A special meeting of the Local Licensing Authority for the Town of Vail, Colorado, was convened at 10:25 A.M. on Wednesday, March 3, 1976, in the Council Chambers of the Vail Municipal Building. The following members of the board were present: Sally Hanlon Robert Buterbaugh Barbara Parker Also present were: Larry Rider, town attorney Rosalie Jeffrey, town clerk Jim Jacobson, attorney for Vail Run Liquors Rob Buterbaugh, acting chairman, called the meeting of the authority to order. Jim Jacobson, representing Vail Run Liquors, was present to request the consideration of the authority concerning a problem of jurisdiction between Eagle County and the Town of Vail. The question of jurisdiction resulted when the area known as Lions Ridge was annexed to the Town on December 16, 1975. Mr. Jacobson gave the background information concerning the original application of Vail Run Liquors to the County Commissioners, at which time the proper publica- tion for the liquor hearing was not made - hearing date November 25, 1975. At the November 25 hearing, the commissioners, who had failed to have notice published in the local newspaper, continued the hearing to January 5, 1976, by which time proper notice would be made. When the area was annexed to the Town, the question of juris- diction came up, and the State will not issue the license until the matter is settled. Mr. Jacobson was present to request a letter from the authority stating that the Town of Vail accepts the testimony heard before the county. The town attorney commented that equities lie with the applicant but that legally there are problems relating to the public notice. Since proper notice was not given for the initial hearing, the Town can lessen the legal burden by giving the proper notices and then taking administrative notice of the county testimony. Mr. Buterbaugh then noted that the next regular meeting of the authority would be Friday, April 9, 1976, at 10:00 A.M. He then moved to require re- application due to Town of Vail jurisdiction and the 30 day waiting period. Ms. Parker seconded the motion; Ms. Hanlon, Ms. Parker and Mr. Buterbaugh voted in favor and the motion carried. Mr. Jacobson then asked about a waiver of the application fee at the hearing. Mr. Buterbaugh commented that he could make the request at the April 9 hearing. As there was no further business, Ms. Hanlon moved to adjourn the meeting; Ms. Parker seconded the motion; all voted in favor; and the meeting was adjourned. t� I tL �jtl - �4 Town Clerk
