To whom it may concern: On November 23, 2009 the Town of Vail Planning and Environmental Commission approved a Conditional Use Permit for a private parking lot located on the former BP/Amoco gas station site,with an expiration date of November 23, 2012 (PEC09-0032). On October 4th, 2012 the Town of Vail Community Development Department administratively approved a 3 year extension,granting approval to November 23, 2015. On November 6, 2015 the Town of Vail Community Development Department once again administratively approved another 3 year extension,granting approval to November 23, 2018(PEC 150031). These extension were granted unless the proposed EverVail project was submitted for building permits and was moving forward diligently towards the start of development and the lot is continuously used for parking. No building permits for EverVail have been submitted and the lot is continuously used for parking purposes. I believe there have also been conversations of making this a permanent Conditional Use Permit and after an initial 3 year period, 2 additional 3 year extensions and now an additional 3 year extension request perhaps we could revisit the idea. We have completed the Town of Vail Conditional Use Permit Application Form, provided adjacent property address and provided copies of our last extension request and subsequent approval. The conditional use permit was conditionally approved on October 22, 2012, with an expiration of November 23, 2015 unless building permits for Ever Vail project are obtained. As Ever Vail will not be moving forward by this deadline the applicant has requested an extension of the conditional use permit. Staff's approval includes the following conditions: 1. This conditional use permit shall expire on November23, 2018. 2. Applicant shall at all times abide by the Conditional Use Permits regulations, Chapter 16, Title 12 of the Vail Town Code. 3. Any conditional use which is discontinued for a period of twelve(12) months, regardless of any intent to resume operation, shall not be resumed thereafter; any future use of the site or structures thereon shall conform to the provisions of this title. The Town of Vail staff has determined that this amendment to the approved private parking lot conditional use permit meets the review criteria prescribed by Section 12-16-10, Amendment Procedures, Vail Town Code. This approval o f a conditional use permit amendment will be reported to the Town of Vail Planning and Environmental Commission at its Monday, November 23, 2015 public hearing at 1:00 p.m. in the Vail Town Council Chambers, located at 75 South Frontage Road West.
