The Town of Vail has been requested by the Liquor Enforcement Officer to approve guidelines for decks and patios when alcohol is to be served so that the Town's Restaurant License holders may know their responsibilities. Enclosed is a copy of the deck and patio guidelines for your information. All new applications for service on a deck or patio will be required to meet the guidelines. At the time that an application is made to change the licensed premises, or ownership of the license, the licensee will be required to comply with these guidelines. The Liquor Licensing Authority requests that you begin to take the necessary steps to conform with these guidelines in order to avoid future inconveniences. Thank you for your cooperation. Sincerely, Chairman Local Liquor Licensing Authority 0 PROPOSED GUIDELINES FOR DECK AND PATIO SERVICE OF ALCOHOLIC BEVERAGES 1. Licensee must have deed, lease or assignment of lease granting full and complete rights and control for the area proposed for service. 2. Area of service must be totally contiguous to licensed premises. 3. No pedestrian traffic should be allowed through any portion of the service area. 4. Service area should be bounded on all sides by wall, planter or fence, 3z feet high, measured from floor level. 5. Ideally, only one opening for street or outside access should be allowed. (if more than one allowed, guideline #6 should be applied) 6. Street or outside access to service area should be controlled at the opening by a gate or by the presence of an employee at all times during service hours. 7. Primary premises must open directly onto service area in a method which conforms to building and health codes. (ie, door or service window) 8. Premises which include pools, recreation areas or grounds should Deck Guidelines page two be fenced and gated at the property line. (other methods of demarcation, such as shrubs, trees, planters, etc., may be considered on an individual basis in certain areas so long as plans are approved by both the Authority and the Department of Community Development ) 9. Prior to consideration of the Authority of any request for approval of any new or the upgrading of existing outside service areas, the licensee should submit plans and drawings of the proposed controls to the Town of Vail Department of Community Development where a determination will be made whether or not an approval of the Design Review Board will be required. All applications filed for hearing before the Authority should include written clearance from the DCD or DRB.
