r All new construction within the Town of Vail is considered to be of unusually tight oonstruction,
thus all combustion air is rcquired to be drawn from outside the structure for mechanical
equipment.
Town of Vail Fireplace Ordinance
In September of 199! the Vail Town Councit adopted an ordinance which restricts te construction and
use of open hearth fircplaces witfiin municipal boundaries. Since that time the ordinance has
undelgone numeKrus changes and revisions, striving for compromise, yet effectiveness in addressing
the air quality issue. Therefore the following criteria has been adopted:
r Construction of open hearth wood burning fireplaces is no longer permitted within Town of Vail
municipal boundaries.
o Dweltino Units - Each new dwelting unit may contain:
One (f ) epA Phase II certified solid fuel burning devke and no more than two (2) gas appliances
(B vent)
OR
Two (2) gas log fireplaces and no more than tuto (2) gas appliance fireplaces (B bent).
o Restricted Dwellino Units - Each nerv rcstricted dwelling unit may contain:
One (1) gas log fircplace and not more than one (1) gas appliance fireplace.
r Accommodation Units - Each new acoommodation unit may contain:
One (1) gas log fireplace or one (1) gas appliance fireplace.

r If two or mor€ separate dwelling units or accommodation units arc combined to form one 53ei
unig the combined unit may rctain one woodburning fireplace (if one already exists) and nolfiorc
than 2 gas appliance fireplaces, or may conveft up to two existing fireplaces to gas.
o If during the course of a remodel iin existing woodburning fireplace is altered or moved, the unit
must then comply with all provisions of the oldinance. That is, the fireplace must be conveiled to
natural gas or replaced by an EPA Phase II ceftified uniL

PUBLIC WORKS AND THE PUBLIC WAY PERMIT PROCESg
How it relates to Building Permits:
Fill out the attached check list with the Building Permit Application.
lf yes was answered to any of the questions then a "Public Way" permit is required. You
can pick up an application at either Community Development, located at 75 South Frontage
Road or Public Works, located at 1309 Elkhom Drive.
Notice sign-offs for utility companies. ALL utilities must field verify (locate) respective
utilities prior to signing application. Some utility companies require up to 48 hours notice to
schedule a locale.
A construction traffic control/staging plan must be prepared on a sepaEte sheet of paper.
An approved site plan may also be used. This plan will show locations of all traffic control
devices (signs, cones, etc.) and the work zone, (area of construction, staging, etc.). This
plan will expire on November 1st and will need to be resubmitted for consideration for
approval through lhe winter. Be aware lhat your resubmission for winter may be denied
depending on the location of construc{ion.
Sketch of work being performed must be submitted indicating dimensions (length, width
and depth of work). This may be drawn on the traffic control plan or a site plan for the job.
Submit completed application to the Public Work's office for review. lf required, locate will
be scheduled for the Town of Vail electricians and irrigation crew. The locates take plaoe in
the morning, but may require up to 48 hours to perform.
The Public Work's Construction Inspector will review the application and approve or deny
the permit. You will be contacted as to the status and any requirements that may be
needed. Most permits are released within 48 hours of being received, but please allow up
to one (1 ) week to prooess.
As soon as the permit is approved, the Building Department will be notified, allowing the
"Building Permit' to be released. Please do not confuse the 'Public Way Permit" with a
'Building Permit'.
NOTE: The above prooess is for work in a public way ONLY. Public Way
Permits are valid only until November 15th. A new Public Way Permit is required
each year if work is not complete. Re-application each November 1Sih does not
mean an automatic renewal.

other debris or malerial upon any street, sidewalk, alley or public place, or any portion thereof.
o Notice; Abatement: The Director of Public Works may notify and require any person who violates or
causes another to violate the provision of subsection A hereof, or who has in the Directot's employment
a person who violates or causes another to violate the same, top remove such sand, gravel, rocks, mud,
dirt, snow, ice or any other debris or material within twenty four (24) hours after receipt of said notice
by the Director of Public Works. In the event the person so notified does not comply with the notice
within the period of time herein specified, the Director of Public Works, or other authorized agent, may
cause any such sand, gravel, rocks, mud, dirt, snow, ice, debris or any other material to be removed
from any street or alley at the expense of the notified

INTRODUCTION:
On April Tth, 2005, an inspection/survey was conducted and 3 bulk
samples were collected from the:
Residence
1054 Homestake Road
Vail, CO. 81657
The purpose of the inspection/survey was to locate and sample
suspected asbestos containing materials that might be present in the area of
the house that is planned for renovation.
The inspection was made, and the samples were collected by John R.
Peterman, an A.H.E.R.A. and State of Colorado Certified Asbestos
Inspector. Great care was taken during the inspection and sampling to be as
accurate as possible. It should be noted that minimal damage was done to
the existing building structures during the inspection so there is no
documentation for unseen conditions or stored items.
All samples were analyzed by DCM Science Lab in Wheatridge, CO.
This laboratory is deemed "Proficient" in the E.P.A.Quality Assurance (QA)
program for the determination of asbestos in bulk materials, and is
accredited by the American Hygiene Association (AHA).
SAMPLING PROTOCOL:
A random sampling scheme was used to sample the suspect materials that
were discovered. If during any future demolition or renovation work,
suspect material is discovered that hasn't been sampled and would be
disturbed. work should be halted until the material has been tested.

