A request for a final review of an amended final plat, pursuant to Chapter 13-
12, Exemption Plat Review Procedures, Vail Town Code, to allow for a
combination of two lots into a single lot, Lots 12 and 13, Bighorn Subdivision,
located at 4024 Willow Way and 4026 Lupine Drive, Bighorn Subdivision, and
setting forth details in regard thereto. (PEC06-0051)
Applicant Trudy ThomasPlanner: Wanen Campbell
SUMMARY
The applicant, Trudy Thomas, is requesting approval of an amended final plat,
pursuant to Chapter 13-12, Exemption Plat, Vail Town Gode, to allow for a
combination of two lots into a single lot, Lots 12 and 13, Bighorn Subdivision, located
at 4O24 Willow Way and 4O26 Lupine Drive, Bighorn Subdivision. Staff is
recommending approval of this application subject to the findings and conditions
outlined in Section lX of this memorandum.
DESCRIPTION OF REQUEST
The applicant, Trudy Thomas, currently has a single-family home constructed on Lot
13 and owns Lot 12, which is currently vacant and is adjacent. A vicinity map is
attached depicting the two lots (Attachment A). The applicant has proposed the
combination of these two lots as the existing structure on Lot 13 has a zero setback
from the shared property line of Lots 12 and 13 and a proposed dormer addition
would have required the granting of setback variances. The applicant has chosen to
combine the two lots in order to facilitate some minor additions the applicant has
applied to construct without the need for granting variances. The applicant has
proposed to combine these two parcels with the recording of an amended final plat
entitled Biqhorn Subdivision. Lot 13: A Resubdivision of Lots 12 and 13.
Bishorn Subdivision. A copy of the plat to be recorded is attached for reference
(Attachment B). The amended finalplat, if approved, would result in Lots 12 and 13
becoming Lot 13, measuring 36,577 square feet in size.
BACKGROUND
Lots 12 and 13 of the Bighorn Subdivision were annexed into the Town of Vail by
Ordinance 20, Series of 1974, which was effective November 5, 1974.
On October 27 , 1986, a variance was granted for the existing residence on Lot 1 3 for
a second story addition in the rear setback. The setback variance was granted as

the addition was located over a portion of the home which was already within the
setback.
ROLES OF REVIEWING BOARDS
Exemption Plat
Planning and Environmental Commission:
Action: The Planning and Environmental Commission is responsible for final
approval, approve with modifications, or disapprove the plat. Specifically the
code states in Section 13-12-3C. Review and Action on Plat:
The planning and environmental commission sha// review the plat and
assocrafed materials and shall approve, approve with modifications or
disapprove the plat within twenty one (21) days of the first public hearing on
the exemption plat application or the exemption plat application will be
deemed approved. A longer time period for rendering a decision may be
granted subject to mutual agreement between the planning and
environmental commission and the applicant. The criteria for reviewing the
plat shall be as contarned rn secfion 13-3-4 of this title.
Design Review Board:
Action: The Design Review Board has NO review authority on an exemption plat,
but must review any accompanying Design Review Board application.
Town Gouncil:
The Town Council is the appeals authority for an exemption plat review procedure in
accordance with Section 13-3-5C, Vail Town Code, which reads as follows:
Within ten (10) days the decision of the Planning and Environmental
Commission on the final plat shall be transmifted to the Council by the staff.
The Council may appeal the decision of the Planning and Environmental
Commission within seventeen (17) days of the Planning and Environmental
Commr'ssion's action. lf Council appeals the Planning and Environmental
Commissrbn's decision, the Council shall hear substantially the same' presentation by the applicant as was heard at the Planning and
Environmental Commission hearing(s). The Council shall have thirty (30)
days to affirm, reverse, or affirm with modifications the Planning and
Environmental Commission decision, and the Council shall conduct the
appeal at a regularly scheduled Council meeting.

13.12 EXEMPTION PLAT REVIEW PROCEDURES
13-12-1: PURPOSE AND INTENT:
The purpose of this chapter is to establish criteria and an appropriate review process
whereby the planning and environmenlal commission may grant exemptions from the
definition of the term "subdivision" for properties that are determined to fall outside
the purpose, purview and intent of chapters 3 and 4 of this title. This process is
intended to allow for the platting of property where no additional parcels are created
and conformance with applicable provisions of this code has been demonstrated.

