Re: Air Conditioning Proposal, 9 Vail Road Unit 41
Dear Joel,
Alfredo Catan, Debbie Ford and Gwen Scalpello, members of the Board of Directors, and Tom Saalfeld,
Property Manager, met Thursday, June 1 by phone to review your air conditioning proposal. Rhoda
Kaplan was unable to attend. I’m sorry you were unable to attend.
The Board of Directors reviewed your application to install air conditioning based on the following:
− Application Package submitted by you and revised May 23, 2017
− Representations made by Chris Allen in e-mail to Mark Hallenbeck dated May 26, 2017
− Clarification of disposition of condensate in your e-mail to Gwen Scalpello dated May 29, 2017
− Representations made by Stan Humphries of AEC in letter to Mark Hallenbeck dated May 25,
2017 regarding the electrical capacity of the unit, the unit’s electrical meter and the building
electrical capacity
On file with the Association are an Application for Unit Remodel signed by you and a Construction
Agreement signed by you and by Mark Hallenbeck of Rocky Mountain Construction Group. A Certificate
of Liability Insurance naming Holiday House Condominium Association as additional insured will also be
required.
The application is approved with the following conditions:
− Exterior compressor unit: mounting is to incorporate vibration dampening; compressor to be
installed between the sliding doors that open onto the fifth floor west balcony, below the
balcony rail and parallel to and as close to the building as feasible; mounting the compressor
unit between the sliding doors as shown in the submitted plans places it directly above the
sliding door between a bedroom in Unit 42 to the fourth floor balcony below;
− All plumbing and electrical conduit will be contained entirely within Unit 41; plumbing and
electrical conduits from the exterior compressor to the inside must enter the building behind
and below the top of the compressor and be routed within Unit 41 to the various system
components;
− Condensate from the interior wall units will be drained to a bathroom drain servicing the loft
bathroom and not directly into any general common waste lines as clarified in your e-mail to
Gwen Scalpello May 29;
− No interior units may interfere with the operation of the fire / sprinkler system; relocation of
fire / sprinkler system elements was not included in the application and is not approved;
− The owner is responsible for all upgrades to electrical service to support this installation.
All approvals are subject to the Construction Agreement, Rules and Regulations, Architectural Change
and Design Review of Unit Modifications, Common Element Modification Policy and Universal Policy on
Unit Renovations, all of which can be found on the 9 Vail Road website. As General Contractor, Rocky
Mountain Construction Group is not only bound by these policies and agreements but also responsible
for ensuring all subcontractors comply with these policies. Should work commence on this project prior
to June 30, all work must cease at 4:00 Friday, June 30 regardless of the status of the project and may
not resume until the next construction season (after Labor Day). The Association reserves its right to
address by any legal means any violations of these conditions as specified in section 3d of the
Construction Agreement.
Note that this installation is immediately above the sliding door from a unit 42 bedroom to the Unit 42
west balcony. If this installation results in noise and / or nuisance complaints, the Association reserves
the right to require that appropriate sound mitigation be installed to continue unit operations and / or
turn the complaints over to the Town of Vail for resolution.
All logistics regarding parking, trash removal, construction materials delivery and building access must
be coordinated with Tom Saalfeld of Ptarmigan Management before any work starts.
Copies of all building permits and Design Review Board permits must be delivered to Tom Saalfeld of
Ptarmigan Management before any work may be started.
By copy to Town of Vail Community Development, this letter also documents the Association’s approval
and conditions of approval for application for Town of Vail building permits and Design Review Board
reviews.