UNIT DESCRIPTION:
1054 Homestake Road is planned for partial interior renovation. The
renovation impacts on the master bedroom, lower bedroom, and the garage.
The interior walls are covered in sheetrock with no texture. The ceilings are
sheetrock like the walls, and the floors are covered with carpet, ceramic tiles,
and bare concrete.
CONCLUSIONS AND RECOMMENDATIONS:
I-aboratory analysis of the bulk samples indicate that Asbestos was detected
in two out of the three composite sheetrock samples. However, the Asbestos
content is less than the Regulatory Limit (Greater than 77o Asbestos). The
Asbestos content of the positive sample was verified by the required point
count analysis. The O.S.H.A. regulations that require the protection of
workers from airborne Asbeslos frbers still apply. The removal of the
sheetrock should be done by wet facility component removal methods.

Bulk sanples are prepared br analysis using a 10X-80X sbreo microscop€ in a hepa filter hood which provirles

When the sample consisb of more than one layer, each hyer is prepared and analyzed separably. Fiber and
matrix mat€rials are identified by the characterization of optical properties including color and pleochrorism,
form, cleavage, reliel birefringence, ex0nction, orientation, twinning, inbrference figure and other distinguishing
featurgs. Dispersion staining is also used to furtrer aid in mineral identification. All percentages ol asbesbs,

Samples analyzed by he point count nrettrod arc milled to homogenize the samde, ptepared on microscope

PUBLIC WORKS PERMIT PROCESS
How it relates to Building Permits:
1) Fill out our check list provided with a buildino oermit aootication.
lf yes was answered to any of the above questions then a "public Way" is
required. You can pick up an application at either Community Development,
located at 75 S. Frontage Road or Public Works, located at 1309 Vail Valley Drive.
2) Notice sign offs for utility companies. All utilities must field verify (locate)
respective utilities prior to signing application, Some utility companies require up
to a 48 hour notice to schedule a locate.
A construction tratfic control/staging plan must be prepared on a separate sheet
of paper.An approved site plan may also be used. This plan will show locations
of all traffic control devices(signs, cones, etc..) and the work zone, (area of
Construction, Staging, etc..). This plan will expire on Oct. 1Sth. and will need to
be resubmitted for approval through the winter.
sketch of work being performed must be submitted indicating dimensions (length,
width & depth of work). This may be drawn on the traffic control plan or a site
plan for the job.
Submit completed application to the Public Works's office for review. lf required,
locates will be scheduled for the Town of Vail Electricians and lrrigation crew. The
locates take place in the morning but, may require up to 48 hours to perform.
The Public work's construction Inspector will review the application and approve
or disapprove the permit. You will be contacted as to the status and any that may
needed. Most permits are released within 48 hours of being received, but pleas6
allow up to one week to process.
As soon as the permit is processed, a copy will be faxed to Community
Development allowing the "Building Permif'to be released. Please do not confuse
the "Public way Permit" with a "Building Permit" to do work on a project itself.
NOTE:
* The above.process is for work in a public way only.* Public Way Permits are valid only until November 15th.'A new Public Way Permit is required each year if work is not complete.

NOTTCE TO CONTRACTORS/OTINER BUILDERS
Effective June 20, 1991, the Town of VaiI Building Department has
developed the following procedures to ensure that new constructionsites have adequately established proper drai-nage from buiJ-dingsites along and adjacent to Town of Vail roads or st.reets.
The Town of Vail Public Works Department will be reguired toinspect and approve drainage adjacent to Town of Vail roads orstreets and the instalLation of temporary or permanent culverts at
access points from the road or street on to the construction site.
Such approval must be obtained prior to any request for inspectionby the Town of vail Building Depart.ment for footings or temporaryelectrical or any other inspection. Please call 479-2L60 torequest an inspection from the Public Works Department. Al-Low a
minimum of 24 hour notice.
Also, the Town of Vait Public Works Department wiII be approvingall final drainage and culvert installation with resulting roadpacching as neceisary. Such approval must be obtained prlor to
Fj.na1 Certificate of Occupancy j_ssuance.
