BUILDING PERMIT ISSUANCE TIME FRAME
If this permit requires a Town of Vail Fire Department Approval, Enginee/s (Public Works)
review and approval, a Planning Department review or Health Department review, and a review
by the Building Department the estimated time for a total review will take as long as three (3)
weeks.
All commercial (large or small) and all multi-family permits will have to follow the above
mentioned maximum requirements. Residential and small projects should take a lesser amount
of time. However, if residential or smaller projects impact the various above mentioned
departments with regard to necessary review, these projece may also take three (3) weeks to
review and approve.
Every attempt will be made by this depaftment to expedite this permit as soon as possible.
I, the undersigned, understand the plan check procedure and time ftame. I also understand
that if the permit is not picked up by the expiration date, that I must still pay the plan check fee
and that if I fail to do so it may afFect future permits that I apply for.

PUBLIC WORKS AND THE PUBLIC WAY PERMIT PROCESS
How it relates to Building Permits:
Fill out the attached check list with the Building Permit Application.
If yes was answered to any of the questions then a "Public Way" permit is required. You
can pick up an application at either Community Development, located at 75 South Frontage
Road or Public Works, located at 1309 Elkhorn Drive.
Notice sign-offs for utility companies. ALL utilities must field verify (locate) respective
utilities prior to signing application. Some utility companies require up to 48 hours notice to
schedule a locate.
A construction traffic control/staging plan must be prepared on a separate sheet of paper.
An approved site plan may also be used. This plan will show locations of all traffic control
devices (signs, cones, etc.) and the work zone, (area of construction, staging, etc.). This
plan will expire on November lst and will need to be resubmitted for consideration for
approval through the winter. Be aware that your resubmission for winter may be denied
depending on the location of construction.
Sketch of work being performed must be submitted indicating dimensions (length, width
and depth of work). This may be drawn on the traffic control plan or a site plan for the job.
Submit completed application to the Public Work's office for review. If required, locates will
be scheduled for the Town of Vail electricians and irrigation crew. The locates take place in
the morning, but may require up to 48 hours to peform.
The Public Work's Construction Inspector will review the application and approve or deny
the permit. You will be contacted as to the status and any requirements that may be
needed. Most permits are released within 48 hours of being received, but please allow up
to one (1) week to process.
As soon as the permit is approved, the Building Depaftment will be notified, allowing the
"Building Permit" to be released. Please do not confuse the "Public Way Permit" with a
"Building Permit".
Permits are valid only until November 15th. A new Public Way Permit is requircd
each year if work is not complete. Re-application each November 15th does not
mean an automatic renewal.

/ fne Town of Vail Building Department has developed the following procedures to
ensure that new construction sites have adequately established proper drainage
from building sites along and adjacent to Town of Vail roads or streets.
{tne Town of Vail Public Works Depaftment will be required to inspect and approve
drainage adjacent to Town of Vail roads or streets and the installation of temporary
or permanent culverts at access points from the road or street onto the construction
site. Such approval must be obtained prior to any requests for inspection by the
Town of Vail Building Depaftment for footings, temporary elecirical or any other
inspection. Please call Leonard Sandoval at479-2198 to request an inspection from
the Public Works Depaftment. Allow a minimum of 24 hour notice.
J Nso, the Town of Vail Public Works Department will be approving all final drainage
and culvert installation with resulting road patching as necessary. Such approval
must be obtained prior to any Final Certificate of Occupancv issuance.

gther debris or material upon any street, sidewalk, alley or public place, or any portion thereof.

