Dear Mr. Kuschner;
As requested, a representative of Hepworth-Pawlak Geotechnical, Inc. observed the
subject site on Apri13, 2008 to evaluate the rockfall hazard potential to the existing
residence at 1995 Chamonix Lane in the town of Vail, Colorado. Our study consisted of
a site reconnaissance and review of published regionai hazards mapping and topographic
mapping af the area. The review was conducted in accordance with our agreement f�r
professional services with you dated Apri12, 2008.
Proposed Construction: The western unit of the duplex on the property was reportedly
built in ] 972. 7'he residence is proposed to be remodeled and will not increase in
building footprint. A review of the potential rockfall impact to the site is required by
Town of Vail for the building permit.
Site Conditloas: The existing residence on Lat 27 is a one story duplex with a walkout
basement. It is located along Chamonix Lane to the south, existing two story residences
to the northeast and west, and open space to the northwest. Lot vegetation wnsists of
landscaped brush with pine and aspen trces reaching between 40 to 60 feet tall. A small
drainage swale roughly follows the western side of the lot. The hillside northwest of the
existing lot has a slope between 45 to 70% and drops from the north and northwest dawn
to the south and southeast. Snow cover on the property was between 3 to 4 feet deep.
Rockfall Source: Several prominent rock outcrop bands and low cliffs formed by
erosionally resistant sandstone and limestone of the Minturn Formation are present on the
steeper areas of the hillside northwest of the lot. Jointing in the Minturn Formation
produces a blocky structure at the rock outcrops. The jointed rock blocks of the Minturn
are potential source areas for rockfall. The valley side between the rock outcrops is
underlain by colluvium and glacial drift deposits. Vegetation on the hillside consists of
low brush and grass.
RockfaU Evaluadon: The regional rockfall hazard study prepazed for the Town of Vail
(2000) indicates that Lot 27 is in the southeast limit of the high severity rockfall hazard
zone. We concur with the regional study that Lot 27 is exposed to potential rockfall

hazard, but would judge the likelihood that a rockfall could reach thc existing residence
during a reasonable service life to be low to moderate. The gresence of rock blocks on
the slope above the property could not be observed due to snow cover.
Although unlikely that a rockfall will reach the residence on Lot 27, it could result in
severe damage to the strudure and potential harm to its occupants. The owner of the
residence should be aware of the risk and accept the potential consequences of a rockfalL
If the risk is not acceptable, then the feasibility of developing rockfall mitigations should
be further evaluated.
Limitations: This review has been performed in accordance with generally accepted
engineering geologic principles and practices in this aresi at this time. We make no other
wairanty either express or implied. The conclusions are based on a site reconnaissance,
review of the published data, and our experience in the area. This report has been
prepared for the exclusive use by our client for site evaluation. Evaluation of possible
rockfall hazard mitigation measures for Lot 27 are beyond the scope of this review.

D&D Environmental Consulting, Inc. (D&D) is pleased to provide the results of the walk-through and collection of
representative bulk samples of suspect asbestos containing materials from the residential structure referenced above.
The asbestos survey was limited to collection of representative bulk samples of suspect drywall and drywall joint
compound, texture and floor tiles and associated mastic. Reportedly, these materials may be impacted by the
renovation activities. The walk-through of the renovation areas, collection of representative bulk samples, and
delivery of the bulk samples to an independent analytical laboratory was completed on May 15, 2008. The work
was performed by D&D Building Inspectors, certified and accredited by the Environmental Protection Agency
(EPA) and the State of Colorado.
UNDERSTANDING
D&D understands that a representative of J.L. Viele Construction, Inc. was seeking a professional environmental
consulting company to conduct a walk-through and conduct a limited asbestos survey of the areas impacted by
renovation, collect representative bulk samples of suspect materials, and submit the bulk samples to an independent
analytical laboratory for analysis based on rush 24-hour turnaround time. This report of findings was prepared based
on the results of the analysis.
SCOPE OF WORK
Twenty-nine representative bulk samples were collected of suspect asbestos containing materials (ACM) on May 15,
2008. The representative bulk samples were submitted for asbestos content analysis of the fotlowing materials:
Texture (5 types)
Drywall & drywall joint compound (3-types)
Floor tile and associated mastic
ANALYTICAL PROCEDURES
The bulk samples collected of suspect asbestos containing materials were delivered to DCM Science Laboratory, a
National Voluntary Laboratory Accreditation Program (NVLAP) asbestos laboratory located in Wheat Ridge,
Colorado for rush 24-hour turnaround time analysis. All bulk samples are archived for six months unless otherwise
stipulated by the client.

