The lot was annexed into the Town of Vail in 1974. Two units (a duplex building) were approved to be built in the original building permit from 1976, and finished construction in 1977. Therefore two units are recognized as being legally established. The property is currently zoned for Two - Family Primary/Secondary, but due to the lot area being less than 14,000 square feet; only one dwelling unit would be allowed under current zoning regulations. According to the Town of Vail property file, the property had two dwelling units, plus a Iockoff unit, as of September 1992. It is unclear from a review of the Town of Vail property records when the Iockoff unit was built, or if it was ever formally reviewed or approved by the Town of Vail. I have found no permits or other evidence to show that construction of the Iockoff unit was approved by the Town of Vail. That being said, there is a note in the file indicating that during discussions about the Iockoff unit (in 1992), the owner was told by the Town of Vail that it was OK to keep the Iockoff unit as constructed. Based on this evidence, the existing, nonconforming condition may be maintained. However, as a nonconforming property, upon redevelopment the property must come into conformance with the current zoning code, which allows only one dwelling unit based on lot area and zoning. Redevelopment to allow two dwelling units would require approval of a variance from the density control regulations for the zone district (Section 12-6D-8, Vail Town Code). Any redevelopment of the property will be subject to the Nonconformities section (Title 12, Chapter 18) of the Vail Town Code in effect at the time of redevelopment. Also, any nonconforming use which is discontinued for a period of twelve (12) months, regardless of any intent to resume operation of use, shall not be resumed thereafter, and any future use of the site or structures thereon shall conform to the Vail Town Code in effect at the time.
