Those in attendance included: Pam Brandmeyer, Kristen Pritz, Mike Mollica, Dan Stanek,
Mike McGee, Gary Murrain, Holly McCutcheon, Dieter Menzel, and Leo Palmer.

Pursuant to a conversation with Matt Cook today, the following is an additional
requirement:
The State Liquor Enforcement Division will not accept the letter as signed by Tim
Whitney referencing waiving section 51 paragraph D of the lease. The letter
must be incorporated into and become a part of the lease and also must
reference exclusive right to serve alcohol.
Once these conditions have been met and approved by the Fire and Building
Departments, the applicant may proceed with obtaining approval from the Local
Licensing Authority.

Dear josette:
I am writing in regard to the recent party which was held at the Gateway on November 17,
1993.
According to our agreement when you modified the premise to accommodate this event, you
were told that all stores would have to be closed, that no drinks were to be allowed past the
elevator, and, finally, that the Gateway would be closed to the public. This party was to be by
invitation only.
I have been informed that, in fact, all stores were open, drinks were allowed to be taken onto
the elevator and onto different floors, thereby leaving the licensed premise, and that there were
no invitations being checked. 'Anyone was allowed inside the Gateway during this event.
These incidents are in violation of the Colorado Liquor Code, Article 47, Title 12, C.R.S. I will
document the Palmos file to reflect these violations, which will be considered should Palmos
wish to entertain such an event in the future.

To whom it may concern,
September 30,1993
Members of the board this letter is in advisement to the board in
regards to Palmos Cappuccino & Spirits located in the Vail Gateway Plaza.
As the General Manager and Secretary/Treasure of Palmos Inc., it is my
responsibility to inform the board in regards to this matter.
It seems that Mr. Leo Palmer; the Landlord, is going to be doing some
remodeling in the Gateway Plaza and this remodel includes changes to the
front of Palmos. Mr. Dieter Menzel owner of Palmos is aware of these
changes, but both gentlemen are under the impression that they can make
such changes without abiding by the State of Colorado liquor code or the
local licensing authority.
These changes as planned are to change the exsisiting glass windows
which look out to the atrium of the Gateway and to replace the glass
windows with glass doors. (See map enclosure) Then addiditional seating
would be added in the atrium falling into the common area of the Gateway
without providing any barrier.
In my opinion as the General Manager of Palmos this change would be
quite detrimental to the future of Palmos. This decision made by Mr.
Palmer and Mr. Menzel is in no way an improvement to Palmos nor the
Gateway. Also Mr. Palmer has told myself and Mr. Menzel that he has
received approval from the Town of Vail regarding this change to Palmos. I
know that this is impossible since he is nor the tenant of the Palmos
space or the Liquor License holder. Mr. Palmer is falsely guiding
Mr. Menzel, in which Mr. Palmer could place Mr. Menzel and myself in a
gross violation of the Liquor codes and building codes.
I am hoping that you the board members see my point of view.
The following reasons for this are as follows:
1. Open solicitation of alcohol
2. Controlling the open containers
3. Crowd control
4. Blocking the ingress /egress of front entry doors in the event of
an emergency situation
5. Setting a presidence in the State of Colorado and Vail of such an open
drinking environment in a shopping mall type situation
6. Trying to control theft of alcohol, glassware, and revenues.
7. Employing two to three persons to maintain an environment .
8. The noise level and disruption to the patrons of the Gateway
9. The noise level and disruption to the other tenants of the Gateway
10. The increased chance of breakins and or robberies 'due to three
new entrances.
11. The added responsibilities of security
12. The evacuation of patrons in the event of an emergencie
13. Exceeding the maximum seating allowed
14. Not being allowed to provide the ratio of parking to patrons
15. Changing all Licensing responsibilities due to the increased
occupancy.
16. The invitation to the local youths to have a warm places to sit and
the possibility of their attempts to try to purchase alcohol.
17. Puts the entire Gateway/Tenants in a security risk
18. Highly impossible to obtain liability insurance with such an
increased risk.
19. Losing the ambiance and charm in which we built Palmos for.
With these facts in mind I hope that you will render the right
decision as the board and with your knowledge of the laws and the
negative effects this can have on all sides. I also hope that you will take
my recommendations regarding this matter that will have a negative
effect for me and all concerned. Being that I was raised in the food and
beverage business in Vail for 26 years and also formally educated in this
business besides the practical experience that I have obtained. I believe
that I know the laws an the adversities of serving alcohol in an
uncontr lied environment better than Mr. Palmer.

6. PUBLIC HEARING - Consideration of the Authority of the Renewal
of the Tavern Liquor License held by Can Am of Colorado, Inc.,
d /b /a Sundance Saloon, at the location of 675 Lionshead Place,
Vail, Colorado.
The following items may be considered, as well as any other
items that may affect the renewal of said license:
a. Whether the Licensee sold malt, vinous, or spirituous
beverages to persons under the age of twenty -one years,
in violation of C.R.S. 12- 47- 128(1)(a), as amended;
b. Whether the licensee with respect to his character,
record, and reputation, is satisfactory to the Town of
Vail Local Licensing Authority, pursuant to 12-47 -
111(1)(a)(VIII), C.R.S.; and