According to the analytical laboratory, the bulk samples were analyzed in accordance with EPA Method 600/R-
93/116. Small portions of the sample were placed in Series: E High Dispersion Refractive Index Liquid on a
microscope slide. The prepared samples were observed at 100X (power) under polarized light using a McCrone
Dispersion Staining Objective. The characteristics of the fibers were compared to the known properties of asbestos
iibers for dispersion color, polarity, extinction and general morphology. Sample content (given by percentage) was
made by visual estimates by comparison of asbestos fibers to total materials.
RESULTS
The US Environmental Protection Agency (EPA), the Occupational Safety and Health Administration (OSHA), and
the State of Colorado Air Quality Control Commission considers a material as asbestos containing if the reported
amount of asbestos is greater than one percent. According to the analytical report, all of the samples were reported
as a trace amount (1% or less) of asbestos. However, three of the drywall joint compound samples were reported as
containing a trace amount of chrysotile asbestos and nine of the texture samples were reported as containing a trace
amount of chrysotile asbestos. The remaining texture and drywall and floor tile samples were reported as none
detected (ND) for asbestos content.
The nine texture samples and the three drywall joint compound samples were re-submitted for nzsh 2-hour
turnaround time point-count analysis. According to the analytical results, the point-count of the nine texture
samples confirmed the results of the visual analytical method of a trace amount of asbestos. The results of two of
the three bulk samples of drywall were confirmed as containing a trace amount of asbestos in the joint compound
layer. Then remaining sample was reported as containing 1.25 percent chrysotile asbestos in the drywall joint
compound layer and the composite result of this sample was calculated to be less than one-percent. A summary of
the State of Colorado's policy statement regarding drywall and drywall joint compound, as it relates to demolition
and renovation activities, listed below. The appropriate chain of custody form and the analytical results are attached.
The National Emission Standard for Hazardous Air Pollutants (NESHAP) requires that materials reported as
containing a trace amount of asbestos (1 % or less) be confirmed by the point-count analytical method before they
are reported as unregulated. If the point-count result confirms the result of the PLM method, those materials may be
considered unregulated and will not have to be removed prior to demolition activities.
According to the analytical report of the point-count analysis, the texture samples and the drywall joint compound
samples were reported as trace amounts of chrysotile asbestos. Therefore, these materials will not require removal
prior to commencing demolition activities. However, under the OSHA Asbestos Regulations, limited engineering
controls, such as wet methods, must be designed and installed to prevent the release of asbestos fibers during periods
of disturbances. In addition, the renovation contractor as well as all other personnel working in and around the
texture must be notified of the trace amounts of asbestos detected and their locations.
The Colorado Department of Public Health and Environment (CDPHE) issued a policy statement regarding
demolition and renovation projects impacting asbestos containing drywall joint compound. A summary of that
policy follows.
Drywall mud has been found, in many situations, to contain significant amounts of asbestos while the substrate
material that it is applied over may not contain asbestos. According to the State of Colorado, if the composite
analysis (percent of asbestos in the combined mud/drywall) indicates an asbestos content of one percent or less,
even though the mud may contain greater than one percent, the material is not considered asbestos containing for
the purposes of demolition of the entire wall, and therefore does not fall under the asbestos abatement requirements
of Regulation 8. However, if the drywall mud itself is impacted by sanding, drilling or scraping, these activities may
fall under the CDPHE Regulation No. 8. In addition, under OSHA regulations, the demolition contractor must be
notified of the trace amounts of asbestos. Control measures must be installed that eliminate potential exposure to the
workers when it is disturbed.

RECOMMENDATIONS AND SUMMARY
Although the textures and drywall joint compound are not considered a regulated material by the State of Colorado
or the USEPA, the OSHA Asbestos Regulations must be followed during periods of disturbances and require the use
of limited engineering controls, such as wet methods, and notification of the asbestos content to all personnel
involved with renovation activities.

