SCOPE
This report presents th€ results of our soils and foundation investigation on Parcel
D, Stevens Subdivision in Vail, Colorado. We explored the subsurface conditions to
provide foundation recommendations tor five single family buildings. This report includes
a description of the subsurface conditions found in our test holes, a recommended
foundatlon system and geotechnical and construction ctiteria for details influenced by the
subsoils. Our report was propared from data developed during our field exploration,
laboratory testing, engineering analysis and our experience with similar conditions. A
8ummary of our conclusions is prssented below.
SUMMARY OF CONCLUSIONS
1. Our test holes penetrated 0.5 to 1,5 feet of organic, sandy clays above 4.5
to 6.5 feet of very loose to medium dEnse, moist, clayey sands and silty
sands underlain by dense to very dense, moist sandy gravels with cobbles
and bouldErs. Drill rig refusal occurred at depths of 7.5 to 13 fEet. No lree
groundwater was found in our test holes at the time of drilling.
2. We recommend founding the buildings with footings bearing on ths native
sandy gravels. A mo<imum soil bearing pressure is pressnted in the
"Foundations" gection.
Ground level floors in living areas will be loundation supported with a
space between the floor and soils.
A ground surface slope away from the buildings should be maintained at
all times to rsduce tho risk ol wetting soils below foundations.
SITE CONDMONS
Parcel D, Stovens Subdivision is adjacent to Gore Creek at the west end of Vail,
Coforado. The bounds of the +/- 2 acre site ars defined by a green fence' The site
occupios an alluvial torrace formed by Gore Creek. Ground surface slopes are from the
south to the north at grades measured and visual estimated at 8 to 16 percent.

Vegetatlon consistg of medium to larg€ plne and fir trees, small birch trees, flowers,
grasses and weeds, Bouldere and cobbles are strewn sparsely on the ground surface.
PROPOSED CONSTRUCTION
Single family residential buildings will be buitt. The buildings will be wood framed,
two to three stories tall with attached garages. No basements are planned, Living areas
of ground level floors will be foundation supported with a spacs betwssn the floor and
the ground. Foundation loads we assumed for our analysis were between 1000 and 3000
pounds per linsal foot on continuous footings and'maximum interior column loads of 15
kips. We should be informed il actual construction is different than describod above.
SUBSURFACE CONDMONS
Teet holes pengtrated 0.5 to 1.5 feet of organic sandy clays above 4.5 to 6.5 feet

SITE GFADING
Building ground floor elevations will be stepped to minimize grading. No fill will
be placed belorrv buildings. Site preparation will be limited to stripping of the surficial
organic clays. We estimate stripping d€pths of 6 to 12 inches'

FOUNDATIONS
In our opinion, the buildings can be founded with footings bearing on the native
eandy gravels. Footings should be designed and construsted with the following criteria.
1. Footings should bear on the native sandy gravels and be designed lor a
maximum soil bearing pressure of 5000 psf. Materials loosened during the
excavation or forming process should be removed from the footing areas
prior to placing concrete;
2. Foundation walls for continuous lootings should be reinforced top and
bottom, to span loose soil pockets. We recommend reinforcing sleel
equivalent to that required for a simple span of 10 feet. Reinforcement
should be designed by a qualified structural engineer;
3. Minimum footing sizes are desirable. We suggest a minimum width of 16
inches for continuous footings and a size of at least 2 feet by 2leel tor
isolatsd column pads. Larger sizes may be required based on the
structural loads;
4, The soils under extErior footings should be protected from freezing. The
depth normal assumed for frost protection in Vail is 48 inches. We
recommend contacting the local planning department to verify the depth
of protection required.
FLOOR SIABS AND EXTERIOR CONCRETE
Livlng areas on ground level floors will be loundation supported with a space
between the floor and the ground, Garage floors, patios and sidewalks will be elabs-on-
grade. We recommend the following design and construction details for slabs-ongrade:
Slabs should be placed directly on native sands or gravels;
Slabsongrade should be separated from exterior walls and interior
bearing members. Vertical movement of the slabs should not be restricted;
Plumbing betow the slabs should be pressure tested. Trench backfill
should be moisture treated and compacted to at least 95 percent of the
standatd Prostor maximum dry density (ASTM D 698);
Frequent control joints should be provided, The American Concrete'
lnstitute (ACl) recommends maximum joint spacing of 15 to 20 fest to

