Development O Department administratively approved a three year extension, granting approval to November • 23, 2015, unless the proposed ' EverVail project has submitted for building permits and is moving forward diligently towards the start of redevelopment. As you are aware, building permits for EverVail have not been submitted. As a result, Vail Resorts is requesting an extension of the Conditional Use Permit for the West Day Private Parking Lot for an additional three years, or until November 23, 2018. No changes are proposed at this time. We have provided a Town of Vail Conditional Use Permit Application Form, adjacent property addresses, the Conditional Use Permit application fee of $650, and a copy of the extension of approval that was granted on October 4, 2012. (PEC120034) Applicant: Vail Resorts Development Company, represented by the Mauriello Planning Group Planner: Warren Campbell Dear Planning and Environmental Commission members and adjacent property owners: The purpose of this letter is to inform you that the Town of Vail Staff has approved an amendment to the approved conditional use permit for the Vail Resorts private parking lot located on the former BP/Amoco gas station site. The conditional use permit for the private parking lot was conditionally approved on November 23, 2009, with an expiration of November 23, 2012 or the obtainment of building permits for Ever Vail. As Ever Vail will not be moving forward by this deadline the applicant has requested an extension of the conditional use permit. Staff's approval includes the following condition: 1. This conditional use permit shall expire on November 23, 2015, unless the proposed Ever Vail project has submitted for building permits and is moving forward diligently towards the start of redevelopment. The Town of Vail Staff has determined that this amendment to the approved private parking lot conditional use permit meets the review criteria prescribed by Section 12-16-10, Amendment Procedures, Vail Town Code. This administrative approval of a conditional use permit amendment will be reported to the Town of Vail Planning and Environmental Commission at its Monday, October 22, 2012 public hearing at 1:00 p.m. in the Vail Town Council Chambers, located at 75 South Frontage Road West. The Planning and Environmental Commission reserves the right to "call up" this administrative action for additional review at this hearing. This administrative action may also be appealed by an adjacent property owner, any aggrieved or adversely affected person, or the Vail Town Council as outlined in Section 12-3-3, Appeals, Vail Town Code.
