Frontage Road Vail, Colorado 81657 Re: Lodge at Lionshead Certificate of Occupancy I9 Thanks for your efforts to help us obtain a Certificate of Occupancy for the Lodge at Lionshead! To recap our discussions, on October 16, 2008 a meeting was held at the Lodge at Lionshead to review the as-built conditions of the sloping sidewalk access route from East Lionshead Circle to the lobby entrance. The meeting was requested to discuss the comment from the Town of Vail Senior Building Inspector, Greg Denckla, that the building was unable to receive a Certificate of Occupancy due the sloping sidewalk access route not meeting all the requirements of ANSI 117.1 -1998. The contention from both the Owner and Design Team is this sloping sidewalk access route was reviewed with the Town of Vail (Planning & Engineering Departments) prior to the design being submitted for permit. At the time of the meetings with the Town of Vail Planning & Engineering Departments it was understood that this sloping sidewalk access was not being designed to meet all the requirements of a ramp, as defined by ANSI 117.1- 1998. The reason it was being allowed a concession from all the requirements were due to a review and understanding of the existing conditions. Prior to this renovation and improvement project the only pedestrian access to the lobby from East Lionshead Circle was via the driveway, pedestrians and vehicles were not separated and the unheated driveway varied between a 12 -18% slope. The new design has separated the vehicles and pedestrians by providing a sidewalk, both the driveway and the sidewalk are heated and both the driveway and the sidewalk have been reduced to a 5- 7.6% slope. The floor elevation of the lobby is existing as is the elevation of East Lionshead Circle, and the Town of Vail Planning & Engineering dictated the location where the driveway was to intersect with East Lionshead Circle due to sightlines and existing easements and property lines. The permit drawings were submitted to the Town of Vail on December 19, 2006, revised and re- submitted on February 28, 2007, revised and re- submitted on March 26, 2007; the design for the driveway and sloping sidewalk access route was shown in the same configuration during all of these submissions and there was never a comment from the Town of Vail indicating any concern or questioning of the design. The design team assumed since this design was reviewed With Town of Vail Planning & Engineering prior to submitting drawings for permit and during all three permit submissions(revisions there were no comments or questions relating to the design of the sloping sidewalk access route that it was acceptable. During the inspections for the Temporary Certificate of Occupancy the only comment relating cp to the sloping sidewalk access route was that the single handrail, on the East side of the sidewalk (as shown on the permit drawings) had not yet been installed and was required to be installed prior to issuance of TCO. The contractor installed the single handrail on the East side of the sidewalk and the TCO for Phase II was issued on December 11, 2007. b.. • � During a Final Inspection, requested to allow issuance of the Certificate of Occupancy, on August 29, 2008 Greg Denckla added a handwritten comment to the inspection report stating that the sloping sidewalk access route from East Lionshead Circle to the lobby entrance is required to meet ANSI 117.1 -1998, including handrails on both sides of the sidewalk, landings at appropriate intervals and the sloping surface is not to exceed 5 %. After both the Owner and Architect were informed of this new comment and requirement a meeting was requested with the Town of Vail to review/discuss this comment. Webb Architects PC), Colleen Kaneda (Evans Chaffee Construction Group), Greg Chaffee (Evans Chaffee Construction Group), Ryan Burke (Evans Chaffee Construction Group) to review the as -built conditions and discuss the options available to the Owner and Design Team. A consensus was reached among everyone involved that the existing sloping sidewalk could remain but additional items were required to be installed. The existing sloping sidewalk is to be surveyed and where the slope is 5% or greater handrails are required to be installed on both sides of the sidewalk, on the edge adjacent to the driveway edge protection (per ANSI 117.1 -1998) is required, a sign is to be installed identifying the ramp as not an accessible route, and a letter is to be produced stating the reasons why the sloping sidewalk is not compliant as an accessible route (as defined by ANSI 117.1- 1998). If you agree with the above proposal as we discussed, Jeff Bailey will proceed with the remedial work based upon the drawings attached, and we will call for Final inspection after completion. i thank you for your attention to this matter and we look forward to your confirmation of this matter..
