Dear Ms. Chang-Nadeau,
Thank you for your application for the expansion of your deck at 2625 Bald Mountain Road in
Vail. Your application materials include an email from Denny and Sheila Linn dated June 20,
2014. However, this email is not sufficient to act as the required Joint Property Owner Approval,
as required in Section 12-11-4 C 1 I, Vail Town Code, which reads:
"I. Form And Fee: Application form and appropriate fee. If the property is owned in
common (condominium association).and/or located within a.development lot, the written
approval of the other property owner, owners, or applicable owners'association shall be
required. This can be either in the form of a letter of approval or signature on the
application."
As a duplex property, your home is located within a Development Lot, and thus the written
approval from the attached duplex owners is required. The email from Denny and Sheila Linn
from June 20, 2014 discussing the use of treated lumber is not sufficient to act as "approval of
the other property owner". As a result, your application is incomplete and will not be processed
until a complete application is received, including written approval from the adjacent property
owner specific to the proposed deck design.
