Conditions:
- All exposed metal flashing, trim, flues, vents, and rooftop mechanical equipment shall be anodized, painted
(adjacent facade/roof material color or flat black), or capable of weathering so as to be non-reflective
pursuant to Section 14-10-5C, Building Materials and Design, Vail Town Code, pror to requesting final
inspections.
- Approval of this project shall lapse and become void one (1) year following the date of final approval, unless
a building permit is issued and construction is commenced and is diligently pursued toward completion.
- Design Review Board approval does not constitute a permit for building. Please consult with Town of Vail
building personnel prior to construction activities.
- Prior to issuance of a Certificate of Occupancy or Temporary Certificate of Occupancy for the building, the
applicant shall legally execute and record with the Eagle County Clerk and Recorder the Town of Vail Type VI
employee housing unit covenant for all sixty-five (65) dwelling units within the building.
- This property is located in a "geologically sensitive area" pursuant to Chapter 12-21, Hazard Regulations,
Vail Town Code.
- The applicant for this project is required to submit a foundation Improvement Location Certificate (ILC)
showing the foundation of the structure in compliance with the approved development plan in conjunction with
the building permit inspection process.
- The applicant for this project is required to submit a framing Improvement Location Certificate (ILC)
showing ridge and eave elevations in compliance with the approved development plan in conjunction with the
building permit inspection process.
- Prior to issuance of a building permit, the applicant shall provide an updated traffic study based on the
proposed building and site designs.
- Prior to the issuance of any building permit for construction within the geologically sensitive areas, the
owner shall submit a written, signed and notarized affidavit certifying acknowledgment of receiving personal
notice of the fact that said building or structure is in an area of geologic sensitivity and notice of the studies
conducted to date with regard thereto.
- Prior to issuance of a building permit, the application shall exchange eleven (11) existing deed restrictions
on the property to other locations in the Town of Vail, through the Employee Housing Unit Deed Restriction
Exchange Program, Section 12-13-5 Vail Town Code. If the applicant obtains one building permit which
includes demolition of the existing building and construction of the new building, then the employee housing
unit deed restriction exchanges may be delayed until the issuance of a Certificate of Occupancy for the new
Solar Vail Building.
