Consideration of the Authority of a Corporate Structure Change for Chart House, Inc., d /b /a Chart House, a Hotel & Restaurant License with extended hours located at 610 West Lionshead Circle, Vail, Colorado. PUBLIC HEARING - Consideration of the Authority of the Renewal of the Hotel and Restaurant license for Newlands, Inc., d /b /a Wanderers Restaurant at the location of 950 Red Sandstone Road, #43, Vail, Colorado. The following items may be considered, as well as any other items that may affect the renewal of said license: 1) At their last regular meeting, the Local Licensing Authority was presented with complaints against the licensee and a signed petition, requesting that the license not be renewed. The Local Licensing Authority shall consider the reasonable requirements of the neighborhood and the desires of the adult inhabitants. Town attorney, Tom Moorhead informed the Authority that Kevin Lindahl would be taking his place, due to a conflict of interest to wit, FDIC v. 770 Potato Patch Dr. Condominium Association and Town of Vail Civil Case No. 94 -B -151 in the U.S. District Court for the District of Colorado. Wanderers Operating Manager, James Phillips, was present and briefly updated the Authority on the history of the restaurant, as well as issues with the Potato Patch Homeowner's Association. Attorney, James Bull, representing Potato Patch Homeowner's Association President, Lois Paul, presented the Authority with petitions signed by 19 residents of Potato Patch. Such petitions opposed the renewal of said license, alleging the following: excessive noise, parking violations, litter in common areas, and improper neon signage. The Local Licensing Authority determined that there were no violations of the Colorado Liquor Code and that the reasonable requirements of the neighborhood were being met. The Authority felt that the issues being discussed were outside the purview of the Local Licensing Authority and should be dealt with between the restaurant and the homeowner's association. The Authority recommended that the Wanderers Hotel and Restaurant License be renewed. APPROVED, 5 -0. AGENDA LOCAL LICENSING AUTHORITY APRIL 13, 1994 PAGE TWO 4. Mitzi Gimenez informed the Authority of her upcoming relocation to France, and stated that today would be her last meeting. Mitzi thanked the other members for their support. 6.
