Unit A Violation: Section 12-11-3 Design Approval Ruth Change Nadeau 312 Pearl Pkwy, #5205 San Antonio, TX 78215 Dear Ms. Chang-Nadeau, Your property located at 2625 Bald Mountain Road, Unit A, in the Town of Vail, Colorado, appears to be in violation of Vail Town Code Section 12-11-3 Design Approval, which prohibits construction within the Town limits without prior design approval from the Town of Vail Design Review Board. Specifically, it appears that a deck addition was constructed at the rear of your building without design review approval, and without a building permit. We have looked through the Town's property records and could find no approval from the Design Review Board, or a building permit, for the deck addition. We believe that the deck addition was performed within the past five (5) years. Failure to comply by obtaining a Design Review Board approval, and to construct any projects according to Town of Vail codes and approved plans, could result in a citation and summons to Municipal Court, which may result in criminal charges, a fine or both. Please contact this office as soon as possible so this issue can be resolved quickly. If you have evidence of any required permits or approvals please provide those records to me for review. However, if you do not have approval records, you will be required to obtain a Design Review Board approval for this work, and a building permit may also be required. Please understand that as a two-family residence (duplex), the approval of the Joint Property Owner (the owners of the other side of your duplex) is also required to submit your Design Review Board application.