The above precautions will not prevent movEment of the slab-ongrade floors in the ev€nt
the eoils become wet, but they will reduce the potential damage when movsmsnt occurs.
CBAVTIL SPACE CONSTRUCTION
Below grade walls will be subject to lateral earth pressure. These walls are
testralned and cannot move and should be dssigned for the "at resf latoral earth
pressure. Assuming on-site sands will be used as backfill, we recommend using an
gquivalent fluid density of 45 pcf to calculate lateral earth pressure. The above equivalent
lluld density does not include allowances for sloping backfill, hydrostatic pressures, live
loads or loads from adjacent structures, Backftll adiacent to the foundation walls shoutd
b€ compacted to at least 95 percent of the standard Proctor maximum dry dsnsity (AsrM
D 698).
SURFACE DRAINAGE
The performance of foundations and concretE tlatwork is influenced by the
moisture conditiong in the subsoils. Wetting of soils below foundations can be reduced
by planned and maintained surface drainage. Wetting or drying of the open foundation
excavations should be avoided. The ground surface surrounding the buildings should
be sloped to provide rapid run-off of water away from the buitdings in all directions. We
Ie@mmend a slope of at least 12 inchss in the first 10 feet. Backfill ol thE foundation
walls should be moisture treated and compacted (see "Crawl Space Construction'), Roof
downspouts and drains should discharge well beyond the limits of all backfill. Splash
blocks or downspout e)ftensions should be provided at all discharge locations.

subsurface. Variatlons in the subsurface conditions not indicated by our test holes will
occur. We should observe the completed excavations to confirm the soils are as

otfice of the Gommunity Development Department, the Town of Vail, and to do all work
incidental thereto according to and in compliance with the following:

submitted by the Developer to be approved by any of the above-referenced
governmental entities. All said work shall be done under the inspection of, and
to the satisfaction of, the Town Engineer, the Town Building Official, or oher

as their respective interest may appear, and shall not be deemed complete until
approved and accepted as completed by the Town of VailCommunity

4. The Town shall not, nor shall any otficer or employee thereof, be liable or
responsible for any accident, loss or damage happening or occurring to the work specified in
this Agreement prior to the completion and acceptance of fte same, nor shall the Town, nor
any officer or employee thereof, be liable for any persons or property injured by reason of the
nature ol said work, but all of said liabilities shall and are hereby assumed by the Developer.
The Developer hereby agrees to indemnify and hold harmless the Town, and any of its
otficers, agents and employees against any losses, claims, damages, or liabilities to which the
Town or any of its officers, agents or employees may become subject to, insofar as any such
losses, claims, damages or liabilities (or actions in respect thereof) that arise out of or are
based upon any performance by the Developer hereunder; and the Developer shall reimburse
the Town for any and all legal or other expenses reasonably incurred by the Town in
connection with investigating or defending any such loss, claim, damage, liability or action.
This indemnity provision shall be in addition to any other liability which the Developer may
have.
5. lt is mutually agreed that the Developer may apply to the Town and the Town
shall authorize for partial release of the collateral deposited with the Town for each category
of improvement at such time as such improvements are constructed in compliance with all
plans and specifications as referenced hereunder and accepted by the Town. Under no
condition will the amount of the collateral that is being held be reduced below the amount
necessary to complete such improvements.
6. lf the Town determines, at its sole discretion, that any of the improvements
contemplated hereunder are not consfucted in compliance with the plans and specifications
set forth in this Agreement on or before the date set lorth in Paragraph 2, the Town may, but
shall not be required to, redeem the letter of credit as necessary to complete the unfinished
improvements. The Bank shall release such funds upon written request from the Town stating
that the improvements have not been completed as required by this agreement. The Bank
shall not require the concurrence of the developer prior to release of the funds to the Town
nor shall the Bank be required to verily independently that such improvements have not been
completed as required by this agreement, but shall release such funds solely upon the Town's
written request.
lf the costs of completing the work exceed the amount of the deposit, the excess,
together with interest at twelve percent per annum, shall be a lien against the property and
may be collected by civil suit or may be certified to the treasurer of Eagle County to be
collected in the same manner as delinquent ad valorem taxes levied against such property. lf
the permit holder fails or refuses to complete the cleanup and landscaping, as defined in this
chapter, such failure or refusal shall be considered a violation of the Zoning Code.
7. The Developer warrants all work and material for a period of one year after
acceptance of all work refened to in this Agreement by the Town if such work is located on
Town of Vail property or within Town of Vail right-of-way pursuant to Section 17.16.250.
8. The parties hereto mutually agree that this Agreement may be amended from
time to time, provided that such amendments be in writing and executed by all parties hereto.