13-12-2: EXEMPTIONS lN PROCEDURE AND SUBMITTALS:
"Exemption Plats", as defined in section 13-2-2 o'f this title, shall be exempt from
requirements related to preliminary plan procedures and submittals. Exemption plat
applicants may be required to submit an environmental impact report if required by
title 12, chaoter 1 2 of this code.
13-12-3: PLAT PROCEDURE AND CRITERIA FOR REVIEW:
The procedure for an exemption plat review shall be as follows:
A. Submission Of Proposal; Waiver Of Requirements: The applicant shall submit two
(2) copies of the proposal following the requirements for a final plat in subsection 13-
3-68 of this title, with the provision that certain of these requirements may be waivedby the administrator and/or the planning and environmental commission if
determined not applicable to the project.
B. Public Hearing: The administrator will schedule a public hearing before the
planning and environmental commission and follow notification requirements for
adjacent property owners and public notice for the hearing as found in subsection
13-3-681 of this title.
C. Review And Action On Plat: The planning and environmental commission shall
review the plat and associated materials and shall approve, approve with
modifications or disapprove the plat within twenty one (21) days of the first public
hearing on the exemption plat application or the exemption plat application will be
deemed approved. A longer time period for rendering a decision may be granted
subject to mutual agreement between the planning and environmental commission
and the applicant. The criteria for reviewing the plat shall be as contained in section
13-3-4 of this title.

VIII. CRITERIAANDFINDINGS
Exemption Plat (Defers to Section 13-3-4. which is as follows):
The following are the requirements of Section 13-3-4, Commission Review of
Application; Criteria and Necessary Findings, Vail Town Code, for the review of an
Exemption Plat.
"The Planning and Environmental Commission shall conduct a public hearing
on an application for a Preliminary PIan fw SubdtVtsion. The Planning and
Environmental Commission shall consider the application, relevant additional
materials, Staff report and recommendations as well as any other comments
or public information given at the hearing. The Planning and Environmental
Commission rnay discuss advisable changes to the proposed subdivision with
the applicant. The burden of proof shall rest with the applicant to show that

the application is in compliance with the intent and purposes of this Chapter,
the Zoninq Ordinance and other pertinent reoulations that the Plannino and
Environmental Commission deems applicable. Due consideration shall be
given to the recommendations made by public agencies, utility companies
and other agencies consu/fed under subsection 13-3-3C above."
Before recommending approval, approval with conditions or disapproval of the
Preliminary Plan, the Planning and Environmental Commission shall consider the
following criteria with respect to the proposed subdivision:
(1) The extent to which the proposed subdivision is consisfent with all
the applicable elements of the adopted goals, objectives and
policies outlined in the Vail Comprehensive Plan and is compatible
with the development objectives of the town; and
Staff has reviewed the individual documents comprising the Vail
Comprehensive Plan and found the Vail Land Use Plan to be the sole
document addressing this parcel/subdivision. The Vail Land Use Plan
identifies Lots 12 and 13 of the Bighorn Subdivision as being within the
Low Density Residential Land Use Designation which states the
following:
This category includes singleJamily detached homes and two
family dwelling units. Density of development within this category
would typically not exceed 3 sfrucfures per buildable acre. Also
within this area would be private recreation facilities such as
tennis courts, swimming pools and c/ub houses for the use of
resldents of the area. lnstitutionaUpubllc uses permifted would
include churches, fire stations, and parks and open space related
facilities.
Staff believes the proposed plat is in conformance with the Low Density
Residential Land Use Designation and therefore complies with this
criterion.
(2) The extent to which the proposd subdivision complies with all of
the standards of this Title, as well as, but not limited to, Title 12,
Zoning Regulations and other pertinent regulations that the
Planning and Environmental Commission deerns applicable; and
The proposed amended flnal plat complies with all the standards of Title
13 in regards to format. Staff further believes that the proposed
exemption plat complies with all the standards found in Title 12, Zoning
Regulations, Vail Town Code. The following are portions of Section
Chapter 12-1-2, Purpose, Vail Town Code, which staff believes apply to
this application:
A. General: These regulations are enacted for the purpose of of
promoting the health, safety, morals, and general welfare of the
Town, and to promote the coordinated and harmonious
development of the Town in a manner that will conserue and
enhance its natural environment and its established character
as a resorf and residential community of high quality.