Description of the Request
Changes to the Approved Plans — Application for Design Review
Reauested Chanqes:
1. Remove the deck on the south side of the Kitchen/Dining Room.
2. Maintain the garage in its existing layout. Foundation to remain.
3. Using the existing garage floor structure, the Kitchen, Dining Room and Office will
overlay the existing garage footprint.
4. Reduce the height of the Dining Room/Office roof line as indicated on the elevations.
5. Various window configurations as a result of the above requested changes.
6. Adaptive re-use of existing windows incorporated into the Office (north and west
elevations).
7. Re-seal the existing asphalt driveway instead of replacing asphalt.
8. Leave the overhead power line in place as Holy Cross is planning on reconfiguring and
burying the neighborhood's overhead power lines in the near future.
9. Remove the existing loft's plywood floor only instead of demolishing the structural floor.
10. Delete the lower deck area off the north-west corner of the garage.

I understand the time constraints with this project and appreciate your patience. I have reviewed the Change
to Approved Plans application (DRB 08-0190) and have the following comments and requests to proceed:
1. The existing home is non-conforming as to the above ground power lines. I agree, the proposed
Kirshner addition qualifies for the 'one-time exclusion' under section 12-11-3(C)(2). To claim the 'one-
time exclusion,' please complete the attached Exclusion form and submit with a check (To Eagle County
Recorder) in the amount of $6 for first page and $5 for all subsequent pages, for recording fees (The
Town Clerk will record). Note: Please clearly specify the unit # in the legal description, as the other 1/2
of the duplex is also allowed a one-time exclusion.
2. The existing loft, that was originally approved to be removed, may be partially replaced with 2x4 joists,
non-weight bearing, but capable of supporting the false ceiling desired. The stairs must still be
removed. Please re-submit plans #A2.0 & A4.0, indicating the change to 2x4's.
Once I receive the above mentioned items, I will Staff approve the request. Thank you for your time and

Nicole: Very interesting question. The existing s.f. for the Kirschner side of the duplex is 2,768 s.f. of GRFA.
The proposed GRFA is 2,755 s.f. per the latest calculations shown.
We have actually reduced GRFA for the Kirschner side. We achieve this "balance" of before and after GRFA by
eliminating the existing loft and the existing office and reconfiguring that s.f. into the "addition" over the existing
garage. The "addition" over the garage consisting of Kitchen, Dining and Office is 645 s.f.

Kirk and 1 met today about the proposed changes to the Kirschner Residence. After Kirk left, I researched the
issue of the power lines. Please see attached code sections that are applicable to the requirement to bury the
power lines (Attached: Sections 14-10-10, 12-11-3 and 12-11-5, Vail Town Code). As you will see the
requirement to bury lines applies to all additions, with the exception of one 500 sf addition. This poses a
question: How many square feet are proposed through the addition (Kirk, couid you answer)? Please let me
know.

12-11-3: DESIGN APPROVAL:
A. Scope: No person shall commence
removal of vegetation, site prepara-
tion, building construction or demoli-
tion, dumping of material upon a site,
sign erection, exterior alteration or
entargement of an existing structure,
paving, fencing or other improvements
of open space within the corporate
limits of the town unless design ap-
proval has been granted as prescribed
in this chapter. The addition of plant
materials to existing landscaping,
gardening and landscape maintenance
shall be exempt from this provision.
B. Violation: It shall be a violation of this
chapter and the building permit for
any person to commence, continue or
complete work that has not received
design approval as prescribed in this
chapter and/or is not in conformity
with the plans approved and autho-
rized by the administrator and/or the
design review board and the building
official.
C. Nonconforming Sites And Structures;
Effect Of Design Guidelines:
1. Buiidings and sites which are not in
conformance with the design guide-
lines, due to annexations or changes
in code provisions (i.e., legal
nonconformities), shall be required to
conform with the design guidelines
when allowable gross residential fioor
area (GRFA) (the GRFA that is per-
mitted by the density control section
of various zone districts), commercial
floor area, or garage area credit is
added to any existing structure or site.
2. From the effective date of July 21,
1998, there shall be permitted a one-

time exclusion from this provision for
an expansian to single-family, two-
famity, and primary/secondary resi-
dential dweliing units. This ��e
exclusion shall be allowed for a single