IIHEREAS the Town council of the Town of vail is of the opinlon that the
subdivlder of land in each major residential subdivision or portion of a major
subdivlsion which is intended for residential use shall allocate and convey sites
and land areas for school s when such are reasonab'ly necessary to serve the
proposed subdlvlsion and future residents thereof;

Sectlon 1.
Title 17 of the Town of vail Municipal code is hereby amended by the
addition of Chapter L7,L7, School Site Dedications, to read as follows:
17.17.010 PURPoSE
It is hereby declared to be the policy of the Town that whenever there is
a major subdivision, which is subdivided for residential use or partlal
residentia'l use, the owner of the land shalI provide 'l and for school needs
generated by the proposed residential use. It js the purpose of this chapter to
require the dedlcatlon of'land or the payment of fees in lieu thereof or both to

The full market value shall mean the current market value of unimproved
'land. Thls value shall be set annually by the Town Council on an acre basis with
recommendatlons from the School District. The same value per acre shall be used
throughout the town.
If the subdivider does not agree with .the value per acre, the subdivider
may submit the report by a qualified appnaiser who is M.A.I. designated, which
establishes a new value. The Town Council shall review the report and determlne
if the value ls reasonable. Based upon their review, the Town councll will
detenmine the value of such land.
!'lhen money in lieu of land is required or when monies have been paid to the
Town Counci'l from the sale of such dedicated sites for schools, it sha1l be held
by the Town Counci'l for the acquisition of reasonably necessary sites for the
construction of school faci'l ities, for the construction of employee housing
required by the school district, for the purchase of employee housing units for
the schoo'l district, or for the development of such sites. If housing units are
purchased, a deed restrictlon restricting their use to school district employee
housing shall be required and ownership shall remain in the name of the School
District. A subdivision school dedication shall apply onlyonce to the same land
area. Dedication shall not be required of re-subdivisions of the same land on
a dedlcatlon that has pnevlously been made.
Sectlon 17.17.030. Town Exempted.
The Town of Vail is specifically exempted from the requirements of this
chapter 17.17.

Section 3. The Town council hereby finds, determines, and declares that
this Ordinance is necessary and proper for the health, safety, and we1fare of the
Town of Vail and the lnhabitants hereof.
section 4. The repeal or the repeal and reenactment of any provision of
the Vall Municlpal Code as provided in this Ordinance shall not affect any rlght
which has accrued, any duty imposed, any violation that occurred pnior to the
effective date hereof, any section commenced, nor any othen action or proceedlngs
as cormenced under or by virtue of the provision repealed or. repealed and
reenacted. The repeal of any provision hereby sha1 'l not revive any provislon or
any ordinance previously repealed or superseded unless expressly stated herein.
section 5. Repealer. All bylaws, orders, resolutions, and ondinances, or
parts thereof, inconslstent herewith are hereby repealed to the extent only of
such inconsistency. This repealer shall not be construed to revise any bylaw,
order, resolution, or ordinance, or part hereof, heretofore repealed.