causes another to violate the provision of subsection A hereof, or who has in the Director's employment
a person who violates or causes another to violate the same, top remove such sand, gravel, rock, mud,
dirt, snow, ice or any other debris or material wlthin twenty four (24) hours after receipt of said no6ce
by the Director of Public Works. In the event the person so notified does not comply with the notice
within the period of time herein specified, the Director of Public Works, or other authorized agent, may
cause any such sand, gravel, rocks, mud, dirt, snow, ice, debris or any other material to be removed
jrom any street or alley at the expense of the notified.
d Summons and Penalty: As an alternative to the notice for removal provided in subsection B above,
any person who violates or causes another to violate the same, may be issued a summons to appear
before the Municipal Court of the Town for said violations, and upon being found guilty of a violation
hereunder be punished as provided in Section 14-1 of this code.
d NoUce and Penalty: It is unlawful for any person to fail or refuse to comply with the notice of the
Director of Public Works as provided in subsection B hereof, and any such person shall, in addition to
payment of the expense of removal incurred by the Director of Public Works, as provided in subsection B
hereof, upon being found guilty of a violation hereunder, be punishable as provided in Section L-4-L of
this Code. (1997 Code: Ordinance 5 (1979).
CODES 7.3A.1 AND 7.3A.3: PARKING OBSTRUCTING TRAFFIC & IMPOUNDMENT AUTHORIZED
d No person shall park any vehicle upon a street or at any other place within this Municipality in such a
manner or under such conditions as to interfere with the free movement of vehicular traffic or proper
street or highway maintenance. (Ord. 2(1968) g 1)
{ Whenever any police officer finds a vehicle attended or unattended, standing upon any portion of a
street or upon any place within this Municipality in such a manner as to consutute a violation of any
section of this Article, or left unattended for a period of twenty four (24) hours or more and presumed to
be abandoned under the conditions prescribed by Colorado Revised Statutes section 424-1102, as
amended, the officer shall require the vehicle to be removed or ciruse it to be removed and placed in
storage in the nearest garage or other place of safety designated or maintained by this Municipality, and
the charges for towing and storage of such vehicle shall be charged to the owner of the vehicle in
addiUon to a ten dollar ($10) impoundment charge. (Ord. 2(1968) g 3: Ord. 28(1981) 5 1)

If this permit requires a Town of Vail Fire Department Approval, Engineer's (Public Works)
review and approval, a Planning Department review or Health Department review, and a review
by the Building Department, the estimated time for a total review will take as long as three (3)
weeks.
All commercial (large or small) and all multi-family permits will have to follow the above
mentioned maximum requirements. Residential and small projects should take a lesser amount
of time. However, if residential or smaller projects impact the various above mentioned
departments with regard to necessary review, these projects may also take three (3) weeks to
review and approve.
Every attempt will be made by this department to expedite this permit as soon as possible.

PUBLIC WORKS AND THE PUBLIC WAY PERMIT PROCESS
How it relates to Building Permits:
Fill out the attached check list with the Building Permit Aoolication.
If yes was answered to any of the questions then a "Public Way" permit is required. You
can pick up an application at either Community Development, located at 75 South Frontage
Road or Public Works, located at 1309 Elkhorn Drive.
Notice sign-offs for utility companies. ALL utilities must field verifo (locate) respective
utilities prior to signing application. Some utility companies require up to 48 hours notice to
schedule a locate.
A construction traffic control/staging plan must be prepared on a separate sheet of paper.
An approved site plan may also be used. This plan will show locations of all traffic control
devices (signs, cones, etc.) and the work zone, (area of construction, staging, etc.). This
plan will expire on November 1st and will need to be resubmitted for consideration for
approval through the winter. Be aware that your resubmission for winter may be denied
depending on the location of construction.
Sketch of work being performed must be submitted indicating dimensions (length, width
and depth of work). This maybe drawn on thetrafftccontrol plan ora site plan for.the job.
Submit completed application to the Public Work's office for review. If required, locates will
be scheduled for the Town of Vail electricians and irrigation crew. The locates take place in
the morning, but may require up to 48 hours to perform.
The Public Work's Construction Inspector will review the application and approve or deny
the permit. You will be contacted as to the status and any requirements that may be
needed. Most permits are released within 48 hours of being received, but please allow up
to one (1) week to process.
As soon as the permit is approved, the Building Department will be notified, allowing the
"Building Permif'to be released. Please do not confuse the "Public Way Permit" with a
"Building Permif'.
NOTE: The above pnocess is for work in a public way ONLY. Public Way
Permits are valid only until November 15th. A new Public Way Permit is required
each year if work is not complete. Re-application each November 15th does not
mean an automatic renewal.