square feet or ess of allowable GRFA
or garage area credit per dw g

expanded without requiring upgrades
to entire structures and sites ta con-
form to the design guidelines. The
addition itseif, however, shail conform
to the design guidelines. An expan-
sion which is greater than five hun-
dred (500) square feet, or any subse-
quent expansion to a structure, re-
gardless of size, shali require full
compliance of the dweliing unit with
the design guidelines.
3. General maintenance and upkeep
of a property shail continue to be
required regardless of the amount of
fioor area added to a structure. The
one-time exciusion noted above shali
not preciude the design review board,
pursuant to the design guidelines,
from requiring landscaping and other
improvements necessary to buffer or
mitigate development impacts associ-
ated with the expansion/remodel.
4. Expansions made pursuant to sec-
tion 12-15-5 of this title shail require
fuil compiiance of the entire dwelling
unit with the design guidelines. Interi-
or conversion additions pursuant to
section 12-15-4 of this title shail not
trigger the requirement for upgrading
sites and structures to fuily comply
with the design guidelines, unless it
can be classified as a"demo/rebuild",
pursuant to section 12-2-2 of this title.

b. Any application for an addition to

al has been received by an authorized
member of a condominium associa-

modify the existing vegetation or land-

In the above specified cases, the
administrator may review and approve
the application, approve the applica-
tion with certain modifications, deny

12-11-6: PARK DESIGN GUIDELINES:
A. Purpose: These guidelines shall be
used by the design review board in
reviewing any proposals for the devel-
opment of town park land. The guide-
lines shall be used in conjunction with
the general design review guidelines
found in title 14 of this code. It is the
intent of these guidelines to leave as
much design freedom as possible to
the individual designer while at the
same time encouraging park develop-
ment that wiii complement the natural
beauty of our park land. The purpose
of the guidelines is to provide continu-
ity in the character of the parks which
will be developed over many years.
The guidelines will provide consistent
design criteria to maintain the quality
of town parks through all phases of
development.
B. Building Materials And Design:

chainlink fences shall be allowed
except as temporary construction
fences or as required for recreational
facilities.
C. Setbacks Observed: All accessory
uses and structures except fences,
hedges, walls and landscaping, or
ground level site development such as
walks, driveways, and terraces shall
be located within the required mini-
mum setback lines on each site. Rec-
reational amenities may be exempted
by the design review board if it deter-
mines that their location is not detri-
mental environmentally and/or aes-
thetically,
D. Sight Triangle: To minimize traffic
hazards at street intersections by
improving visibility for drivers of con-
verging vehicles in any district where
setbacks are required, no fence or
structure over three feet (3') in height
shall be permitted within the triangular
portion of a corner lot measured from
the point of intersection of the lot lines
abutting the streets a distance of thirty

I believe you were in receipt of the September 30, 2005 letter from the Town of Vail to Mr. Jim Garland
outlining the development potential for Lot 27, Buffer Creek. I have attached a copy of that letter for your
reference.
Based upon our recent discussions, questions still remain as to how much square footage is available for
additions to your residence and Mr. Garland's residence. As you are aware, Lot 27 is 18,410 square feet
in size, thus allowing a total of 6,943 sq. ft. of GRFA (gross residential floor area) between the two units.
You have indicated that your residence is the "secondary" unit and is therefore restricted to no more than
40% of the allowable GRFA (2,777 sq. ft.).
Please keep in mind that GRFA is not the same "square footage" calculation used by realtors, the county
assessor, etc. For example, both you and Mr. Garland may construct a garage of up to 600 sq. ft. that
may be deducted from the GRFA calculations. Additionally, if you choose to proceed with the
construction of a Type I EHU (employee housing unit) you may also deduct up to 550 sq. ft. of floor area
for that unit and up to an additional 300 sq. ft. if an EHU garage is constructed. The GRFA calculations
for both your residences will also include a basement deduction tiased upon the proportion of how much
of the lowest level of your home is located below-grade.
Viele Construction prepared a preliminary analysis of the existing GRFA for your residence and Mr.
Garland's residence. Based upon that analysis, the following is a brief summary of your remaining

Dear Resident,
It has come to the attention of the Town that the historic irrigation ditch, which runs from north to south thru
��,otis=.28, 22;;23; 24; �5;.26, 27,.3f, 40,::39 o��th�Buffehr Creek�subdivision (see attached map), does not
currently have water rights for any type of use; irrigatiori�or aesthetic. In addition, the diversion for this historic
irrigation ditch is on publicly owned property and has recently been altered to divert more flow from Buffehr
Creek into the historic irrigation ditch.
The Town is concerned about the long term health of Buffehr Creek and the lack of water rights. during the low
flow months, July thru April. In our conversations with the Colorado Division of Water Resources it is
apparent that this historic irrigation ditch has no current water rights and is required to abide by state law. At a
minimum, this will require all flows to remain in Buffehr Creek during periods when there is a call on the river
typically from July thru April.
It is the Town's intent to remove the diversion and return the creek back to its natural state. This will generally
limit flow to the ditch to high flow periods (May and June).

