The grounds for suspension or revocation are as follows: 1) Jim Dexter, Vice - President and Secretary of Knuckles, Inc., dba, Ringside, is not of good moral character in violation of C.R.S. 12 -47 -111, as amended, in the following particulars: a) Jim Dexter was convicted on May 24, 1991, of the crime of disorderly conduct. b) The conviction of Jim Dexter as set forth in paragraph a) hereof was not disclosed on the application for a Town of Vail liquor license for Knuckles, Inc., dba, Ringside, in violation of C.R.S. 12 -47 -107, as amended. The regular meeting of the Local Licensing Authority for the Town of Vail will be held in the Council Chambers of the Vail Municipal Building, 75 South Frontage Road West, Vail, Colorado, on Wednesday, January 8, 1992, at 10:00 A.M. The agenda, to be set the morning of the hearing, will include the following: 1. Consideration of a corporate structure change for the following: a. Majiks Vail Corporation, dba, Club Majiks b. Raecker Assistant Secretary to the Authority MEMORANDUM TO: THE TOWN OF VAIL LIQUOR LICENSE AUTHORITY FR: Larry Eskwith DA: December 16, 1991 RE: DELIVERY OF LIQUOR BY A RETAIL LIQUOR OUTLET You have asked me to research the law relating to the delivery of liquor by a retail liquor outlet. Although there is no Colorado statute which directly deals with the issue, I have learned the following in my discussions with the State Liquor Enforcement Board. So long as the individual to whom the liquor is ultimately to be delivered places the call with the retail liquor outlet, the delivery is considered legal. It does not matter who delivers the order, so long as the order is placed by the consumer with a retail store. Therefore, an individual could call a pizza shop and order pizza and then call a retail liquor store and order liquor, and the same delivery truck or car with the same driver could deliver both the pizza and the liquor to the consumer. What is not permitted is for a food store owner to place an order for liquor with a retail liquor store for the benefit of the ultimate consumer. Therefore, it would not be proper for an individual to call a food store adjacent to or nearby a liquor store, and place a food and liquor order, and then have the proprietor of the food store place that order either in person or over the phone with the retail liquor store. Another question I have been asked is whether or not it is proper for hotels and other businesses to engage in a catering business which provides both food and liquor to patrons. It is not proper for any company or individual to provide alcoholic beverages as a part of a catering business. Alcoholic beverages at parties catered by such businesses must be purchased and provided by the individual or company organizing the party or event. CALIQDELrv.MEM