B. Specifically: These regulations are intended to achieve the
following more specific purposes;
6. To encourage a harmonious, convenient, workable
relationship among /and uses, consrcfenf with Municipal
dev elopm e nt objectlves.
11. To otherwise provide for the growth of an orderly and viable
community.
Staff believes that the proposed amended final plat complies with this
criterion.
The extent to which the proposed subdivision presenfs a
harmonious, convenient, workable relationship among adjacent
land uses consistentwith municipal development obiectives; and
Staff believes that the combination,of Lots 12 and 13 allows for the
continued development of "harmonious, convenient, workable
relationship among adjacent /and uses consisfent with municipal
development objectives." As can be seen in Section Vll of this
memorandum the combination of the two lots into one does not create a
lot within the subdivision which is out of character with others in the
subdivision. In addition, the combination of the two lots eliminates the
need for granting variances in the future for the existing structure as was
done in the past. The combinations of the lots as proposed would take a
non-conforming structure and make it conforming with the Zoning Code.
The extent of the effects on fhe future development of the
surrounding area; and
Staff believes that the proposed amended final plat will not have any
negative effect on the development of the surrounding area, and
therefore complies with this criterion.
The extent to which the proposed subdivision is located and
d*igned to avoid creating spatial pafterns that caise inefficienciesin the delivery of public seruices, or require duplication or
premature extension of public facilities, or result in a "leapfrog"
pattern of development; and
The proposed amended final plat will have no negative impact on the
items identified in the above criterion as the Lot 13 is currently platted
and services and facilities are in place.
The extent to which the utility lines are sized to serue the planned
ultimate population of the seruice area to avoid future land
disruption to upgrade under-slzed lines; and

The proposed amended final plat will have no negative impact on the
utility lines servicing Lot 13 as the lot is currently platted and adequate
utility lines services are in place.
(7) The extent to which the proposed subdivision provides for the
growth of an orderly viable community and serves fhe besf inferesfs
of the community as a whole; and
The proposed amended final plat does not create a lot which does not
already currently exist. Staff believes the application complies with this
criterion.
(8) The extent to which the proposed subdivision resulfs in adverse or
beneficial impacts on the natural environment, including, but not
Iimited to, water quality, air quality, noise, vegetation, riparian
corridors, hillsides and other desirable natural features; and
The proposed amended final plat, if approved, would not have any
negative effect on the items listed in the above criterion as the lot is
currently platted.
(9) Such other factors and criterta as the Commission and/orCouncil
deem applicable to the proposed subdivision.
STAFF RECOMMENDATION
The Community Development Department recommends that the Planning and
Environmental Commission approves the amended final plat entitled Biqhorn
Subdivision. Lot 13: A Resubdivision of Lots 12 and 13. Biqhorn Subdivision,
pursuant to Chapter 13-12, Exemption Plat, Vail Town Code, to allow for a
combination of two lots into a single lot, Lots 12 and 13, Bighorn Subdivision, located
at 4024 Willow Way and 4026 Lupine Drive, Bighorn Subdivision based upon the
criteria evaluated in this memorandum.
Should the Planning and Environmental Commission choose to approve this
amended final plat, the Community Development Department recommends the
Commission pass the following motion with the suggested condition:
The Planning and Environmental Commission approves the reguest for an amended
final plat to create fhe Biqhorn Subdivision. Lot 13: A Resubdivision of Lots 12
and 13. Biqhorn Subdivision pursuant to Chapter 13-12, Exemption Plat Review
Procedures, Vail Town Code, to allow for a combination of two lots into a single lot,
Lots 12 and 13, Bighorn Subdivision, located at 4024 Willow Way and 4026 Lupine
Drive, Bighorn Subdivision and sefting forth details in regard thereto.
Should the Planning and Environmental Commission choose to approve this
amended final plat, the Community Development Department recommends the
Commission makes the following findings:
(1) That the subdivision is in compliance with the criteria listed in
Subsection 13-3-44 of this Title.
(2) That the subdivision rs cons.stent with the adopted goals,
objectives and policies outlined in the Vail Comprehensive Plan
and compatible with the development objectives of the Town; and
(3) That the subdivision is compatible with and suitable to adjacent
uses appropriate for the surrounding areas; and
(4) That the subdivision promotes the health, safety, morals, and
general welfare of the Town and promotes the coordinated and
harmonious development of the'Town in an manner that
conseryes and enhances lls natural environment and its
esfab/lshed character as a resorf and residential community of the
highest qualitY.