Project Description
The project consists of the remodeling of the existing living spaces on two levels, re-building of
a two car garage with one level above consisting of a kitchen, dining area, an office and dedc
space. The existing exterior stair will be deleted and an interior stair is proposed to connect
the two levels. The lower level living areas will remain intact with the exception of the internal
stair and new entry. Miscellaneous revisions to exterior doors and windows. The total existing
plus additional square footage shall be consistent with and as allowed for a secondary unit
within the Town of Vail Zoning Ordinance for primary/secondary residential zone districts.

Dear Mr. Aker,
The Town of Vail Staff has reviewed the Design Review application for the proposed remodel and
addition to the existing west (secondary) half of the duplex, located at 1995 Chamonix Lane. The
following is a summary of the comments from that review:
1. On the site plan:
� Please label the scale correctly
� Please clearly label the section of driveway to be removed and state landscaping
proposed to replace pavement.
� Please label if the driveway is to be heated and delineate snow storage area. If heated
please indicate the location of the boiler.
� Please state intent of existing retaining wall, adjacent to drive, to remain or be replaced.
Also label height of retaining wall, if replaced.
� Vail Town Code requires the above ground power lines be buried. Therefore, as part of
the remodel, the owner must bury that portion of the above ground power lines that run
from the house to the utility pole. Please show and label that section of power line as 'to
be buried.'
,,r The existing metal shed on the property is non-conforming. Therefore, as part of the
remodel, it shall be removed from the property. Please label the shed as 'to be removed.'
f To determine height, please label all proposed roof ridge lines with proposed ridge
elevations. Indicate existing (natural grade prior to construction of structure) grade
shown underneath all roof lines.
� A 4 ft concrete pan is required at the end of the proposed driveway.
� To maintain the required site distance along Chamonix Lane, the large coniferous tree
near the driveway entrance must be trimmed so that no tree limbs are present from the
� ground up 7 feet. Please label the tree and trim distance on the plan.

As you requested, this letter is intended to respond to your letter
to me dated July 15, 1995, regarding the issues discussed during
our meeting with Tom Moorhead on July 12, 1995.
Primarv/Secondarv Desicrnation - The "250" ordinance allows a
property owner to apply to the Town to add up to 250 square feet of
gross residential floor area (GRFA) to a property, above and beyond
the maximum allowed, provided certain conditions are met. One of
the conditions is that the property has already utilized all of its
available GRFA. In order to verify that there is no GRFA available
on the Primary/Secondary zoned lot owner by Mr. Garland and
yourself, "as-built" drawings of the residences will be provided by
Mr. Garland's architect. If these drawings confirm that no GRFA is
available on the lot, it will not be necessary to designate which
unit is the primary and which is the secondary. However, if there
is GRFA remaining to be utilized on the site the primary/secondary
designation will be required.
Future 250 application for vour side - Assuming that you have not
received a 250 approval previously, and you can meet the criteria
for a 250 approval the 250 would be avilable for your side.
Walk-throuah of vour side - The purpose of the walk-through is to
verify the accuracy of the "as-built'� drawings provided by Mr.
Garlands' architect, which are intended to document that no GRFA if
left on the property. Obviously, if I discover code violations in
your unit during my walk-through I will have to act upon them.
The leQal non-conformincr status of vour auartment - I have checked
our annexation maps and confirmed that your property, and
surrounding neighborhood, was annexed into the Town of Vail in
December, 1980. Therefore, your statement from Mr. Dennis Shay

would appear to indicate that the apartment was in existance before
it was annexed into the Town and would be considered legal non-
conforming.

Dear Rod Hall Company/Colorado Comfort,
Enclosed is a check in the amount of $29.00 for a refund of the permit fees you
paid for permit M08-0277. This permit was for the conversion of a wood fireplace
to gas, and per Title 5-3-8 of our Town Code (Ordinance 21, 1991), all permit
fees for wood to gas conversions are waived.
We apologize for our error originally charging for this permit, and have taken
steps to ensure this error doesn't happen again, by training staff, including a note
about the waived fees on our fee schedule, and updating our mechanical permit
application form.
