PUBLIC HEARING - Consideration of the Authority of a Suspension or Revocation of a Hotel and Restaurant license with extended hours held by Garfinkel Enterprises, Ltd., d /b /a Garfinkel's, at the location of 536 W. Lionshead Mall, Unit C6, Vail, Colorado. Grounds for suspension or revocation are as follows: A. The licensee is not in compliance with Article 47, Title 12, C.R.S., as amended, in the following particulars: i) The Licensee sold malt, vinous, or spirituous beverages to persons under the age of twenty -one years, in violation of C.R.S. 12- 47- 128(1)(a), as amended; ii) The Licensee or his agents, servants or employees allowed disrobing to occur on the licensed premise, in violation of C.R.S. 12- 47- 105.1(B)(1), as amended. The Local Licensing Authority was advised of a stipulation and agreement reached with the Licensee. After considering the facts of the alleged violations, the Local Licensing Authority approved by a 3 -1 vote, the following: A. The License holder is guilty of a single violation of Article 47, Title 12, CRS by: (i) The Licensee or his agents, servants, or employees on or about December 28, 1993, sold malt, vinous, or spirituous beverages to persons under the age of twenty -one (21) years, in violation of CRS 12- 47- 128(1)(a), as amended; (ii) The Licensee or his agents, servants, or employees on or about December 30, 1993, sold malt, vinous, or spirituous beverages to persons under the age of twenty -one years, in violation of CRS 12- 47- 108(1)(a), as amended; (iii) The Licensee or his agents, servants, or employees allowed disrobing to occur on the licensed premise, in violation of CRS 12- 47- 105.1(B)(1), as amended. B. The License is suspended for thirty (30) days, twenty (20) days to be held in abeyance for one (1) year pending no further violations. C. Pursuant to CRS 12 -47- 110(3), the Licensee shall have permission to pay a fine in lieu of having his retail license suspended for the ten (10) day suspension. The fine to be paid is five thousand dollars ($5,000.00) which is the maximum penalty. The full amount is due within seven (7) days. AGENDA LOCAL LICENSING AUTHORITY MARCH 16, 1994 PAGE TWO D. Within the next ninety ( 90) days, and at all times thereafter, seventy percent (70 %) of the Licensee's service personnel are to be certified by the TIPS or colorado Restaurant Association Training Program. New hires shall receive such training within a ninety (90) day period from their date of hire. Documentation supporting this requirement shall be provided to the Town Clerk on a monthly basis. 4. Consideration of the Authority of recent renewals: Colorado Ski Service, Inc., d /b /a Vista Bahn Ski Rentals; Sonnenalp Properties, Inc., d /b /a Bully Ranch & Bar; Steven Satterstrom, Inc., d /b /a Seasons at the Green; and Sweet Basil, Inc., d /b /a Sweet Basil. APPROVED, 4 -0 Newlands, Inc., d /b /a Wanderers Restaurant Larry Barnes, President of the Potato Patch Homeowner's Association presented petitions against the renewal of the Wanderers License. After brief discussion, the Authority approved a motion to set a Renewal Hearing on the matter for the next regular meeting of the Local Licensing Authority, Wednesday, April 13, 1994 at 10:00 a.m. APPROVED, 4 -0 5. Any other matters the Authority wishes to discuss. 6. Next scheduled special meeting March 24, 1994. Next scheduled regular meeting April 13, 1994. McCutcheon Secretary to the Authority i� TOWN OF VAIL 75 South Frontage Road Vail, Colorado 81657 303 - 479 -2100 FAX 303 - 479 -2157 FOR IMMEDIATE RELEASE March 17, 1994 Contact: Holly McCutcheon, 479 -2136 Town Clerk GARFINKEL'S FINED $5,000 IN LIEU OF LIQUOR LICENSE SUSPENSION (Vail) -- Garfinkel's, a bar and grill in Lionshead, will pay a $5,000 fine to the Town of Vail for violating the state's liquor laws following a suspension- revocation hearing yesterday (3 -16) by the Local Licensing Authority. The bar admitted serving liquor to minors on two occasions in December, and to charges of "prohibited conduct" by the bar manager on Jan. 9. The liquor board considered the three incidents as one violation and rendered a 30 day license suspension. Twenty days of the 30 -day suspension were deferred for a one year period pending no further violations. Garfinkel's also was granted permission, as provided by state law, to pay the maximum fine of $5,000 in lieu of closing the establishment for 10 days. Also, within the next 90 days, and on an ongoing basis thereafter, 70 percent of the bar's employees will be required to receive TIPS certification (training intervention procedures for servers of alcohol) or similar training from the Colorado Restaurant Association. (more) Liquor /Add 1 Vail Police Chief Ken Hughey said the board's action represents zero tolerance for sales to underage drinkers. "It is clear to us in the Police Department that the community standard in Vail is not to tolerate or condone this type of activity," said Hughey. "This should send the message loud and clear." Hughey said the bar has taken the violations seriously, noting that compliance has been excellent since the initial incidents.
