HomeMy WebLinkAboutTampering Letter 2841 Basingdale.pdf January 14, 2019 BLUE SKY HAUS LLC SCOTT HANDLER 303 S BROADWAY, STE 200-509 DENVER CO 80209 Subject: System Tampering Account Number: 00571272 Service Address: 2841 BASINGDALE BLVD Dear Mr. Handler: It was reported to Eagle River Water and Sanitation District (ERWSD) staff on the morning of January 2, 2019 that a Fire Hydrant located on the property at 2841 Basingdale Blvd may be compromised. Upon a field inspection of the fire hydrant, it was determined that the structural integrity of the fire hydrant, and associated thrust block, was compromised due to improper excavation. When the excavation of the property occurred, the bearing soil needed for the thrust block of the fire hydrant was removed thus compromising the integrity of the fire hydrant lateral and increasing the likelihood of a mainline failure that could interrupt water service and cause significant property damage. As a result the fire hydrant was taken out of service and will be relocated in the spring of 2019 when the weather permits. Based upon the severity of this issue, ERWSD is assessing the following fines and penalties:  A System Tampering fine of $2,000.00 per ERWSD Rules and Regulations, 3.10 Violators Liability for damage to the water system.  A civil penalty of $5,000.00 for failure to notify prior to commencing excavation and causing damage to an underground facility during excavation pursuant to C.R.S. § 9-1.5-104 ERWSD will bear the costs of relocating the fire hydrant, which will likely exceed the above referenced fines and penalties. But, you will be responsible for any costs incurred by ERWSD in managing the out of service fire hydrant prior to relocation, including but not limited to water loss, tasks to secure the hydrant, and/or repairs that may arise due to the compromised integrity of the fire hydrant. The fines will be added to your account and may be paid in person at the ERWSD Offices at 846 Forest Rd Vail, CO.
