July 18, 2018 – 7 PM - SPECIAL MEETING OF THE BOARD OF DIRECTORS
Special Meeting Minutes
Attendees: Kirk Hansen, John Oenick, Nino Licciardi, Dan Heim, Suzi Gartner (Proxy is Nino Licciardi), Steven Goldstein
Motions: By Kirk Hansen and 2nd by John Oenick
Background:
Being that the decks (front, side and back decks) are limited common elements of our Association, those decks are the responsibility of the Association to maintain. To-date, 23 front
decks and 11 back/side decks have been either rebuilt or updated - do to normal wear and tear or damage due to ice/snow falls. None of the Association’s 46 decks – except the side deck
in Unit 1 - has been designed to support a large weight, like the weight of a hot tub with people and added potential snow load.
Motion Passed:
To approve the demolition and rebuilding of the Unit 15 deck per the plans outlined by KRM Engineering.
Vote: 5-0 in favor of the motion.

If a Falls at Vail Townhouse Association unit owner has a deck that needs to be replaced for structural reasons, and the Unit Owner wishes to have that deck built to a higher structural
standard, the Association will get at least two bids to replace that deck to the current Association building standard. The Association will make a payment to that Owner the lower
of the two bids for the basic, as-built deck rebuild. The payment schedule can be worked out between the Association and the Owner.
If a Falls at Vail Townhouse Association unit owner with a failed deck would like to upgrade that deck to be able to support more weight, such as a hot tub, then that Owner will hire,
at that Owner’s cost, a Colorado license engineer to create a drawing and specification for that new deck. The Unit Owner is then responsible to find a Vail registered builder(s) to
provide bids and building services to build this enhanced deck. The cost of these services will be entirely the responsibility of that Unit Owner. The Association will need to see
the builder’s license and insurance before that construction starts.
If a Falls at Vail Townhouse Association unit owner has an in-tact, structurally sound deck attached to their unit and that Owner would like to replace that deck with a stronger deck
to support a heavy weight such as a hot tub, then the Association takes no cost sharing responsibility to change out that deck. Under this scenario however the Unit Owner must make
application to the Association including plans and specifications as outlined in the governing documents of the Falls at Vail Association.
Note:
The Board requested an action of the Association President (Kirk Hansen) that a licensed structural engineer review our decks to report on any potential problems with design or construction.
