As we have discussed, the town is solely responsible for all mowing, removal of vegetation or other landscaping activities on this property, and will perform these activities in the future at its sole discretion. This letter serves as a follow up to our discussion regarding these items; stonework, patio, and possible modifications to the retaining wall structure. As agreed in the phone conversation on October 24, 2017, the stone patio closest to Gore Creek has been removed. In regards to additional improvements existing on Town Property (i.e., additions to the retaining walls and the patio and/or decking area immediately adjacent to the property line), the Town reserves the right to require removal of these improvements as part of any future development review application, however as they are currently contributing to the structural integrity of the property, they may remain in place. The Town requests that you acknowledge and agree, by your signature below, as follows: 1. That the property on which these improvements were installed is owned by the Town; 2. That the Town accepts the Landscape Plan, Attachment A, to be installed by you by July 30, 2018, and after initial revegetation Town is solely responsible for all mowing, removal of vegetation and other landscaping activities on this property; 3. That the Town has not consented to any mowing, removal of vegetation or other landscaping activities on this property beyond initial revegetation and establishment; 4. That no improvements, either temporary or permanent, will be installed on such property in the future, including without limitation patio furniture and landscaping materials; 5. That you will not mow, remove vegetation or perform any other landscaping activities on this property; and 6. That this letter agreement will be recorded in the records of the Eagle County Clerk and Recorder so that future owners of your property are on notice of its provisions; Please sign this letter below and return it to me within ten (10) days.