The following letter is in regard to your request concernlng the status of a Holy Cross Energy
overhead power line situate within Lot l2 of the Bighorn Subdivision, Town of Vail, County of
Eagfe, State of Colorado -
The power pole in question was retired and removed by Holy Cross Energy under work order
number 17268. The as built sheets for thls particular project show a completion date of
November 7, 2001.
I understand that the Town of Vail is requiring 4 quit claim deed stating that the relinquishment
of an existing overhead utility easement is agreeable to Holy Cross Energy, prior to the
rerubdivislon of Lots 12 and 13. Since the overhead power line in question has been retired
and removed, Holy Cross Energy would agree to execute, upon examination, such a document
prepared by Eagle Valley Surveying, Inc.

DESCRIPTION OF VARIANCE REQUESTED
The appljcant wishes to add a second story to the existing single family
residence located on Lot 13, Bighorn Subdivision. The existing
residence currently encroaches wjthin the required rear setback a
distance of up to 5 feet from the near property line. Although the
encroachment is not increasjng above and beyond the exjsting situation,a setback variance is required in order to allow for this addition. The
required rear setback is 15 feet.
CRITERIA AND FINDINGS
upon review of Criteria and Findings. Section 18.61.060 of the Municipal
Code. the Department of Community Development recommends denial of the
requested variance based upon the following factors:
Consideration of Factors:
The relationship of the requested variance to other existing orpotential uses and structures in the vicinjty.
The requested encroachment into the rear setback presently exists with
the existing structure. The application is for the addition of a second
story on the existing structure. Encroachments due to the addition
should not substant'ially impact adjacent units or property above and
beyond the impact of the existing unit.
The degree to which relief from the stri ct or literal interpretation and
enforcement of a specified requlation is necessary to achieve
at and uniformitv of treatment nq sites in the vicinitv orto attain e ob.i ect i ves o t orant opr'rvl lege.
Staff feels that due to the siting of the existing residence, it would
not be a special privilege to grant the variance for encroachment into
the rear setback. The setback encroachment will not be any greater than
that which is existing on the site.

above mentioned criteria.

RELATED POLICIES IN VAIL'S COMMUNITY ACTION PLAN
Under the heading, "Community Design," statement Number 2 reads:
"Upgrading and remodel ing of structures and sjte improvements
should be encouraged."
The Community Development Department staff has long encouraged upgradingof existjng units and property within the Town of Vail. This has been
done traditional'ly as long as the zoning and varjance criteria could be
adequately addressed.

applicable to the site of the variance that do not apply generallyto other properties in the same zone.
The strict or literal interpretation and enforcement of thespecified regulation would deprive the applicant of privileges
enjoyed by the owners of other properties in the same district.

Amendment to the 1999 N.E.C. Town of Vail Ordinance 10-1-6.
Overhead services are not allowed in the Town of Vail,
Underground services have to be in conduit (PVC) from the transformer to the electric meter, main disconnect
switch and to the first electrical distribution circuit breaker panel.
The main disconnect switch shall be located next to the meter on the exterior wall of the structure easilv
accessible.
All underground conduits are required to be inspected before back-filling the trench.
In multi-family dwelling units, no electrical wiring or feeder cables shall pass from one unit to another. Common
walls and spaces are accepted.
NM Cable (Romex) is not allowed in commercial buildings or structures exceeding three (3) stories.
No use of aluminum wire smaller than size #8 will be permitted with the Town of Vail.
TOWN OF VAIL ELECTRICAL PERMIT GUIDELINES
All installations of exterior hot tubs or spa's require a DRB approval from planning. This application will
not be accepted without a copy of the DRB approval form attached (if applicable).
if this permit is for installation of an exterior hot tub or spa on a new elevated platform or deck over
30" above grade, you must also obtain a building permit.
If this permit is for installation of an exterior hot tub or spa on any existing deck or elevated platform,
a structural engineer must review the existing condition and verify that it will support the added
concentrated load. Please provide a copy of the structural engineers wet stamped letter or drawing
with this application.