DRAINAGE AND CULVERT INSPECTIONS ARE REOUIRED BY PUBLIC WORKS!

o The Town of Vail Building Department has developed the following procedures to
ensure that new construction sites have adequately established proper drainage
from building sites along and adjacent to Town of Vail roads or streets.
a The Town of Vail Public Works Depaftment will be required to inspect and approve
drainage adjacent to Town of Vail roads or streets and the installation of temporary
or permanent culverts at access points from the road or street onto the construction
site. Such approval must be obtained prior to any requests for inspection by the
Town of Vail Building Depaftment for footings, temporary electrical or any other
inspection. Please call Leonard Sandoval at479-2798 to request an inspection from
the Public Works Depaftment. Allow a minimum of 24 hour notice.
o Also, the Town of Vail Public Works Depaftment will be approving all final drainage
and culvert installation with resulting road patching as necessary. Such approval
must be obtained prior to any Final Ceftificate of Occupancy issuance.

CODE s-2-1O: DEPOSITS ON PUBIJC WAYS PROHIBITED
a Unlawful deposits: Subject to subsection C thereof, it is unlawful for any person to litter, track or
deposit, or ctruse to be littered, tracked or deposited, sand, gravel, rocks, mud, dirt, snow, ice, or any
other debris or material upon any street, sidewalk, alley or public place, or any portion thereof.
B Notice; Abatement: The Director of Public Works may notify and require any person who violates or
causes another to violate the provision of subsection A hereof, or who has in the Director's employment
a percC,n who violates or causes another to violate the same, top remove such sand, gravel, rocks, mud,
diG snow, ice or any other debris or material within twenty four (24) hours after receipt of said notice
by the Director of Public Works. In the event the person so notified does not comply with the notice
within the period of time herein specified, the Director of Public Work, or other authorized agent, may
cause any such sand, gravel, rocks, mud, dirt, snow, ice, debris or any other material to be removed
from any street or alley at the expense of the notified.
o Summons and Penalty: As an alternative to the notice for removal provided in subsection B above,
any person who violates or causes another to violate the same, may be issued a summons to appear
before the Municipal Court of the Town for said violations, and upon being found guilty of a violation
hereunder be punished as provided in Section 14-1 of this code.
o Notice and Penalty: It is unlawful for any person to fail or refuse to comply with the notice of the
Director of Public Works as provided in subsection B hereof, and any such person shall, in addition to
payment of the expense of removal incurred by the Director of Public Works, as provided in subsection B
hereof, upon being found guilty of a violation hereunder, be punishable as provided in Section 14-1 of
this Code. (1997 Code: Ordinance 5 (1979).

o No person shall park any vehicle upon a street or at any other place within this Municipality in such a
manner or under such conditions as to interfere with the free movement of vehicular traffic or proper

o Whenever any police officer finds a vehicle attended or unattended, sbnding upon any portion of a
street or upon any place within this Municipality in such a manner as to constitute a violation of any
section of this Article, or left unattended for a period of twenty four (24) hours or more and presumed to
be abandoned under the conditions prescribed by Colorado Revised Statutes section 42-4-1102, as
amended, the officer shall require the vehicle to be removed or cause it to be removed and placed in
storage in the nearest garage or other place of safety designated or maintained by this Municipality, and
the charges for towing and storage of such vehicle shall be charged to the owner of the vehicle in