AND SETTING FORTH DETAILS IN REGARD THERETO.

COLORADO:
l. Title 18 ls hereby amended by the addition of Chapter 18.67 to read
as fo] 'lows:
18.67.010 PURPoSE
The purpose of this Chapter is to provide the procedures necessary to
implement the provisions of Article 68 of Title 24, C.R.S., as amended.
18.67.020 DEFINITIONS
A. Site specific development plan sha'l I mean and be'l'imited to a final
major or minor subdivjsion p1at, or a specia'l deve'l opment district development
pl an.
B. Vested property right means the right to undertake and complete the
development and use of property under the terms and conditions of the site
specific development p1an, and shall be deemed estab'l ished upon approval of a
site specific development pl an.
18.67.030 NOTICE AND HEARING
No site specific development plan shall be approved by the Town Council
or any Town board or conmission as applicable, unti'l after a public hearing
proceeded by written notice of such hearing, in accordance with Chapter 8.68
of the Va'il Munjcipal Code. Such notjce may, at the option of the Town, be
combined with the notice for any other hearing to be held in conjunction with
the hearing on the site specific development plan for the subject property.
At such hearing, persons with an interest in the subject matter of the hearing
shal'l have an opportunity to present relevant or material evidence as
determined by the Town Council or Town board or commission as appljcable.
18.67.035 ACTION FOR APPROVAL OF SITE SPECIFIC DEVELOPMENT PLAN .
CONDITIONS
The action of the Town Council or Town board or commission as applicable
for approva'l of a site specific development p'lan sha'l 'l be in the same form as
that required to approve any request being considered for the subject property
in conjunction with the hearing on the site speclfic development plan, such

action being eithen by ordinance, resolution, or motion as the case may be.
If any action by any board or conmission is appealed to or ca1'led up by the
Town Council, approval shall be deemed to occur when a final decision of the
Town Council ls rendered approving the site specific development plan. The
approva] may include such terms and conditions as may be reasonab'ly necessary
to protect the public health, safety, and welfare, and the failure to abide by
any such terms and conditions may, at the option of the Town Counci'l or Town
boand or commlssion as applicable, and after public hearing, result in the
forfeiture of vested property rlghts.
18.67.040 APPROVAL . EFFECTIVE DATE
A site specific development plan shal 1 be deemed approved upon the
effective date of the approval action relating thereto by the Town Council or
the Town board or comission as the case may be.
18,67.045 VESTED PROPERTY RIGHTS - DURATION
A. A property right which has been vested as provided for ln this
Chapter shall remain vested for a period of three (3) years. In the event
amendments to a site spec'ific development plan are proposed and approved, the
effective date of such amendments for purposes of the duration of the vested
property right, shall be the date of the approval of the original site
specific deve'l opment plan, unless the Town Council or applicab]e board or
conrnission specifica'l ly finds to the contrary and incorporates such finding in
its approva'l of the amendment.
18.67.050 NOTICE OF APPROVAL
Each map, plat, or site plan or other document constituting a site
specific development plan shall contain the fol'l owing language: "Approval of
this plan may create a vested property right pursuant to Article 68 of T'l tle
24, C.R.S., as amended." Failure to contain this statement sha'l 'l invalidate
the creation of the vested property right. In addition, a notice describing
general ]y the type and intensity of use approved, the specific parcel or
parcels of property affected, and stating that a vested property right has
been created, sha'll be published once, not more than fourteen (14) days after
approva'l of the site specific development plan in a newspaper of general
circu'l ation w'lthin the Town.
18.67.055 EXCEPTION TO VESTING OF PROPERTY RIGHTS
A vested property right, even though once established as provided in
this Art'icle, precludes any zoning or land use action by the Town or pursuant

