Sincerely, Alfred Blu ASB/dr attachment l Community Development Department TOWN OFVATI, ' NOTICE OF VIOLATION Date: May 1, 2018 Parcel #: 2101-122-27-001 Lot#: Village on Bighorn Creek, Filing 3, Lot F Address: 4250 Spruce Way Violation Section 12-11-3 Design Approval Alfred and Bonnie Blum 26 Glenmoor Drive Englewood, CO 80113 Dear Homeowner, The property located at 4250 Spruce Way (Village on Bighorn Creek, Filing 3, Lot F) in the Town of Vail, Colorado, appears to be in violation of Vail Town Code Section 12-11-3, Design Approval. The Vail Town Code prohibits removal of vegetation and site preparation, within the Town limits without prior design approval from the Town of Vail Design Review Board. Specifically, it appears that the owners or occupants of 4220, 4230, 4240, and 4250 Spruce Way have performed landscaping and stream work without a permit. We have reviewed the Town of Vail permits and property files, and have found no permit for this work. The dams created by the landscape work are leading to dramatic changes in reducing the water supply to the downstream pond owned by Bighorn Mutual Sanitation and Recreation Co. at 4205 Columbine Drive. On April 27, 2018 the location was visited by Town of Vail Community Development Department Staff, including the Planning and Environmental Divisions. However, if you have not obtained Design Review Board approval, a permit will be required. Failure to comply by obtaining a Design Review Board approval and to construct any projects according to Town of Vail codes and approved plans could result in a citation and summons to Municipal Court, which may result in criminal charges, a fine or both. However, we would prefer to help you come into compliance with the Town's regulations and to avoid further enforcement, if possible. Please contact this office as soon as possible so this issue can be resolved quickly, without further action being taken. I look forward to working with you to achieve compliance with the Town Code.