I.O INTRODUCTION
Family Environmental conducted an ashtos survey of the occupied building located at 1436 W Haven Dr,
Unit #9, Coldstream Condominiums, Vail, Colorado. The survey was conducted on April 2, 2001, by an
accredited Building Inspector per the verbal authorization in the telephone conversation with Mr. Sam Rolf
of Family Environmental and Mr. Ken Howards of J. L. Viele Assoc, Inc. on March 29,2001. Interior
building components were surveyed and homogeneous areas of suspect asbstos-containing materials
(ACM) were visually identified and documented. Although r€asonable effort was made to survey
accessible suspect materials, additional suspect but unsampled materials could be located in walls, in voids
or in other concealed areas. Suspect ACM was sampled in general conformance with the sampling
protocols outlined in EPA regulation 40 CFR 763.86 (Asbestos Hazard Emergency Response Act,
AHERA). Sample were delivered to an accredited laboratory for analysis by polarized light microscopy.
IJ Prcjet Objective
We understand this asbestos survey wns requested because of the planned remodeVrenovation of the
building unit. EPA regulation 40 CFR 61, National Emission Standards for Hazardous Air Pollutants
(NESHAP), prohibits the release of asbestos fibers to the atmosphere during renovation or demolition
activities. The asbestos NESHAP requires that potentially regulated asbestos-containing building materials
be identified, classified and quantified prior to planned disturbances or demolition activities.
2.O BuiniryDescriptions
The building is a four-story wood frame structure atop a poured concrete foundation and finished
basement. Wood fascia exterior walls cover the sides of the building. The interior consisted of finished
drywall, wood paneling textured walls and ceilings, floor tile, ceramio floor tilg sheet vinyl flooring and
carpeting. The concrete floor in the garage arst wzrs futished. No insulation was observed above finished
ceiling areas. Heating and cooling ventilation ducting was observed to be sheet metal ducting insulated
with fiboglass. The roofing systern consists of an asphaltic shingle system over wood deck with tar-
impregnated roofrng paper, rooftar, felt, and rooftape. The fireplace unit appears to be a triple lined maal
insert unit. According to Mr. Ken Howards, the building was constructed in the 1970's.
3.0 ACMneU Activitics
The survey was conducted by Mr. Douglas K Shively, a trained and accredited Asbestos Building
Inspector. The suwey was conducted in general conformance with the sampling protocols established by
EPA regulation 40 CFR 763.86, the Asbestos Hazard Emergency Response Act (AHERA). A summary of
survey activities is provided below.
3.1 Visuol Ass*snpnt
No blueprints, floor plans or other building documentation were provided to Family Environmental
preceding the survey. Our survey activities therefore began with visual observation of the interior and
exterior ofthe building to identifu homogeneous areas ofsuspect ACM. A homogeneous area consists of
building materials which appear similar throughout in terms of color, texture and date of application.
Interior assessment was conducted in the offrce area, common areas, work areas, closet, utility areas and
warehouse area. The exterior survey included visual observation of the roof, siding and doorways.
Building materials which were not identified as concrete, glass, wood, masonry, metal or rubber were
considered suspect ACM.
3.2 Physical Assasnunt
A physical assessme,nt of each homogeneous area of suspect ACM was conducted to assess the condition of
the material as friable or non-friable. The EPA defrres a friable material as one whiclq when dry, can be
crumbled pulvoized or reduced to powder by hand pressrue. Friability was assessed by physically
touching suspect materials.
3.3 Sanple Colleaion
Based on results of the visual observation, bulk samples of suspect ACM were collected in general
conformance with AHERA protocols. Random samples of suspect materials were collected in each
homogeneous area. Appropriately auired sample team members collected bulk samples using wet methods

labeled with unique sample numbers using an indelible marker.
Nine bulk samples were collected from the homogeneous areas of suspect ACM. Bulk samples were
collected from the ceiling (texturddrywalVjoint compound/tape), textured walls (drywalVjoint compound),
vinyl flooring and mastic. Samples of roof tar, roofing felt, roof tape and roofing paper were not collected
from the building exterior, these materials are assumed non-friable ACM. Homogeneous areas of suspect
ACM identified and sampled during the survey are presented in Appendix A.
3,1 Asbestos Sanple Analysis
Bulk samples were submitted under chain of custody procedures to Resevoirs Environmsntal Services Inc.
of Denver, Colorado, for analysis by polarized light microscopy with dispersion staining techniques per
EPA methodolog (a0 CFR 763, Subpart F). Microscopical visual estimation was used in obtaining the
percentage of asbestos in bulk samples. Resevoirs Environmental Services Inc. is accredited under the
National Voluntary Laboratory Accreditation Program NVLAP (1896).
4.0 Regdrtory Overvk
The asbestos NESHAP (40 CFR Part 6l) regulates asbestos fiber emissions and asbestos waste disposal
practices. It also requires the ide,ntification and classification of existing building materials prior to
demolition or renovation activity. Under NESHAP, asbestos-containing building materials are classified as
either friable, Category I non-friable or Category II non-friable ACM. Friable materials are those that
when dry, may be crumbld pulverized or reduced to powder by hand pr€ssure. Category I non-friable