to.an initiated measure which would alter, impair, prevent, diminish, or
otherwise delay the development or use of the property as set forth in the
site specific development p'lan except:
A. Uith the consent of the affected landowners; or
B. Upon the discovery of natura'l or man-made hazards on or in the
immediate vicinity of the subJect property, which hazards cou'l d not reasonably
have been discovered at the time of site specific development plan approval ,
and which hazards, if uncorrected wou'ld pose a serious threat to the public
health, safety, and welfare; or
C. To the extent that the affected landowner receives just compensation
for a'll costs, expenses, and'l iabi'l ities incurred by the landowner, including
but not'limited to all fees paid in consideration of financing, and all
architectural , planning, marketing, legal , and other consultants fees incurred
after approval by the Town council, or app'licab'le town board or comission,
together with interest thereon at the 'lega1 rate until paid. Just
compensation shall not inc] ude any diminution in the va] ue of the property
whjch is caused by such action.
D. The establishment of a vested property ri ght pursuant to law shall
not preclude the application of ordinances or regulations which are general in
nature and are applicable to a'll properties subject to land use regulation by
the Town of. Vail, including but not limited to, building codes, fire,
plumbing, electrica] and mechanical codes, housing, and dangerous building
codes, and design review guidelines,
18.67.060 PAYMENT 0F CoSTS
In addition to any and all other fees and charges imposed by the
Municipal Code of the Town, the applicant for approval of a site specific
development plan shal 1 pay a1 'l costs re'lating to such approval as a result of
the site specific development plan review including publication of notices,
public hearlng, and review costs. At the option of the Town, these costs may
be imposed as a fee of / nO .
18.67.065 OTHER PROVISION UNAFFECTED
Approval of a site specific developrnent p'l an shall not constitute an
exemption from or waiver of any provisions of this code pertaining to the
development and use of property
18.67.070 LIMITATIONS
Nothing in this Chapter is intended to create any vested property right,

I but only.to imp'lement the provisions of Artic'le 68 of Title 24, C.R.S., as
amended. In the event of the repeal of said Article or Judicial determination
that said Article is invalid or unconstitutional or does not apply to home
ru'le municipalities such as the Town of Vai'l , this Chapter sha'l 'l -be deemed to
be repealed, and the provisions hereof no longer effectlve.
2. If any part, section, subsection, sentence, clause or phrase of this
Ordinance is for any reason he'ld to be invalid, such decision shall not affect
the va'lidity of the remaining portions of this 0rdinance; and the Town Counci'l
hereby dec'lares it wou'ld have passed this Ordinance, and each part, section,
subsection, sentence, clause or phrase thereof, regardless of the fact that
any one or more parts, sections, subsections, sentences, clauses or phrases be
declared inval id.
3. The Town Council hereby finds, determines and dec'lares that this
Ordinance is necessary and proper for the health, safety and welfare of the
Town of Vail and the inhabitants thereof-
4. The repeal or the repeal and reenactment of any provision of the
Municipal Code of the Town of Vai'l as provjded in this 0rdinance shall not
affect any right which has accrued, any duty 'imposed, any violation that
occurred prior to the effective date hereof, any proserution cormenced, nor
any other action or proceedings as commenced under or by virtue of the
provision repealed or repealed and reenacted. The repeal of any provision
hereby shal'l not revive any provision or any ordinance previously repealed or
superseded un1ess expressly stated herein.
5. A1 I by'l aws, orders, reso'l utions, and ordinances, or parts thereof,
inconsistent herewith are repealed to the extent only of such inconsistency.
This repealer shal'l not be construed to revise any bylaw, order, resolution,
or ordinance, or part thereof, theretofore repealed.
