Due to najor Leakage in the lowest level, we recomrnend thefollowing actions:
A) we have contacted the adjoining duplex owner, Terry Snridth at

B) We have contacted the Property Manager, Peter Cl.ark at

I. BACKGROUND AND DESCRIPnON OFTHE REQUEST
ln 1985, the VailTown Council approved Ordinance 4, Series of 1985, creating a new Chapter
18.71 - Additional Gross Residential Floor Area, to allow for an additional ZS0 square teet ot
Gross Residential Floor Area (GRFA) beyond the maximurn allowance for dwelling units located
within the Town of Vail; The purpose of the additional GRFA Ordinance is to provide an
inducement for the upgrading of existing dwellings units, which have been in existence for aperiod of at least five years, by permitting the addition ol up to two hundred tifty (250) square
leet.
In August 1 995, the Town Council's approval of Ordinance 6, Series of 1995, amended Chapter
18.71 . This ordinance eliminates the ability to use the additional GRFA when a dwelling unii is
"demo/rebuilt" and requires that all requests for additional GRFA that involve exterior changes to
a building be reviewed and approved by the planning and Environmental commission.
ln this proposal, the applicant is requesting to enclose a patio area located at the basement level.
The addition will be 89 square feet and will be used for additionat mechanical space. A ponion of \ r-at1the 250 has already been used to expand the living room on the floor above, and is curr-entty / ao"f
under construction. Because the adiition will be located under existing floor area and a new -

III. CRTTERN AND FINDINGS
Upon review ot Chapter 18.71 - Additional GRFA, the Community Development Department
recommends approval of the request for additional GRFA based upon the lollowing factors:
A. Consideration of Factors:
Before acting on an application for additionalGRFA, the Planning and Environmental
Commission shall consider the following factors with respect to the proposed use:
1. Eftect upon the existing topograohy. vegetation. drainage and existing
structures.
The proposed addition is located at the basement level of the building.
under existing floor area. The addition will have minimal impact on the
site, no vegetation will be removed, and neifier drainage or grading on the
property will be etfected. The addition will match the existing building
(materials and colors) and not appear out ol place.
2. lmpact on adjacent properties.
The proposed addition will have no impact on adjacent properties.
3. Compliance with the Town's zoning requirements and applicahle
develooment standards.
Section 18.71.020 (F) of the Town of Vail Zoning Code requires that any
dwelling unit that proposes to use an additional 250 square feet of GRFA
shall comply with the standards within the Design Review Guidelines.
These standards include landscaping, undergrounding of utilities, paving' of the driveway and general maintenance of the property.
Upon inspection by staff, we find that this property is in compliance with
the Town's zoning reguirements and all applicable development standards.
Because a portion of this building is currenty under construction, some
areas of the site have been disturbed. When construction is compleb, all
site regrading and revegetation will be completed.
B. Findings:
The Planning and Environmental Commission shall make the following findings beforegranting approvat tor Additionat GRFA:
1' That the granting of the requested Additional GRFA would not negatively
eflect existing topography, vegetalion, drainage and existing structtres.
2. Thatthe granting of the requested Additional GRFA would not negatively
impact adjacent properties.
3. That the granting of the requested Additional GRFA would comply with all
Town zoning requirements and applicable development standards.
IV. STAFF RECOMilENDATION
The Community Deleloprnent Department statf recommends approvat of this application for
additional GRFA. Staff believes that the review criteria have been met as Oiscu-s'seO in the
memo. Rqgarding the findings, staff believes that finding 81 is met as the proposed addition
minimally impacts the existing site. Finding 82 is met in staff's opinion, as the proposed addition
will not impact adjacent properties. Finding 83 is met, in staffs opinion, as the proposed addition
complies with all zoning requirements and applicable development standards. Staff recommends
approval with no conditions.

The following information, in addition to DRB submittal requirements, shall be required with
this submittal:
1. Verification that the unit has received a final certificate of occupancy.
2. Stamped, addresssd envelopes and a separate list of adjacent property owners
and ol owners of units on lhe same lot. This information is available from the
Eagle County Assessor's office.
3. Condominium Association approval (if applicable).
4. Existing or proposed floor plans of structure.
G. Your proposal will be reviewed for compliance with Vail's Comprehensive Plan.
H. lf this application requires a separate review by any local, State or Federal agency
other than the Town of Vail, the application fee shall be increased by $200.00.
Examples of such review, may include, but are not limited to: Colorado Department of
Highway Access Permits, Army Corps of Engineers 404, etc.
The applicant shall be responsible for paying any publishing fees which are in excess
ol 501" of the application fee, lf, at the applicant's request, any matter is postponed for
hearing, causing the matter to be re-published, then the entire fee for such re
-publication shall be paid by the applicant.
Applications deemed by the Community Development Department to have significant
design, land use or other issues which may have a signilicant impact on the
community may require review by consultants other than town staff. Should a
determination be made by the town staff lhat an outside consultant is needed to review
any application, the Community Development Department may hire an outside
consultant, it shall estimate the amount of money necessary to pay him or her and this
amount shall be foruvarded to the Town by the applicant at the time he liles his
application with the Community Development Department. Upon completion of the
review oi the application by the consultant, any of the funds forwarded by the applicant
for payment of the consultant which have not been paid to the consultant shall be
returned to the applicant. Expenses incurred by the Town in excess of the amount
forwarded by the applicant shall be paid to the Town by the applicant within 30 days of
notification by the Town.
