Rondall Phillips, Town Manager Charlie Wick, Events Manager 5. PUBLIC HEARING - Consideration of the Board of Licensee stipulates to a Suspension /Revocation Hearing for the Hotel/ violation. In lieu of Restaurant Liquor License currently held by 3 day suspension, licensee Starr Pizza Slices, Inc., dba, Rocky Rococo's will pay fine of $291.60 Pan Style Pizza, with the grounds for suspension (20% of the retail estimated or revocation as follows: gross sales of alcoholic beverages). See attached On February 18, 1989, the licensee, Starr Pizza "Revised Petition." Slices, Inc., dba, Rocky Rococo's Pan Style Pizza sold malt, vinous, or spirituous beverages to John Charles Belt and Thomas D. Crimmons, persons under the age of twenty -one years, in violation of C.R.S. 12- 47- 128(1)(a), as amended. 6. PUBLIC HEARING - Consideration of the Board of a Suspension /Revocation Hearing for the Hotel/ Restaurant Liquor License currently held by Mary J. Senac, dba, the Corona Cafe and Cantina, with the grounds for suspension or revocation as follows: On April 7, 1989, the licensee, Mary J. Senac, dba, the Corona Cafe and Cantina, sold malt, vinous, or spirituous beverages to Emily K. Moore, a person under the age of twenty -one years, in violation of C.R.S. 12- 47- 128(1)(a), as amended. Licensee is found guilty of the violation. License suspended for 4 days, to commence immediately, June 14 -18, 1989. See attached "Decision." 7. Notification of the Board of a recent incident Board so notified. report, Vail Police Department 489 -2734. 8. Any other matters the Board may wish to discuss. None. 9. J.A.M.E., Inc., dba, Fountain Cafe and Restaurant. it VAIL LOCAL LICENSING AUTHORITY TOWN OF VAIL COUNTY OF EAGLE STATE OF COLORADO REVISED PETITION FOR PERMISSION TO PAY A FINE In the Matter of : STARR PIZZA SLICES, INC., d /b /a Rocky Rococo Pan Style Pizza. COMES NOW Starr Pizza Slices, Inc., d /b /a Rocky Rococo Pan Style Pizza, by and through its attorneys, Dill and Dill, a Professional Corporation, and respectfully requests permission to pay a fine in lieu of having its retail license suspended as follows: 1. On Wednesday, June 14, 1989, the Licensee will stipulate to the existence of one (1) violation of C.R.S. 12- 47- 128(l)(a). 2. The Licensee has its place of business at 600 Lionshead Mall, Vail, Colorado. 3. The Vail Local Licensing Authority has concluded that the appropriate time of suspension is three (3) days. 4. The -licensee states that the public welfare and morals will not be impaired by permitting the Licensee to operate during the period set for suspension, and that the payment of the fine will achieve the desired disciplinary purposes. 5. The books and records of the retail licensee are kept in such a manner that the loss of sales of alcoholic beverages which the Licensee would have suffered had the suspension gone into effect can be determined with reasonable accuracy there- from. 6. The Licensee has not had its license suspended or revoked nor had any suspension stayed by a payment of a fine during the two (2) years immediately preceding June 14, 1989. 7. Alcoholic beverage sales with respect to the Licensee at the above - referenced address average approximately Four Hundred Eighty -Six Dollars ($486.00) per day (a total of One Thousand Four Hundred Fifty -Eight Dollars [$1,458.00] gross sales for three days). 8. Twenty percent (20 %) of the retail licensee's estimated gross revenues from the sales of alcoholic beverages during the period of the proposed suspension would be approximately Two Hundred Ninety-One Dollars and Sixty Cents ($291.60). Thus, the Licensee requests that the fine of Two Hundred Ninety -One Dollars and Sixty Cents ($291.60) be imposed with respect to this particular licensee. WHEREFORE, the Licensee respectfully requests that it be permitted to pay a fine in lieu of having its license suspended in accordance with the terms of this Petition and the State of Colorado Liquor Code.