ACM includes packings, gaskets, resilient floor coverinp and asphalt roofing products. Category II non-
friable ACM are any materials other than Category I materials that contain more than lolo asbestos.
Friable ACM and Category I and Category II non-friable ACM which is in poor condition and has become
friable or which will be subjected to drilling sanding grinding cutting or abrading and which could be
crushed or pulverized during anticipated renovation or demolition activities are considered regulated ACM
(RACM). RACM must be removed prior to renovation or demolition activities. lf the amount of RACM
exceeds 260 linear feet ofpipe insulation or more than 160 square feet in other building componants, the
owner or operator must provide the EPA" the State of Colorado Department of Public Health and
Environment, Air Pollution Control Division with written notification of planned removal activities at least
l0 working days prior to the commencernent of asbestos abatement activities. Removal of RACM must be
conducted by a trained and appropriately licensed asbestos abatement contractor.
The Occupational Safety and Health Administration (OSHA) Asbestos standard for the construction
industry (29 CFR l9l0.1l0l) regulates workplace exposure to asbestos. The OSHA standard requires
that employee exposure to airborne asbestos fib€rs be maintained below 0.1 asbestos fibers per cubic
centimeter of air (0.1 f/cc). The OSHA standard classifies construction and maintenance activities which
could disturb ACM, and specifies work practices and precautions which employers must follow when
engging in each class of regulated work.

Based on the results of laboratory analysis, the following materials are identifie.d as ACM:
r Sheet vinyl flooring and associated mastic used in the bathrooms and the hot water heater storage
room. The Sheet vinyl flooring (backing) was observed in good condition and is considered friable.
Sorne observed homogeneous suspect materials were not sampled during the survey because they
would require excessive destructive sampling techniques, or they were not reasonably accessible
by restricted €rccess. These materials are assumed to be ACM. These homogeneous areas and
materials are:
. Tar impregnated roofing rraterials. The roofing materials were observed in good condition and are
considered non-friable.
The roof materials were not sampled within this scope of work, because it is not included in the AHERA
criteria snd because it would require destructive sampling techniques. The asphalt and tar impregrated
roofing materials are assumed to be ACM.
o According to the Colorado Regulation 8, Control of Hazardous Air Pollutants, Section III, Part 3,
Paragraph C(i) Roofing Materials:
"Tar impregnated roofing felts, asphalt tiles, asphalts and mastics that are non-friable and will
remain non-friable during abatement ile o(empt from this regulation.n
According to the Colorado Department of Public Health and Environment, Air Pollution Control Division,

Additionally, the building debris need not be disposed as asbestos-containing waste material, as long as the
ACM remains non-friable. However, the landfill receiving the asbestos+ontaining roofing materials must
be notified ofthe asbestos content.
According to the State ofColorado regulatory information, ACM roofing components do not need to be
removed as part of the asbestos abatement plan prior to demolition/renovation of the building. However the
demolition ofthe building cannot include explosives, sawing (rotary or reciprocating), grinding abrading
blasting or intentional burning that will render the materials friable.
Recommendations:
Family Environmental recommends the abatenrent (removal) of the friable ACM sheet vinyl prior to
conducting any renovation or selective demolition activities. The friable ACM shoet vinyl must be removed
for

- tr a licensed asbestos abaternfit contractor.
Based on the provided information and site observations, at a minimum, Family Environmental
recommends that any employee's and any sub-contractor's ernployees who perform flooring ovetlay
activities that disturb ACM flooring materials during remodeVrenovations activities successfully complete
an 8-hour training course which meets the training requirements for flooring workers, set fourth in
Colorado Regulations No. 8, The Control of Hazardous Air Pollutants, Appendix C (Training Course
Outline).
A summary of the classificatiorq condition and approximate quantity of identified ACM are presented in
Appendix B and the laboratory analytical r€ports are included in Appendix C.
6.0 Generel Comrenb
This asbestos surye,y w{ur conducted in a manner consistent with the lwel of care and skill ordinarily
exercised by mernbers of the profession currently practicing under similar conditions in the same locale.
The results, firdings, conclusions and recommendations expressed in this report are based on conditions
observed during our survsy of the building. The information contained in this report is relevant to the date
on which this survey was performed, and should not be relied upon to represent conditions at a later date.
This report has been prepared on betralf of and exclusively for use by
specific application to their project as discussed. This report is not a bidding document. Contractors or
consultants rwiewing this report must draw their own conclusions regarding further investigation or
